Hope all is well. We spoke last October regarding a permit limit exceedance of Total Suspended Solids (TSS) for the Ergon
facility in Wilson, NC (NC0089087). The facility just received the attached NOV, and we wanted to provide a response
accordingly. As such, we would like to provide the following summary in connection with the October 2021 sampling
event:
• The quarterly effluent sampling event for Q4 2021 was completed on October 5, 2021.
• For the event, TSS exceeded the daily maximum of 45 ppm (reported at 78 ppm for the sampling event), and we
notified your office via voicemail and a subsequent e-mail within 24 hours of receipt of laboratory analytical
results, as outlined in the permit.
• The facility has demonstrated a history of compliance as this was the first permit limit exceedance over the life
of the permit.
• The TSS exceedance has been attributed to a very low volume in the pond at the time of sampling. There had
also been some recent landscaping done around the facility, but it seems the primary driver for the elevated TSS
concentrations appears to be the low volume.
• All other parameters, including the Acute Toxicity Test, were within range of permit limit thresholds for the
October 2021 sampling event.
