Division personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant
to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as
subsequently amended).
The Division has reviewed the comments on the draft permit submitted on your behalf by Harmon
Environmental, PA. Based on those comments, modifications to the conditions found in the draft
version of the permit have been made. This final permit includes the following changes from the draft
permit sent to you on February 3, 2010:. •
• Monitoring requirements have been removed for Cadmium, Toluene, Total Xylenes and pH.
The Division cannot agree to your request to have toxicity testing samples collected as a grab sample
due to the continuous nature of treatment and discharge. The sample collection requirement shall
remain as a composite sample.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty
(30) days following receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150B ofthe North Carolina General Statutes, and filed with the Office of
Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless
such demand is made, this decision shall be final and binding.

All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby
revoked. As of this permit issuance, any previously issued permit bearing this number is no longer
effective. Therefore, the exclusive authority to operate and discharge from this facility arises under the
.permit conditions, requirements, terms, and provisions included herein.

1. Chronic Toxicity (Ceriodaphnia dubia) P/F at 90%: March, June, September, December [see
Special Condition A.(2)].
2. A flow totalizer may be used in lieu of a continuous recording device at this time. Should flow
become inconsistent and/or highly variable, or should the Mooresville Regional Office deem this
method insufficient to properly characterize the wasteflow, a continuous recording device may be
required in the future.
There shall be no discharge of floating solids or visible foam in other than trace amounts.

A. (2.) CHRONIC TOXICITY PERMIT LIMIT (QUARTERLY)
The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to
Ceriodaphnia dubia at an effluent concentration of 90%.
The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North Carolina
Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina
Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. Thd tests will
be performed during the months of March, June, September, and December. Effluent sampling for this testing shall be
performed at the NPDES permitted final effluent discharge below all treatment processes.
If the testprocedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then
multiple -concentration testing shall be performed at a minimum, in each of the two following months as described in "North
Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions.
The chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration
having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable
impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes,
and further statistical methods are specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test
Procedure" (Revised -February 1998) or subsequent versions.
All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring
Form (MR-1) for the months in which tests were performed, using the parameter code TGP3B for the pass/fail results and
THP3B for the Chronic Value. Additionally, DWQ Form AT-3 (original) is to be sent to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later than 30 days after
the end of the reporting period for which the report is made.
Test data shall be complete, accurate, include all supporting chemicaUphysical measurements and all concentration/response
data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the
effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee
will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit
number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the
form. The report shall be submitted to the Environmental Sciences Section at the address cited above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required
during the following month.
Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality
indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate
monitoring requirements or limits.
• If the Permittee monitors any pollutant more frequently then required by this permit, the results of such monitoring shall be
included in the calculation & reporting of the data submitted on the DMR & all AT Forms submitted.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival,
minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will
require immediate follow-up testing to be completed no later than the last day of the month following the month of the
initial monitoring.

SUMMARY
Equipment & Supply, Incorporated has applied for renewal of its permit to discharge 0.0216
MGD of remediated and treated groundwater into an unnamed tributary (conveyance ditch) to
Stewarts Creek in the Yadkin Pee -Dee River Basin. Groundwater and soils samples have been
taken and were found to have been contaminated with various volatile organic compounds
(VOCs). Primarily trichloroethene (TCE), 1,2 — Dichloroethene (1,2 DCE), 1,1— Dichloroethene
(1,1 DCE) and vinyl chloride are the contaminants. The sources of these contaminants could not
be determined by the consultant (there were no obvious sources used or produced at the facility).
Cadmium also was present in detectable levels; Per the consultant, cadmium is naturally
occurring in the soils (no obvious sources were found for this constituent either and some levels
are well above the water quality standard of 2 ug/1).
Upon review of the EAA submitted with the initial permit application, the most environmentally
sound/economically feasible alternative was determined to be wastewater treatment, followed by
direct discharge to a UT to Stewarts Creek. The soils are not suitable for subsurface. The site is
not large enough for spray/drip (and nearby soils indicate that they are not very viable for
spray/drip, especially during the winter period). POTW connection to Monroe is cost prohibitive
(and they will not take the requested flow). With site circumstances unchanged since the original
permit issuance, the NPDES Unit continues to agree with this conclusion.
The discharge is to an unnamed tributary to Stewarts Creek, off of Highway 74 near Bakers.
Stewarts Creek is designated as a Class WS III waterbody.

The facility is a Chemical/Physical facility consisting of two recovery wells, a contaminated GW
storage tank, an air stripper and a flow totalizing device.
TOXICITY TESTING:
Because this is a groundwater remediation and treatment system for solvents, current NPDES
guidance requires whole effluent toxicity testing. Due to the discharge to a dry ditch, toxicity
testing has been conducted at 90% effluent. The facility reported one "fail" result of WET
testing in June 2006. The follow up ChV test results were reported as ">100%" during July and
August 2006. All other test results during the period of record have been reported as "pass."
Recommended requirement: Continue Chronic Quarterly P/F at 90%, September, December,
March, June.
MONITORING & LIMITS
DEH/Public Water Supply expressed its concern regarding this discharge during public comment for the
initial permit issuance based upon the observed concentrations of contaminants in the groundwater and
the close proximity of the City of Monroe's water supply intake downstream of the discharge. No
treatment system or effluent data existed at that time. Insufficient data existed to show whether water
quality standards established as effluent limits for discharge to the unnamed tributary would be
protective of water supply Maximum Contaminant Levels (MCLs) at the City's raw water intake site
downstream at Lake Twiddy. Stewarts Creek was described as having a small watershed, experiencing
extremely low stream flows during periods of drought. As a result, Equipment and Supply, Inc. agreed
to meet the MCLs for three parameters highlighted below, at the effluent (end of pipe). Water quality
standards were established as effluent limits for the other parameters of concern because there was no
dilution of the discharge in the receiving stream.

the middle of Lake Twitty (down stream on Stewarts Creek):
Drainage Area = 23.4 mi2 (estimated, using existing DA at 601, plus DA to mid -
Lake Twitty)

Using this 7Q10s flow - the instream waste concentration (IWC) at mid -Lake Twitty

Effluent data from 2006 through 2009 were reviewed. Except for the following values recorded
during the startup/shakedown phase of the treatment facility during early 2006, all results for all
monitored parameters have been reported as less than the detection limit over the course of over
80 sampling events per parameter.

As a result of the consistent (good) performance of the treatment facility, limits for all constituent
parameters will be removed and monitoring for those parameters will be reduced from 2/Month
to Monthly.
4/14/2010: Based upon comments provided by the facility's consultant and discussions with
MRO and ATU, monitoring for cadmium, toluene and xylenes will be removed from the permit.
Cadmium at the site is said to be naturally occurring; any contaminant from an earlier spill has
been cleaned up to the satisfaction of the state through shallow soil removal. Toluene and xylene
were included in the permit based upon the results of one GW sampling event; they are not part
of the primary contaminants at the site. All monitoring results of treated GW for these
parameters has been no detection. pH was added to the draft in error by the permit writer; it
has been removed from the final permit. The facility's request to change toxicity sample
collection from composite to grab is denied based upon the continuous nature of the discharge.
INSTREAM MONITORING:
No instream monitoring will be required (continuation of current requirement).

As discussed in our recent telephone conversation, on behalf of Equipment & Supply, Inc., Harmon
Environmental, PA respectfully submits the following comments to the Draft NPDES Permit No.
NC0087858.
1.)
We respectfully request the DENR consider removing cadmium, toluene and total xylenes
from the Monitoring Requirements. Since the inception of the groundwater treatment system
in 2006, cadmium, toluene and total xylenes have not been detected in any of the required
effluent samples. Further, historically, these compounds have not been associated with the
groundwater plume at the facility.
2.) We respectfully request the DENR consider removing the pH reporting requirement from the
February 2010 version of the Permit. As you know, pH reporting was not required in the
Effluent Discharge Monitoring Form (MR-1) in the January 14, 2005 version of the Permit.
Based on the notes in the January 14, 2005 Permit, Harmon Environmental, PA personnel
routinely measure the pH in conjunction with the sampling events. Since the inception of
the groundwater treatment system, this data has consistently indicated the pH to be between
the values of 6.0 standard pH units and 9.0 standard pH units as required by the permit. By
requiring Equipment & Supply, Inc. to include pH measurements on the Effluent Discharge
Monitoring Form (MR-1), the DENR is requiring the Operator in Responsible Charge (ORC)
to become a certified field laboratory thus incurring additional expense.
3.) We respectfully request the DENR consider allowing Equipment & Supply, Inc. to collect the
Chronic Toxicity sample as a Grab Sample as opposed to a Composite Sample. Since
issuance of the January 2005 version of the Permit, Equipment & Supply, Inc. has collected
the Chronic Toxicity sample as a composite sample in accordance with the Permit. With the

exception of minor issues associated with start-up of the remediation system, the toxicity
tests have passed. The volume of water treated each day is relatively consistent and the
analytical results associated with the effluent samples indicate the water quality is also
consistent. As a result, it is our opinion that a Grab Sample would sufficiently represent the
waste stream.
4.) Mr. George Griffith has recently retired from Equipment & Supply, Inc. As a result, we
respectfully the DENR revise the contact information to transmit correspondences to Mr. Jim
Diggs, Vice President.

enters a dry ditch, which conveys the effluent to the receiving stream. The
receiving stream is 4 - 5 feet wide and 4 - 6 inches deep at the point of discharge.
There are no known downstream dischargers. The area is dominated by
commercial development primarily along Hwy. 74.
PART II - DESCRIPTION OF DISCHARGE AND TREATMENT WORKS

NPDES permit. Toxicity testing failures have been recorded in the past two years.

PART IV - EVALUATION AND RECOMMENDATIONS
The permittee has requested renewal of the subject permit. There have been no changes
to the permit and/or the existing GW remediation treatment facilities since the permit was last
renewed. The existing treatment facilities appeared to be in good operational condition at the
time of the site inspection.
Pending a final review by the Western NPDES Unit, it is recommended that the permit
for this facility be renewed

Solids and Sludge Management
The Equipment & Supply Inc. remediation system utilizes air -stripper technology to
remove volatile organic compounds from the recovered groundwater. No sludge or
solids are derived as a result of this treatment process.
The groundwater treatment unit is routinely serviced and de minimis amounts of calcium
scaling are removed mechanically. In a June 9, 2008 telephone conversation between
Mr. Richard Harmon of Harmon Environmental, PA and Mr. Mike Parker of the North
Carolina Department of Environment and Natural Resources (DENR), Mr. Parker
indicated that this calcium is associated with the groundwater and is not considered to be
a solid or sludge derived from the treatment process.
