BISER Secretary BRAXTON DAVIS Director Inlet Point Harbor BOA clo Adam Knierim 108 Circle Drive Hampstead, NC 28443 Dear Mr. Knierim, NORTH CAROLINA Environmental Quality November 3, 2021 This correspondence is with reference to the request you submitted to modify State Permit No. 160-05, which was originally issued to Inlet Point Harbor BOA clo Ann Bowman on October 21, 2005, for maintenance excavation of an existing boat basin and access channel, adjacent to the AAIWW, Myrtle Grove Sound, in New Hanover County. State Permit No. 160-05 was modified on June 28, 2006, for the replacement of the existing, deteriorating wooden bulkhead located within the Inlet Point Harbor BOA basin and access channel. State Permit No. 160-05 was modified on January 23, 2021, and again on March 12, 2013, to remove/cut the filter cloth at the location of the weep holes of the new composite bulkhead. State Permit No. 160-05 was modified again on March 23, 2015, authorizing the construction of an additional approximately 78 linear ft. of new composite bulkhead. State Permit No. 160-05 was last renewed February 5th, 2018, to maintain the Maintenance 5 Clause, which is due to expire on December 31, 2022. The action proposed is one-time use of an alternate spoil disposal location for a maintenance excavation event of 200cy. The proposed disposal location is a residential lot located at 246 Inlet Point Drive, Wilmington NC 28409. The spoil location is to be located greater than 30 feet from Normal High Water and no filling of Coastal Wetlands is authorized. A permission letter was provided by you from the property owner, Ms. Gayle Nicholson, who is replacing a portion of the bulkhead on the parcel. Upon review of the information provided, the Division of Coastal Management has determined that the proposed action continues to be consistent with existing State rules and regulations and is in keeping with the original purpose and intent of the permit. 1 hereby submit this Letter of Refinement authorizing the modification of State Permit No. 160-05, as described in your request dated October 29, 2021. By copy of this letter we are notifying the US Army Corps of Engineers and the Division of Water Resources of our action. Please note this refinement does not alleviate the need to obtain any other local, state or federal permits. Additionally, we would like to request a onetime minor modification to the permit to allow placement of 200cy of material in the Nicholson yard located adjacent to the work area. I wanted to touch base on a small project that we have at Inlet Watch located near Carolina Beach Inlet. The community would like to initiate maintenance dredging of a small shoal located within their existing entrance channel. The project consists of removing approximately 200cy of sandy material and placing it at 246 Inlet Point Drive for use as backfill after their bulkhead project is completed. I dont have the exact name of the company conducting the bulkhead work but the owner's name is Zack and I believe the company is Northend Builders. I have attached a copy of the major permit and a corresponding drawing showing the proposed area of maintenance excavation. Please give me a call if you have any questions or concerns.
