North Carolina 28772 Subject: NPDES Permit Modification Permit Number NC0000311 M-B Industries, Rosman Facility Transylvania County Dear Mr. Morrow: The Division issued NPDES permit number NC000031 1 to M-B Industries for its Rosman facility on April 2, 2001. The Division has reviewed your request for permit modification at the subject facility. Specifically. you requested the following (DWQ's response appears in parentheses after each request): record data is 1. Elimination of monitoring for cadmium, nickel, copper, cyanide. lead and silver at outfall 001 (Monitoring for these parameters is a requirement as they are listed as pollutants of concern in 40 CFR 433.13.); 2. Reduction of the monitoring frequency for all other parameters in outfall 001 (Based on a review of effluent data for the period January 2002 - present, the monitoring frequency for silver, nickel, lead, and cadmium can be reduced to quarterly, and the monitoring frequency for copper, cyanide, phenols, and TTO can be reduced to monthly. Given the relatively high effluent concentrations of zinc and chromium, the monitoring frequency remains 2/month for these parameters. The acute toxicity protocols in North Carolina stipulate quarterly testing. As such, the toxicity testing requirement for outfall 001 remains unchanged.); 3. Elimination of monitoring for cyanide, cadmium. zinc, arsenic, lead, selenium. silver, dichloroethene, chloride. and chronic toxicity at outfall 003; and 4. Reduction of the monitoring frequency for all other parameters in outfall 003. As for items 3 and 4 above, the NPDES Unit does not have certified (signed) discharge monitoring reports on for outfall 003. As such, a review of the data for this outfall is not feasible. Until such time as certified historical available. all monitoring conditions will remain unchanged. Enclosed please find the modified permit page (condition A.(1.). This page should be inserted into your permit and the old one discarded. This permit modification is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U. S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). Please take notice that this permit is not transferable. Part II, E.4. addresses the requirements to be followed in case of change in ownership or control of this discharge. This permit does not affect the legal requirement to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources. EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS — FINAL During the period beginning on the effective date of this permit and lasting until expiration, the Permittee is authorized to discharge from outfall 001 - METAL FINISHING. There shall be no discharge of floating solids or visible foam in other than trace amounts. 1 Sample Locations: Upstream - Upstream 50 feet, Downstream - Downstream 50 feet. 2 The temperature of the effluent shall be such as not to cause an increase in the temperature of the receiving stream of more than 0.50C and in no case cause the ambient water temperature to exceed 20°C. 3 In lieu of monitoring for TTO, the permittee may submit the following certification statement: Based on my inquiry of the person or persons directly responsible for managing compliance with the permit limitation for total toxic organics, I certify that, to the best of my knowledge and belief, no dumping of concentrated toxic organics into the wastewater has occurred since the filing of the last discharge monitoring report. 4 Whole Effluent Toxicity will be assessed using the Acute Toxicity (Fathead Minnow) Pass/Fail at 90% test. This request was received on March 6, 2003. After a preliminary review, it has been determined that the package lacks the permit modification fee of $215.00. Please note that the discharge from outfall 001 is regulated by EPA's federal effluent guidelines (40 CFR 433.13). Therefore, cadmium, nickel, copper, cyanide, lead and silver are required monitoring parameters that have associated technology -based limits. While the Division may consider a reduction in the monitoring frequency of these parameters, they cannot be eliminated from the permit. The Division will consider all toxicant data submitted by M-B Industries since the issuance of the permit in determining whether the monitoring frequency of the requested parameters can be reduced. I am pleading to you again. Please review with me the following information: 1. Monthly invoice copies from Pace Analytical for December 2002, totaling$1272.00. 2. Permit NC0000311-001, which defines the parameters for our wastewater effluent. 3. A monthly analysis for one year of the contaminate amounts found by Pace Analytical when they tested the samples to permit — 001. Moreover, cadmium, nickel, copper, cyanide, lead and silver can be eliminated. These metals are not used in our process. We do bend and MITCHELL-BISSELL CO. The permit has no limit noted for phenols....elimination of this measurement will save $60.00 per month. We have never failed the acute toxicity test (bioassay), which is performed quarterly at $270.00....can this test go to bi-annual? 4. Permit NC0000311-003, which defines the parameters for our groundwater remediation program. 5. A monthly analysis for one year of the contaminate amounts found by Pace Analytical when they tested the samples to permit —003. Thirty or fifty years ago we used trichloroethene in a vapor degreaser to clean metal parts. Somehow a few gallons were spilled and contaminated the ground water in parts per billion. The average contamination is 5 to 10 parts per billion.... the equivalent of 1 to 2 ounces in 1,562,500 gallons. Through natural attenuation and a remediation program we are removing the contaminate. Permit — 003 requires us to measure cyanide, cadmium, zinc, arsenic, lead selemuim, silver, dechloriethane and chloride....all of which we have never used and could not have put in the groundwater. Moreover, chronic toxicity should not be measured. In conclusion, based on the foregoing information, our expertise and commitment to the environment, I believe the permits should read as follows: 001 Total Suspended Solids Monthly Oil and Grease Monthly Temperature Weekly Total Toxic Organics Monthly Acute Toxicity 2/Year Chromium Monthly Zinc Monthly 003 Chromium Monthly Trichloroethene Monthly Tetrachoroethene Monthly If I can provide any additional information, please let me know.
