Section 401 Water Quality Certification No. WQC004214, NCDWR Project No. 20200142, issued March 24, 2020. CAMA Major Development Permit, NCDCM Permit No. 45-20, issued April 14, 2020. The North Carolina Department of Transportation (NCDOT) requests a modification to the above referenced CAMA Major Development Permit to authorize the replacement of the existing 84” culverts along Maple Cypress Road. Additionally, NCDOT is requesting modification or reissuance of the referenced permits from USACE and NCDWR for this work. The proposed changes, presented in the attached permit impact sheets, include replacing the existing 84” x 62’ culverts with two 90” x 70’ culverts with headwalls. The original roadway plans and permit drawings requested for an extension of the existing culverts and the addition of a collar. Upon further evaluation during construction, a complete replacement of the existing culverts was determined to be more practical and address long-term maintenance. The previously permitted impacts for channel relocation have been removed from the attached permit drawings. Although a channel is shown in this location, it remains inundated and provides no hydraulic benefit to the system. The excavation in wetlands previously associated with the channel relocation and the mechanized clearing impacts at the inlet of the culvert have been changed to hand clearing, which has already occurred on site. To accommodate construction and installation of the new culverts and headwalls, small permanent fill and excavation impacts have been added to both the inlet and outlet of the proposed culverts. These impacts are less than 0.01 acre in total, and do not result in an increase to the impact totals noted in Table 1 below. The individual increases can be seen in the attached permit impact summary worksheet. Summary Table of Impacts For comparison, Table 1 is an abbreviated version of the wetland and surface water impacts and the changes in impacts due to the modifications described above. A decrease of 0.09 acre of excavation in wetlands and 0.27 acre of temporary fill associated with the channel relocation is offset by 0.36 acre increase in hand clearing in wetlands. Table 1. Total temporary impacts to jurisdictional wetlands are being increased from 0.29 acres to 0.38 acres. These revised permanent and temporary impacts to jurisdictional wetlands do not exceed the mitigation compensated through in-lieu fee payment to the NCDMS in association with the original permits issued for this project. Regulatory Approvals CAMA Permit: NCDOT requests that the N.C. Division of Coastal Management review this permit modification request and issue a modification for the CAMA Major Development Permit issued April 14, 2020. Section 404/Section 10 Individual Permit: NCDOT requests that the U.S. Army Corps of Engineers (USACE) review this permit modification request and modify the Section 404/Section 10 Individual Permit. 401 Certification: NCDOT requests that the N.C. Division of Water Resources review this permit modification request and reissue a Section 401 Water Quality Certification.
