The Wilmington Regional Office received the Stormwater Management Permit Application for Bolivia Elementary School
Addition on July 23, 1998, with final information on October 14, 1998. Staff review of the plans and specifications has
d-tc:-min-.A- that the project. as proposed. will comply with the Stormwater Regulations set forth in Title 15A NCAC
2H.1000. We are forwarding Permit No. SW 980733 dated October 19, 1998, for the construction of Bolivia Elementary
School Addition.
This permit shall be effective from the date of issuance until rescinded and shall be subject to the conditions and limitations
as specified therein, and does not supercede any other agency permit that may be required.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an
adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in
the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office
of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this permit
shall be final and binding.

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and other
applicable Laws, Rules and Regulations
PERMISSION IS HEREBY GRANTED TO

FOR THE
construction, operation and maintenance of a 30 % low density development in compliance with the provisions of 15A
NCAC 2H .1000 (hereafter referred to as the "stormwater rules") and the approved stormwater management plans and
specifications, and other supporting data as attached and on file with and approved by the Division of Water Quality and
considered a part of this permit for Bolivia Elementary School Addition.
The Permit shall be effective from the date of issuance until rescinded and shall be subject to the following specific
conditions and limitations:
I. DESIGN STANDARDS
The total allowable built -upon area for the tract is 89,368 square feet, based on an adjusted site area which excludes
the 169,588 square feet of existing impervious areas.. This permit covers the construction of 4,815 square feet of
additional built -upon area.
2. The overall tract built -upon area percentage for the project, based on the adjusted site area of 297,894 square feet,
must be maintained at 30%, as required by Section 1005 of the stormwater rules.
3. Approved plans and specifications for projects covered by this permit are incorporated by reference and are
enforceable parts of the permit.
4. The only runoff conveyance systems allowed will be vegetatcd conveyances such as swaies with minimum side
slopes of 3:1 (H: V) or curb outlet systems as defined in the stormwater-rules and approved by the Division.

5. No piping shall be allowed except:
a. That minimum amount necessary to direct runoff beneath an impervious surface such as a road.
b. That minimum amount needed under driveways to provide access to lots.
c. That amount which existed on site prior to issuance of this permit, or which is being replaced or relaid,
as shown on the plans.
b. Projects covered by this permit will maintain a minimum 30 foot wide vegetative buffer between all new impervious
areas and surface waters.
7. The tract will be limited to the amount of built -upon area indicated iJ.
aa the approved plans.
8. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable built -
upon area.
9. The Engineer/Owner/Developer/Permittee must certify in writing that the project's stormwater controls, and
impervious surfaces have been constructed within substantial intent of the approved plans and specifications. Any
deviation from the approved plans must be noted on the Certification.
10. The Director may notify the permittee when the permitted site does not meet one or more of the minimum
requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time
schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies
of revised plans and certification in writing to the Director that the changes have been made.
IL The following items will require a modification to the permit. Revised plans, specifications -and calculations must
be permitted prior to the permittee beginning construction on the modification:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
c.. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area.
e.. Further subdivision of the project area.
f. Filling in, altering or piping any vegetative conveyance shown on the approved plan.
In' addition, the Director may determine that other revisions to the project should require a modification to the
permit.
II. SCHEDULE OF COMPLIANCE
1. The permittee shall comply with the following schedule for construction and maintenance of the Low Density
Option stormwater systems:
a. Swales and other vegetated conveyances shall be eoinstiucted in their entirety, vegetated, and be operational
for their intended use prior to the construction of any built -upon surface except roads.
b. During construction, erosion shall be kept to I a minimum and any eroded areas of the swales or other
vegetated conveyances will be repaired immediately.
2. The permittee shall submit the Engineer/Owner/Designer/Permittee Certification within 30 days of completion of
the project.

3. The permittee shall at 'all times provide the operation and maintenance necessary to operate the permitted
stormwater management systems at optimum efficiency to include:
a. Inspections
b Sediment removal.
C. Mowing, and revegetating of the side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and specifications.
4. The permittee shall submit all information requested by the DirectoA.

III. GENERAL CONDITIONS
Failure to abide by -the conditions and limitations contained in this permit may subject the Permittee to an
enforcement action by the Division of Water Quality, in accordance with North Carolina General Statutes 143-
215.6A to 143-215.6C.
2. The permit issued shall continue in force and effect until revoked or terminated.
3. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit
modification, revocation and reissuance, or termination does not stay any permit condition.
4. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and
reissuing the permit, or terminating the permit as allowed by the laws, rules, and regulations contained in Title 15A
of the North Carolina Administrative Code, Subchapter 2H.1000; and North Carolina General Statute 143-215.1
et. al.
5. The permit is not transferable to any person except after notice to and approval by the Director. The Director may
require modification or revocation and reissuance of the permit to change the name and incorporate such other
requirements as may be necessary. A formal permit request must be submitted to the Division of Water Quality
accompanied by the appropriate fee, documentation from both parties involved, and other supporting materials as
may be appropriate. The approval of this request will be considered on its merits, and may or may not be
approved.
6. The permittee grants permission to DENR Staff to enter the property for the purpose of inspecting all components
of the stormwater management facility.
7. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules,
regulations, or ordinances which may be imposed by other government agencies (local, state and federal) which
have jurisdiction.

Following is the revised application for Bolivia Elementary School. I have stated in my
response to your letter that there are no wetlands on site. Please call to let me know if this will
suffice, since the original mylars of the plans are now with the Architect. If I have to, I will
have them sent hack to me to add the note to the plans, but the time delay would seem a bit
unworthy. Further delays on this project may cost taxpayers thousands of dollars in
remobilization charges .Please call me to let me know if there is anything we can do to
expedite this approval.

Dear Ms. Lewis:
We received your request for additional information for the above mentioned project,
dated October 13, 1998. We offer the following responses to your comments,
1. Page 3 of the application and low density application have been initialed,
2. Low density calculations have been added to the low density supplement in the
calculation box provided.
3. There are no wetlands located on this site.
As we have previously discussed, this project has an extremely tight time schedule in
order to coordinate construction with the school schedule. The building inspector will not
issue a building permit for any work until we have an approval letter from your office.
Since these were such minor comment items , if there is any way that you could accelerate
the review process, it would be greatly appreciated. Should you require any additional
information, or have any comments, please do not hesitate to contact either Alan Lewis or
myself at our office.

Drainage Area #1: Currently 17,010 SF of impervious area drain to a tributary of Middle
Swamp through a curb cut and flume in the existing parking lot. The proposed
development will drain 10,425 SF to the same curb cut (most of this is existing asphalt).
An additional 12,175 SF of building area will be collected in roof drains and discharged
into a vegetated filter above Town Hall, into the same tributary,
Drainage Area #2: Currently 57,779 SF of impervious area drain to an existing system of
catch basins and piping, and is discharged through an existing pipe to the tributary of
Middle Swamp. The proposed development will drain 57,235 SF of impervious area
(combination of existing and proposed impervious areas) to piping system and discharge to
tributary through the existing pipe. The number of inlets will not increase, althbugh some
piping and inlets will be relocated to route them around the proposed buildings,
Drainage Area #3: Currently 31,172 SF of asphalt parking area sheet flows off at the
southern corner of the parking lot. The proposed development will have 31,709 SF of
impervious area sheet flow to same location.
Drainage Area #4: Currently 3168 $F of asphalt drain by sheet flow into the NCDOT
drainage ditch. Proposed development reduces this sheet flow to 2103 SF of asphalt area.

Dear Mr. Bowman:
The Wilmington Regional Office received a Stormwater Management Permit Application for Bolivia
Elementary on July 23, 1998. A preliminary review of that information has determined that the application
is not complete. The following information is needed to continue the stormwater review:
1. Please have Page 3 of the application and the low density supplement initialled.
2. On the low density supplement, please demonstrate compliance with low density in the
calculation box provided at the bottom. The method to demonstrate this is to subtract the
existing impervious area (169,588) from the overall site area (467,482) to get the "adjusted
site area" (ASA). The ASA is then multiplied by the appropriate density factor, 30 % in this
case, and the product is the allowable built -upon area for the expansion. This number is then
compared to the proposed increase in impevious area, (4,815) to see if the increase is less than
or equal to the allowable.
3. Delineate all wetlands on site, or note on the plans that none exist.

We are pleased to submit two copies of the Stormwater Plan for Bolivia Elementary
School. We have enclosed the review fee of $225, two copies of the application, and two
copies of the calculations, and stormwater summary.
Although this project does not clearly fall into either the low or high density criteria,
we ask that it be given consideration for the low density option. From the stormwater
summary, it is obvious that we are changing the amount of impervious area a relatively
small amount. Although we are proposing that we utilize some of the existing piping, we
are actually decreasing the amount of impervious area draining into the existing system. By
discharging the majority of the runoff from the new building into a vegetated filter, this
design is decreasing the amount of parking lot runoff that currently is discharged directly
into the tributary through an existing curb cut.
We trust that you will find our submittal package in order. Should you require any
additional information, or have any comments, please do not hesitate to contact either Alan

I talked to BB about this one and we both are leaning toward low
density, but need more info on the project.
1. How much impervious area are they adding?
2. How much total impervious are they up to?
3. What happens to the flow discharging from the collection system?
4. Are they adding any collection? I can't tell from this plan whats
new (if any) and whats existing piping. 5. Are they routing all the
new stormwater to the existing system or proposing to do something
else with it? It looks like some sheet flows off the west end of the
parking lot, but sheet flows to what?

Bolivia Elementary School
Based on the plan we have on file up here, this project looks like
redevelopment. One existing parking lot is being converted to a
building and one existing parking lot is being reconfigured to include
islands. Can the islands be used for bioretention with curb cuts?
How much exisitng area is available on -site to meet MEP? And is the
S/ECP the trigger mechanism for the state permit?

My understanding here is that no new impervious drainage will be routed
to the existing storm sewer system b/c the new building will occupy the
same impervious footprint as an existing parking lot which already
drains to the system. However, new parking will be added, so
redevelopment is out. I'm assuming there is enough property involved to
consider low density if it weren't for the collection system. What do
they propose to do with the drainage from the new parking lot?
