The Division of Water Quality (the Division) has reviewed your request for an Authorization to
Construct a groundwater remediation system at the subject site. The proposal consists of plans and
specifications accepted on May 9, 2001. The Division finds the proposal and design to be satisfactory,
except as stipulated herein, and hereby grants authorization to construct a groundwater pump -and -treat
system consisting of:
• four (4) proposed recovery wells and appurtenant piping
• one (1) 1000-gallon equalization tank with influent throttle valve;
• one (1) transfer pump
• one (1) flow meter;
• one (1) shallow tray air stripper with blower (stripper to be sized at pumping start-up to a
flow estimated between 60 gpm and 160 gpm -- targeted to reduce PCE to <1.0 µg/L);
• one (1) effluent sample port to monitor discharge to Outfall 003; and
• all related structures, equipment, piping, electrical wiring and controls, and other
appurtenances as specified in the approved design documents.
To prevent the discharge of untreated wastewater to the receiving stream, it is hereby
stipulated that this treatment system shall be designed such that pumping and wastewater discharge
shall terminate automatically in the event of aeration blower failure, or other treatment system
failure. •

This Authorization to Construct is issued in accordance with Part III, Paragraph A of NPDES Permit No.
NC0000311 effective May 1, 2001, and shall be subject to revocation unless the wastewater treatment
facilities are constructed according to the conditions and limitations specified in that permit.
In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions,
the Permittee shall take immediate corrective action, including those as may be required by this
Division, such as the construction of additional or replacement wastewater treatment or disposal
facilities.
Notification Requirements
The Permittee shall notify the Asheville Regional. Office, telephone number [phone], at least
forty-eight (48) hours in advance of start-up of the installed facilities, so that an in -place inspection can
be made. Such notification to the regional supervisor shall be made during the normal office hours of
8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding state holidays.
Engineer's Certification
Upon completion of construction and prior to operation startup, the Permittee shall provide the Division
with certification from a North Carolina -certified professional engineer that the permitted facility has
been installed in accordance with the NPDES Permit, this Authorization to Construct, and the approved
plans and specifications. Mail the Certification to:

Operator Requirements
The Permittee shall employ a certified wastewater treatment plant Operator in Responsible Charge
(ORC) of the wastewater treatment facilities. The operator must hold a certificate of the type and grade
at least equivalent to, or greater than, the classification assigned to the wastewater treatment facilities by
the Certification Commission. The Permittee must also employ a certified back-up operator of the
appropriate type and grade to comply with the conditions of Title 15A, Chapter 8G, .0200. The facility's
ORC must visit each Class I facility at least weekly, and each Class II, III, and IV facility at least daily,
excluding weekends and holidays. The ORC must properly manage and document daily operation and
facility maintenance by complying with all conditions of Title 15A, Chapter 8G, 0200.
Additional Conditions
The Operational Agreement between the Permittee and the Environmental Management Commission is
incorporated herein by reference and is a condition of this Permit. Noncompliance with the terms of the
Operational Agreement shall subject the Permittee to all sanctions provided by G. S. 143-215.6 for
violation of, or failure to act in accordance with, the terms and conditions of this Permit.
Failure to abide by the requirements contained in this Authorization to Construct may subject the
Permittee to an enforcement action by the Division of Water Quality in accordance with North Carolina
General Statute 143-215.6A to 143-215.6C.

The issuance of this Authorization to Construct does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances which may be imposed by other government
agencies (local, state, and federal) having jurisdiction.
The Permittee shall maintain a copy of the approved plans and specifications on file for the life of the
facility. One (1) copy of the approved plans and specifications is enclosed for your records.

Dear Mr. Corporan:
The subject M-B Industries (M-B) facility is located on Highway 64 West in Rosman, North
Carolina. On February 27, 2001, Waters Edge Environmental, LLC (Waters Edge) submitted an
Authorization to Construct (ATC) for a soil and ground water remediation system. Based on our
June 7, 2001 conversation, you requested additional clarification concerning the shut down
safeguards for the system in the event of any accidental breakdowns. We have three shut down
provisions as follows:
• The incoming equilization tank has a high -high cutoff probe. If water flowing into
the treatment building hits this sensor, it will shut down the entire system including
the wells.
• The stripping try system also has a similar high -high cutoff probe which would act in
a similar fashion.
• Finally, we have sloped the floor of the treatment building to a blind concrete sump
with a sump pump. Once this pump is engaged, it will also cut off the entire system
including the pumps.
We feel that these engineering controls are more than sufficient to safeguard that any unforeseen
system breakdown would not result in a release to the receiving stream.
