Klimek, P.E., Director Division of Water Quality May 20, 2004 Subject: Modification of NPDES Permit NC0020940 Murphy WWTP Cherokee County The Division issued the subject permit on November 26, 2003. That permit contained a footnote on the Effluent Limits and Monitoring Requirements pages that stipulated the use of EPA Method 1631 for Total Mercury analyses. Further review of the permit file has found this requirement to be incorrect; your facility's Total Mercury limits are higher than the threshold requiring use of method 1631. This modification removes the footnote requiring Method 1631. Note that no limits or monitoring frequencies have been changed. No other changes to the permit have been made. Please find enclosed the revised pages, which should be inserted into your permit. The old pages may then be discarded. All other terms and conditions contained in the original permit remain unchanged and in full effect. This permit modification is issued under the requirements of North Carolina General Statutes 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency. If any parts, measurement frequencies or sampling requirements contained in this permit modification are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be a written petition conforming to Chapter 150B of the North Carolina General Statutes, filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Both effluent sheets have a footnote requiring that Method 1631 be used for mercury analyses. However, Murphy is not on the list of "1631 facilities," and their mercury limits are high enough that the 245 method is adequate. I discussed it with Tom, and he agrees with the mod.
