A North Carolina Division of Marine Fisheries (DMF) Fisheries Resource Specialist has reviewed the
CAMA Major Permit application for proposed actions that impact fish and fish habitats. The
applicant proposes to install a new 8' x 65' floating dock and two 14' x 14' boatlift waterward of an
existing pier and platform, creating four slips. The waters of the AIWW are classified SA-ORW by
the Division of Water Quality. The project area is not designated as a Primary Nursery Area (PNA)
by the N.C. Division of Marine Fisheries and is open to the harvest of shellfish.
The applicant proposes to install a new 8' by 65' floating dock and two 14' by 14' boatlifts
waterward an existing pier and platform to create 4 new slips. Existing water depths along the
outboard side of the existing platform are approximately -1.2' NLW and drop off to -2.5' NLW at the
terminal end of the proposed floating dock. Water depths along the floating dock range from -1.6' to
-2.5' NLW.
The project is being proposed within submerged aquatic vegetation (SAV) habitat. In 2015, SAV was
mapped directly under the existing 14' x 22' fixed platform. Though, the DCM field representative
did not find SAV on their site visit, the project area is suitable habitat for SAV, and SAV is abundant
in the surrounding areas. Submerged aquatic vegetation is a vital component to the estuarine
system and is prime nursery area for many fisheries species, such as gag grouper, flounder, red
drum, black sea bass, weakfish and Atlantic croaker; supports high diversity of foraging fish and
invertebrates; provides valuable ecosystem services as a primary producer and enhancer of water
quality; filters water and stabilizes sediment.
The DMF recommends that all docks and piers in SAV habitat be constructed in a manner to avoid
and minimize short-term construction effects, long-term shading effects, and long-term effects of
uses of the facilities, especially boating. In general, a minimum of 2' NLW is needed to prevent
bottom damage at the docking facility. Waters less than two feet deep, where SAV is present,
floating docks could sit on the bottom for portions of the tide which degrades these sensitive
resources and boating to and from the dock can cause damage. Therefore, the DMF recommends
that all floating structures for this project should be constructed in water depths less than 2' NLW.
To accomplish this, the proposed 8' x 65' section of floating dock should be reoriented into a
configuration that places all floating structure waterward of the 2' contour. The Division also
recommends physical stops be placed at 18" above the substrate with the tie pilings along the
landward side of the structure to prevent dockage in waters less than 2' NLW.
