Division personnel have reviewed and approved your application for renewal of the subject permit. Accordingly,
we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of
North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the
U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended).
The permit contains the following changes from your current permit:
• The WET testing special condition was modified to require use of ceriodaphnia dubia as the test organism
while performing a Chronic toxicity test with 90% effluent.
• Effluent sampling data for copper and iron showed reasonable potential to violate Water Quality Standards.
Since both of these parameters have action level standards, monitoring shall be performed in conjuction with
Whole Effluent Toxicity (WET) tests. In accordance with the NPDES Monitoring Frequency memo dated
July 2010, the sampling frequency for both parameters was reduced to quarterly.
• Effluent sampling data for chloride showed reasonable potential to violate Water Quality Standards.. This
parameter has an action level standard and monitoring is to be performed in conjunction with Whole Effluent
Toxicity (WET) tests. This permit removes the current chloride limitation and requires that chloride be
sampled in conjunction with WET tests. See footnote #4.
• The test organism for the WET test has been changed to ceriodaphnia dubia. It has been determined that
ceriodaphnia dubia is the most sensitive test species in the receiving waters.
Note that if toxicity failures are demonstrated with the use of ceriodaphnia dubia as the test organism the
permittee shall perform a Discharge Alternatives Evaluation as described in Section A. (3).

• In accordance with the NPDES Monitoring Frequency memo dated July 2010, the sampling frequency for
chloride was reduced to quarterly.
• Monitoring for flow, pH, and dissolved oxygen was increased to 2/month per the WTP Strategy.
• Monitoring for TP and TN was reduced to quarterly in accordance with 15A NCAC 2B .0500.
• Turbidity monitoring was added in accordance with Administrative Code 15A NCAC 2B .0500 and per the
Region lV EPA letter dated 2/25/2009.
• The flow limitation was removed and composite sampling for certain parameters was added as required by
the WTP Strategy for maximum, monthly average discharge flows > 50,000 gpd.
• A TRC footnote was added to Section A.(1.) to include the following statement: Limit and
monitoring apply only if chlorine or chlorine derivatives are used for disinfection. The Division
shall consider all effluent TRC values reported below 50 µg/L to be in compliance with the permit.
However, the Permittee shall record and submit all values reported by a North Carolina certified
laboratory (including field certified), even if these values fall below 50 µg/L.
• The wording in Section A. (2.) has been changed and the following paragraph added: If the
Permittee monitors any pollutant more frequently then required by this permit, the results of such
monitoring shall be included in the calculation and reporting of the data submitted on the Discharge
Monitoring Report and all AT Forms submitted. Please review the entire section carefully.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you,
- you have the right to an adjudicatory hearing upon written request within thirty (30) clays following receipt of
this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North
Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center,
Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be fmal and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may require
modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to
obtain other permits which may be required by the Division of Water Resources or permits required by the
Division of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental
permit that may be required.

All previous NPDES Permits issued to this facility, whether for operation or discharge are
hereby revoked. As of this permit issuance, any previously issued permit bearing this number
is no longer effective. Therefore, the exclusive authority to operate and discharge from this
facility arises under the permit conditions, requirements, terms, and provisions included
herein.
Chowan County Water Department is hereby authorized to:
1. Continue to operate greensand and ion exchange water treatment units designed to
produce 2.3 MGD of potable water with filter backwash and softener recharge
wastewaters having a maximum, monthly average discharge of 0.055 MGD. Potable
water treatment units include:
• Six filters
• Four Ion exchange units
The facility is located at the Valhalla Water Treatment Plant, 1608 Virginia Road,
(intersection of NC Highway 32 & NCSR 1222), Edenton, Chowan County.
2. Discharge from said treatment works at the location specified on the attached map into
an unnamed tributary to Pollock Swamp, classified C-NSW in the Chowan River Basin.

A.(2.) CHRONIC TOXICITY PASS/FAIL MONITORING (QUARTERLY)
The permittee shall conduct quarterly chronic toxicity tests using test procedures outlined in the
"North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised December 2010, or
subsequent versions.
The effluent concentration defined as treatment two in the procedure document is 90%. The testing
shall be performed as a Ceriodaphnia dubia 7-day pass/fail test. The tests will be performed during the
months of February, May, August, and November. These months signify the first month of each three
month toxicity testing quarter assigned to the facility. Effluent sampling for this testing must be
obtained during representative effluent discharge.and shall be performed at the NPDES permitted
final effluent discharge below all treatment processes.
All toxicity testing results required as part of this permit condition will be entered on the Effluent
Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter
code TGP3B. Additionally, DWQ Form AT-1 (original) is to be sent to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later
than 30 days after the end of the reporting period for which the report is made.
• Test data shall be complete and accurate and include all supporting chemical/physical measurements
performed in association with the toxicity tests, as well as all dose/response data. Total residual
chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for
disinfection of the waste stream.
Should there be no discharge of flow.from the facility during a month in which toxicity monitoring is
required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test
form indicating the facility name, permit number, pipe number, county, and the month/year of the
report with the notation of "No Flow" in the comment area of the form. The report shall be submitted
to the Environmental Sciences Section at the address cited above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required, then
monthly monitoring will begin immediately. Upon submission of a valid test, this monthly test
requirement will revert to quarterly in the months specified above.
Should any test data from this monitoring requirement or tests performed by the North Carolina
Division of Water Resources indicate potential impacts to the receiving stream, this permit may be re-
opened and modified to include alternate monitoring requirements or limits.
If the Permittee monitors any pollutant more frequently then required by this permit, the results of
such monitoring shall be included in the calculation & reporting of the data submitted on the DMR &
all AT Forms submitted.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival, minimum control organism reproduction, and appropriate environmental controls,
shall constitute an invalid test and will require immediate follow-up testing to be completed no later
than the last day of the month following the month of the initial monitoring.

A. (3.) DISCHARGE ALTERNATIVES EVALUATION
If after performing four WET tests using ceriodaphnia dubia as specified in Section A.(2.) the
permittee demonstrates toxicity failures (2 consecutive failures at any time), the permittee shall
initiate the following evaluation.
DISCHARGE ALTERNATIVES EVALUATION:
The Permittee shall assess potential alternatives to eliminate Whole Effluent Toxicity test failures. This
evaluation shall assess the feasibility of all the following alternatives.
1. Connect discharge to a WWTP: Determine whether the wastewater can be discharged to a
wastewater treatment plant. Approval or disapproval from the plant operator
should be acquired.
2, Obtain a Non -discharge permit. Eliminate the surface water discharge by obtaining a non -
discharge permit for spray irrigation, infiltration, or subsurface disposal (on
site drainfield, infiltration gallery, injection wells).
3. Install Wastewater Treatment: Install improved wastewater treatment to enable the facility
effluent to consistently pass the WET test. If this is not technically feasible or
cost prohibitive, please explain and provide estimated costs.
4. Use Alternative Water Treatment Source: Obtain drinking water from another source (nearest
County, City, or Town or other wells) so the discharge or toxicity problem iS
eliminated.
5. Use Alternative Water Treatment Method: Install alternative and/or innovative water treatment
methods or operational improvements that do not produce toxic wastewaters.
For example, install a recycle iron/manganese filtration system with no
discharge.
6. Discharge to a Larger stream: Relocate the facility's discharge to a larger receiving stream to
eliminate or reduce toxic impacts to the stream given the increased dilution.
7. Combination of Alternatives: Employ any combination of the alternatives listed above that would
result in eliminating or decreasing toxicity until a more feasible solution
becomes available.
The evaluation shall include a present value of costs analysis for all technologically feasible options as
outlined in the Division's "Engineering Alternatives Analysis Guidance Document." This Document can
be found at: http:/ /portal.ncdenr.org/web/wq/swp/ps/npdes/permits.
This evaluation is being requested to determine whether there are any economical and technologically
feasible alternatives available to the Permittee to address aquatic toxicity in the plant effluent. If one or
two such alternatives are available to the Permittee, please identify the preferred alternative and an
estimated timeline for implementation. The Permittee shall submit the Discharge Alternatives
Evaluation to the Division along with the submission of their next permit renewal application.

Summary
Chowan County operates the Valhalla WTP which produces 2.3 MGD of potable water. The raw
water obtained from groundwater wells is first chlorinated, aerated, dosed with potassium
permanganate and then held in a 300,000 gallon detention tank for treatment. It is then
filtered and softened and sent to a 1 million gallon clearwell where it can be pumped to the
distribution system as needed. Backwash from the filters and softeners is discharged to a
settling pond which is really an impoundment resulting from a NC DOT dug out for fill. The
impoundment rarely overflows and wastewaters appear to filter through the dirt wall to other
nearby impoundments which are considered part of Pollock Swamp. The average wastewater
discharge from the water treatment units is 0.045 MGD with a maximum discharge of 0.098
MGD during the past five years. The maximum, monthly average flow during the past three
years was 0.055 MGD.
The current permit was issued in July 2008 with an expiration date of November 30, 2012. The
2008 permit has a chloride limitation of 230 mg/L. In Jan. 2010, Chowan County agreed to a
SOC which included a compliance schedule giving the permittee to April 1, 2015 to comply with
the chloride standard. The chloride limit is a chronic EPA water quality criterion and was
adopted by the state of NC as an action level standard to be implemented in conjunction with
toxicity test failures. The Valhalla WTP was failing all of its toxicity tests using ceriodaphia
dubia as the test organism. Chloride was believed to be the cause of these failures though no
toxicity identification evaluation was ever performed.
Uncertain as to whether the permittee was using the correct test organism, later in 2010,
Regional staff in the Washington Office requested that the toxicity monitoring test requirement
be re-evaluated. It was decided that an acute toxicity 24 hour pass/fail test at 90% effluent
concentration using fathead minnow could be the correct test organism if the discharge was
considered episodic. As a result, in Feb. 2010 a permit modification was issued changing the
toxicity test organism to fathead minnow. From that point on, the permittee has passed all its
Whole Effluent Toxicity tests while using the fathead minnow as the testing organism.
Discussions between ATU, NPDES and WaRO staff ensued and it was determined that this
discharge should not be considered episodic. In 2011, DWQ collected samples from the Valhalla
effluent and ran several toxicity tests using ceriodaphnia dubia. Both of these tests
demonstrated toxicity failures. ATU, NPDES, and WaRO staff decided the toxicity test organism
should be changed back to ceriodaphania dubia.
The Aquatic Toxicity Unit and NPDES are currently assessing the number of IE and membrane
WTP dischargers in the state and their impact on state waters. A uniform approach that
requires IE and membrane WTP facilities, failing toxicity tests, to evaluate discharge
alternatives to eliminate aquatic toxicity in the effluent has been developed. At this time,

these permittees do not have WET testing limits only monitoring requirements. However, in an
effort to address the toxicity failures, a special condition requiring a Discharge Alternatives
Evaluation is being put in IE/RO WTP permits whose effluent is demonstrating aquatic toxicity.
For this permit renewal, it is recommended that the chloride limitation be removed, the test
organism be changed back to ceriodaphnia dubia, and if toxicity test failures resume the
permittee will be required to perform a Discharge Alternatives Evaluation. The evaluation
requires that the permittee assess the most feasible and environmentally sound alternatives
available to eliminate aquatic toxicity in the effluent. This renewal will allow for the SOC to be
rescinded and gives the permittee five years to evaluate its alternative options.

A review of the effluent data shows significant variations in metal concentrations, TDS, and
chloride. Other than its chloride limitation the facility is in compliance with its permit.
The following changes are recommended for this permit:
• The WET testing special condition will be modified to require use of ceriodaphnia dubia
as the test organism.
• Effluent sampling data for copper and iron showed reasonable potential to violate

• Decrease monitoring for TP and TN to quarterly in accordance with 15A NCAC 2B .0500
• Add turbidity monitoring per Region IV EPA letter and Administrative Code 15A NCAC 2B

• Remove the flow limitation and add composite sampling for certain parameters as
required by the WTP Strategy for maximum, monthly average flows > 50,000 gpd.

Dear Mr. Lamb:
Enclosed with this letter is a copy of the draft permit for your facility. Please review the draft very
carefully to ensure thorough understanding of the conditions and requirements it contains.
The draft permit contains the following significant changes from your current permit:
• The WET testing special condition was modified to require use of ceriodaphnia dubia as the test
organism while performing a Chronic toxicity test with 90% effluent.
• Effluent sampling data for copper and iron showed reasonable potential to violate Water Quality
Standards. Since both of these parameters have action level standards, monitoring shall be performed in
conjuction with Whole Effluent Toxicity (WET) tests. In accordance with the NPDES Monitoring
Frequency memo dated July 2010, the sampling frequency for both parameters was reduced to quarterly.
• Effluent sampling data for chloride showed reasonable potential to violate Water Quality Standards.
This parameter has an action level standard and monitoring is to be performed in conjuction with Whole
Effluent Toxicity (WET) tests. This permit removes the current chloride limitation from the permit and
revises the WET test to require the permittee to use ceriodaphnia dubia as the test organism. If toxicity
failures are demonstrated with the use of ceriodaphnia dubia as the test organism the permittee shall
perform a Discharge Alternatives Evaluation as described in Section A. (3).
Chowan County will be given approximately one permit cycle to evaluate and document possible
treatment/discharge alternatives to eliminate aquatic toxicity. This report will be carefully reviewed by
the Division and the results will be used in the development of a compliance schedule or possible
variance request for the County. This evaluation is being requested to determine whether there are any
economical and technologically feasible alternatives available to the Permittee to comply with all NC
Water Quality Standards and Whole Effluent Toxicity tests.

• In accordance with the NPDES Monitoring Frequency memo dated July 2010, the sampling frequency
for chloride was reduced to quarterly.
• Monitoring for flow, pH, and dissolved oxygen was increased to 2/month per the WTP Strategy.
• Monitoring for TP and TN was reduced to quarterly in accordance with 15A NCAC 2B .0500.
• Turbidity monitoring was added in accordance with Administrative Code 15A NCAC 2B .0500 and per
the Region IV EPA letter dated 2/25/2009.
• The flow limitation was removed and composite sampling for certain parameters was added as required
by the WTP Strategy for maximum, monthly average discharge flows > 50,000 gpd.
• A TRC footnote was added to Section A.(1.) to include the following statement: Limit and
monitoring apply only if chlorine or chlorine derivatives are used for disinfection. The Division
shall consider all effluent TRC values reported below 50 µg/L to be in compliance with the
permit. However, the Permittee shall record and submit all values reported by a North Carolina
certified laboratory (including field certified), even if these values fall below 50 µg/L.
• The wording in Section A. (2.) has been changed and the following paragraph added: If the
Permittee monitors any pollutant more frequently then required by this permit, the results of
such monitoring shall be included in the calculation and reporting of the data submitted on the
Discharge Monitoring Report and all AT Forms submitted. Please review the entire section
carefully.
Concurrent with this transmittal, the Division will solicit public comment on this draft as required by the
EPA by publishing a notice in newspapers having circulation in the general Chowan County area.
Please review this draft carefully to ensure thorough understanding of the information, conditions, and
requirements contained therein. Should you wish to correct errors or provide comments regarding this draft
please contact the DENR / DWQ / NPDES Program no later than October 18, 2013.
Following the 30-day public comment period, the Division will review all pertinent comments and take
appropriate action prior to issuing a final NPDES permit. If you have questions concerning the draft permit

Sorry for the delayed response. I have reviewed my notes, and yes, we had agreed that the correct test for the facility
should be the 7-day chronic Ceriodaphnia dubia, based on their IWC (which is 100%) and the frequency of their
discharge, which we consider to be more than episodic.
Also, just wanted to say I thought you did a great job on the discharge alternatives evaluation.

Cindy, Susan, Carol and Robbie, I changed the toxicity test back to 90% chronic using ceriodaphnia dupia. Can you
please review your notes, I know I was to change it back to using that test organism and I assumed it goes back to a
chronic test. Is that correct?

Raw water is chloronated and aerated, potassium permangenate is added and the water is
then held in a 300,000 gallon detention tank. It is then filtered and softened. Chlorine is
added again prior to storeing it in a lmg clearwell. It is then pumped to the distribution
system as needed.

facility:
Wastewater is generated when filters are backwashed three times per week. 80,000 gallons
of filter backwash is generated each time the filters are backwashed. The softners also
generates wastewater. Each softner is regenerated automatically. On average two of the
four softners are regenerated per day which produces 12,000 gallons of wastewater.
