The item that was noted as confidential in the application is the site criteria that we provided in one of our responses to
the Corps. I think it is fine to leave it as is and go ahead and process it.

I've just opened up this application and read the cover letter about requesting that the information remain
confidential. FYI, our admin staff do not read cover letters when they process the applications so the documents have
been available in our electronic file system since submittal. That said, I will try to correct the situation now, however I
will need more information from you.
The NC public records law does have an exclusion for trade secrets. OGC requests that applicants send two
versions of information that qualifies as confidential:
• a clean un-redacted version with specific documents or sections marked "confidential" (just one copy
of this)
• a non -confidential version with specific documents or sections containing their proprietary information
redacted (this is the copy we'd send to WRC)
The redacted version would be a public record and the un-redacted version will only be available to DWR staff
Note our requirements related to public records are likely different than those used by the Corps, and what
qualifies as confidential is specified by statute. For reference, here are links to NCGS Chapter 132 (public

Please note that I have drafted up a public notice and sent it to management for review and hopeful posting this week,
however if we post the public notice before we resolve this question then the entire file would be public record. Please
let me know how you would like to proceed, I can delay the public notice until you address the above info or issue as
soon as management approves.
