Dear Mr. Morrow:
On April 2, 2001, a final permit for the subject facility became effective. On August 14, 2002, you
submitted a request that the sample type for your toxicity test at outfall 003 be changed from composite to
grab. The NPDES Unit has reviewed this requirement in conjunction with the Aquatic Toxicology Unit and
determined that it is appropriate to change the chronic toxicity sample type at outfall 003 to "grab."
Please find enclosed the revised permit page. The revised page should be inserted into your permit.
The old page may then be discarded. All other terms and conditions contained in the original permit remain
unchanged and in full effect. This permit modification is issued under the requirements of North Carolina
General Statutes 143-215.1 and the Memorandum of Agreement between North Carolina and the U. S.
Environmental Protection Agency.
If any parts, measurement frequencies or sampling requirements contained in this permit modification are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days
following receipt of this letter. This request must be a written petition conforming to Chapter 150B of the North
Carolina General Statutes, filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North
Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding.

A. (3.) EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS — FINAL
During the period beginning on the effective date of this permit and lasting until expiration, the Permittee is
authorized to discharge from outfall 003 - GROUNDWATER REMEDIATION. Such discharges shall be limited
and monitored by the Permittee as specified below:

The pH shall not be less than 6.0 standard units nor greater than 9.0 standard units
and shall be monitored weekly at the effluent by grab sample.
There shall be no discharge of floating solids or visible foam in other than trace
amounts.
Notes:
1 Whole Effluent Toxicity will be assessed using the Chronic Toxicity at 0.55% test. See part A.(5.).

Subject: Modification to permit for outfall 003
Dear Natalie,
Below is a brief summary of conversation between Matt Mathews, Ed Corey and yourself
concerning the modification of permit for outfall 003 to change from composite sampling
to grab sampling.
August 13, 2002
Had talk with Mr. Matt Mathews — 919-733-2136 on 8/7/02 and asked hire about a
discharge line from 24 hours "Composite -Chronic Toxicity Test" to a "Grab -Chronic
Toxicity" sample. Mr. Mathews informed me (Corey-ORC-##9909) to call Ms. Natalie
Sierra at 919-733-50583 and see if she cart make the modification request on #003 from
24 hours "Composite" to a "Grab" sample.
Called Ms. Sierra in 8/12/02 and requested a modification on Permit #000031-#003
discharge line from 24 hours "Composite -Chronic Toxicity" testing to a "Grab -Chronic
Toxicity" test sample — Ms. Sierra informed me she will look into this modification
request and get back with on 8/13/02.
Ms_ Natalie Sierra called me (Corey ORC) on 08/13/02 and informed me the
modification request from 24 hours "Composite -Chronic" to a "Grab -Chronic" Toxicity
testing was OK — but a letter from Mr. Morrow has to be made with all this data
information so a "New" modification permit on #003 discharge line can be made.
