On May 8, 2008, the Wilmington Regional Office received a plan revision for
Stormwater Management Permit Number SW8 960818 Modification. The revisions include the
following:

Previously Approved Plan Revision That Was For The Construction Of 0.77 Acres Of Built -

Please be aware that all terms and conditions of the permit issued on October
19, 1999 remain in full force and effect. Please also understand that the
approval of this revision to the approved plans for the subject State Stormwater
Permit is done on a case -by -case basis. Any other changes to this project must
be submitted to and approved through the Division of Water Quality prior to
construction. The issuance of this plan revision does not preclude the permittee
from complying with all other applicable statutes, rules, regulations or ordinances
which may have jurisdiction over the proposed activity, and obtaining a permit or
approval prior to construction.

Hi Karen.
I am putting this in writing for you because of some previous confusion here
regarding permit renewal dates. We have a policy that is being developed concerning
when permits that have been modified should be renewed, but it is not complete yet.
However, as it stands currently, this permit was modified in 1999 as you mentioned
and, per that modification, is not up for renewal until 2009. Therefore it is not
required for that renewal request to be submitted prior to the processing of your
request for a plan revision. The plan revision will be reviewed as quickly as it can
be in the file review queue, but I would not expect any response for at least another
30 days.
Please let me know if there is anything further where I may assist you.

Enclosed is a revised site plan for an additional parking area at the Jungle Rapids Family Fun Park,
permit number SW8 960818. Previous on -site impervious surface was 5.71 AC. This additional
parking area adds 3.34 AC, bringing the total on -site impervious surface area to 9.05 AC. The current
stormwater permit allows for a total of 11.83 AC of on -site impervious surface to drain to the
stormwater pond. V
The proposed additional parking area drains to Forebay 1 of the Stormwater Pond by either sheet
flow or through a storm drain system. Notes detailing the impervious surface areas have been added
to sheet C1.
Permit number SW8 960818 was originally issued on November 20, 1996 and was modified on
October 19, 1999. In October 2001, an additional parking area was added to the plans by way of a
plan revision. For your convenience, a copy of the previous modification and revision and related
correspondence has been enclosed.

Denise:
Nothing has been said regarding the implementation date of the new coastal rules.
We don't even know what the rules will be yet. We know what we have recommended to
the Legislature, but there's no telling what changes the Legislature will make. I
hesitate to commit the Division to any agreement until we know for sure what the
new rules will be. Once we know, a policy regarding the implementation date of
those new rules to new applications and modifications to existing projects will be
established.

Stormwater Permitting Determination from DWQ

Dear Ms. Lewis:
WK Dickson is writing on behalf of Jungle Rapids to obtain clarification of the impact of the proposed
coastal stormwater rules on future development of the property. It is our understanding that the
proposed coastal stormwater rules are anticipated to go into effect on August 1, 2008.
Currently, the Jungle Rapids property has a high density stormwater permit, SW8 960818, with
stormwater treatment provided in a wet detention basin. The wet detention basin was designed and
permitted to provide water quality treatment for the future development of the property with an
allowable built upon area of 70% or 515,305 square feet. In addition, the owner was required to
provide treatment for 250,034 square feet of off -site impervious surface. Per the current stormwater
permit, the future development of the property may require a modification of the existing stormwater
permit depending upon the proposed development. The determination of whether a permit
modification is necessary or if a plan revision is adequate for the future development will be
determined by NCDENR on a case by case basis. The property is located within '/z mile of SA waters.
Our understanding of the impact of the proposed stormwater rules when they go into effect is as
follows:
• Future development of the property up to the permitted on -site built upon area of 515,305
square feet will be reviewed either by permit modification or plan revision under the
stormwater rules that were in effect at the time the permit was originally issued for the site.
Runoff from the on -site permitted built upon area will be conveyed to the existing permitted
wet detention basin either by sheet flow or piping.
• No design revisions or modifications will be required to the permitted wet detention basin as
long as the on -site built upon area is limited to the permitted 515,305 square feet.

No additional stormwater facilities will be required on the property as long as on -site built
upon area is limited to the permitted 515,305 square feet and runoff is conveyed to tho existing
permitted wet detention basin.
No design revisions or modifications to the permitted wet detention basin will be required nor
will additional stormwater facilities be required for redevelopment of existing impervious
surfaces as long as the on -site built upon area is limited to the permitted 515,305 square feet.
If future development of the property exceeds the permitted on -site built upon area of 515,035
square feet, the amount of built upon area in excess of the permitted on -site built upon area
would need to meet the stormwater rules in place at the time the built upon area was proposed
to be constructed.
Mr. Daniel Dawson of our office had a telephone conversation with Mr. Tom Reeder in the Raleigh
office of the Division of Water Quality on March 19, 2008 to discuss our understanding of the impact
of the proposed coastal stormwater rules on this property. Mr. Reeder indicated that based on the
information provided to him during the telephone call, he concurred with our understanding and
agreed that a letter to you to obtain written confirmation of our understanding was appropriate.
Please provide written confirmation that our understanding of the future permitting requirements for
this site is correct. If our understanding is not correct, please clarify what impact the proposed coastal
stormwater rules will have on the future development of the permitted property. Given the rapidly
approaching effective date of the new rules, we would appreciate a timely response to our clarification
request.
We have enclosed a copy of the most recent permit modification and plan revision with the updated
