The flow requested in this application is to be tributary to Union County's Twelve Mile Creek WWTP, which is in chronic noncompliance with NPDES permit limits and current hydraulic flows are at or near the WWTP's permitted capacity. In order to complete our review of this project and approve the requested flow for this proposed development, a full evaluation of current and future tributary flow (including allocated flows that are not yet "on-line") must be conducted for the Union County Utilities collection system and associated WWTP facilities. Upon receipt of this information, the MRO may consider permitting the subject collection system based on a review of your flow assessments. Please be advised that the Surface Water Protection Section is considering placing the County on a moratorium for all pending and future sewer collection system permits that are to be tributary to Union County's 12-Mile Creek WWTP due to the continuing permitted capacity issues noted above. The County is also responsible for meeting all requirements set forth by pertinent North Carolina rules and regulations. Failure to provide the information requested above or any omissions made in responding to the above items may result in the denial of future collection system applications or having the application returned as incomplete if we lack information necessary to perform our review. A written response should be submitted to this Office by no later than December 15, 2006, which provides the information requested in the first paragraph this letter. The agreement specifies that one half the sanitary sewer capacity fees to be paid to reserve the capacity for the initial 250 lots plus community clubhouse and pool. A site plan is attacheddepicting the initial 250 lots. The contract provides the option for Centex. Homes to pay one half thesanitary sewer capacity fees for the balance of the lots (254 units) at the same time as payinent for the initial lots to reserve capacity. The initial 250 lots plus community clubhouse and pool would be able to flow immediately upon State •permitting.
