I reviewed the 1995 Rules that were in effect at the time this permit was issued (available at the bottom of this website) and didn't see a clear definition of surface waters. Today, 15A NCAC 02H.1019(6)(b) of the current 2017 rules define surface waters that require a setback in coastal counties as: (b) VEGETATED SETBACKS. For all subject projects within the Coastal Counties, vegetated setbacks from perennial waterbodies, perennial streams, and intermittent streams shall be at least 50 feet in width for new development and at least 30 feet in width for redevelopment and shall comply with Rule .1003 (4) of this Section. The use of this definition for this project will depend greatly on the project area of the original permit and if the 2017 rules would be triggered by the proposed improvements. If the proposed improvements can fall under the current permit and 1995 rules, I do believe that this definition is reasonable and can be used as good guidance. I would suggest working with Holley (cc'ed) to determine what these ditches would be considered and we can go from there, if needed. I wanted to see if someone might be able to offer input relative to DEQ's current position on what is designated as a "surface water". We've been asked to help Brunswick County Schools develop a stacking lane on campus to get traffic off HWY 17 during drop-off and pick-up times. The original permit (excerpt attached) reveals a low density permit, with language that a 30' buffer is required between surface waters and impervious areas. A stacking lane best fits over an existing roadbed (access point to the septic field area). Construction of a stacking lane in this location places additional impervious area within 30' of ditches that will likely be classified as jurisdictional by the USACE. The ditches are along the property lines adjacent to the proposed stacking lanes (concepts attached for reference). I was wanting to make sure there was nothing preventing the use of the proposed location on campus as it is ideal to overlay where this existing roadbed is located, but didn't want to misunderstand "surface water' and propose something that could be inconsistent with the underlying permit.
