While re-reading your response email from 1/10/2022, I realized that the response to item 2) does not quite capture what I was trying to address. So, I’ve attached a plan sheet with green polygons to break out the 3 stream reaches where the Corps will require compensatory mitigation, as well as comment boxes with each impact length and compensatory mitigation ratio. Essentially I was asking you to break the impacts reported as bank stabilization (a total of 69 lf) into bank stabilization west of South Scales Street (which requires compensatory mitigation due to realignment of the channel) and bank stabilization east of South Scales Street (which does not require compensatory mitigation as it is only rip rap on the banks). I scaled the impacts using the plan sheet and came up with: 34 lf of bank stabilization west of South Scales Street; 35 lf of bank stabilization east of South Scales Street. This totals the 69 lf of total bank stabilization proposed, so it should be approximately correct. So, per the above, the Corps’ compensatory mitigation requirements for streams would be: 65 lf impacts due to culvert placement in Little Troublesome Creek (2:1 ratio); 54 lf impacts due to road fill in Stream SB (2:1 ratio); and 34 lf of bank stabilization requiring stream realignment in Little Troublesome Creek (2:1 ratio). The above equals 153 lf of stream impacts requiring compensatory mitigation at 2:1, resulting in a compensatory mitigation requirement of 306 stream credits. I have reviewed the information and need clarification before proceeding with verifying the use of Nationwide Permit (NWP) 14 (https://saw- reg.usace.army.mil/NWP2017/2017NWP14.pdf). Please submit the requested information below (via e‐mail is fine) within 30 days of receipt of this Notification, otherwise we may deny verification of the use of the Nationwide Permit or consider your application withdrawn and close the file: 1) Thank you for your inclusion of floodplain benches in the design for this project. Please provide additional details on the floodplain benches, including the material make-up (stream bed material? rip rap? mixture?) and stabilization measures (coir fiber matting?) of the bench itself, as well as a planting plan for the bench; The floodplain benches on the upstream and downstream side of the culvert will be constructed with Class II Rip Rap in order to provide channel and bank stabilization in high flow events. The benches will be lined with Geotextile fabric and native grass seeding and mulching will be performed on the disturbed riparian areas as specified in the Sediment and Erosion Control Plans. 2) Please note that the Corps would require compensatory mitigation for the permanent stream impacts resulting in a loss of waters, including Impacts S2 and S3 in this case (119 linear feet), as well as the main flow channel realignment on the west side of SR 2670; please calculate the impacts currently listed as bank stabilization for the portion of Impact S1 on the west side of SR 2670. The compensatory mitigation requirement for these three impact types will be set at 2:1 (mitigation to impact ratio) unless otherwise justified based on aquatic resource functional quality (typically documented by NCSAM). Note that compensatory mitigation is not typically required for bank stabilization impacts limited to the banks where channel realignment is not required (e.g. the portion of Impact S1 on the east side of SR 2670). After deducting the impacts for bank stabilization at Site 1, NCDOT is now requesting mitigation for 119 feet of impacts rather than 188 feet of impacts.
