Pursuant to our phone conversation today, I am providing additional written documentation
regarding the upfront penalty associated with the subject SOC (#S20-001). During the initial negotiation
process for the subject SOC, it was determined that the upfront penalty amount would be $1,478.48 which
covered the enforcement cost portion of the enforcement cases outstanding at that time. As a direct result
of the lengthy SOC process that is now being reviewed concurrently with the NPDES Permit modification
request application, additional enforcement cases were assessed. These new enforcement cases also
included enforcement costs which will now be incorporated into the upfront penalty so that all outstanding
cases may be incorporated into the pending SOC. The table on the following page denotes all the
outstanding enforcement cases and the associated enforcement costs and penalty amounts. The new total
for outstanding enforcement costs is $1,964.32. Deducting the original payment of $1,478.48, the
remaining balance for outstanding enforcement costs is $485.84 ($1,964.32 minus $1,478.48). You may
remit the remaining balance to the following address:
