Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9,1994 (or as subsequently amended). The Division is unable to grant your request for extension of comment period beyond 30 days due to the statutory limitations. This final permit includes following major changes from the draft permit sent to you on October 27, 2004. • In response to your request a 12-month compliance schedule has been added to the permit. The new concentration based limits will become effective on February 1, 2006. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. (3) CHRONIC TOXICITY PERMIT LIMIT (Quarterly) The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 4.5 %. The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The tests will be performed daring the months of January, April, July and October. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the parameter code TGP3B for the pass/fail results and THP3B for the Chronic Value. Test data shall be complete, accurate, include all supporting chemical/physical measurements and all concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. IWC (%): 4.5% SUMMARY This is a minor renewal for a poultry processor (0.70 MGD). The discharge is 100% industrial, with domestic wastewater piped to city sewer. The facility discharges via Outfall 001 to Fisher River (Class C), which is not listed on the 2003 303 (d) list. New guidelines for the Poultry Industry were published in 2003. The permit limits for this renewal were established in accordance with these newly published regulations for Poultry Processing. INSTREAM MONITORING Instream monitoring is required for temperature and dissolved oxygen. An analysis of DO, temperature and conductivity data showed that the facility has no noticeable effect on the receiving stream (table is attached). TOXIQTY TESTING: Type of Toxicity Test: Chronic Phase II Existing Limit: 001: Chronic ChV @ 4.5% Recommended Limit: 001: Chronic ChV @ 4.5% Monitoring Schedule: January, April, July, and October This facility has been consistently passing all toxicity tests. COMPLIANCE HISTORY The facility has a good compliance record. During the review period (01/2001-09/2004) only 4 Notices of Violation (NOV) were issued for violating fecal (1 NOV), and flow limits (minor excursions over the limit). The most recent compliance evaluation inspection conducted on 01/30/2004 found that facility is compliant with the permit and that the treatment system appeared to be well maintained and operated. At this time, Wayne Farms requests an extension for three months from the current proposed issuance date of December 2004 to March 2005. A consultant engineering firm has been employed to investigate the wastewater system, report the findings and make recommendations regarding the current draft permit. Wayne Farms will make additional comments on the current proposed draft permit by March 2005, following review of the engineering firm's report. Additionally, we also request an extension to February 1, 2006 for the permit effective date. This extension is necessary to provide time to consider the existing wastewater treatment system pollutant removal efficiencies and final effluent quality to determine overall system ability to meet the new constituent limits. I understand that an A-C was submitted, which includes plans and specifications for the plastic liner to be installed in each of the two sludge basins. I am not sure who has a copy of the plan. 0n July 12, 1999 an EAA was submitted with a NPDES permit modification, which included the sludge storage lagoons and land application. According to the conversation I had with the ORC this morning, a dewatering/sludge press was evaluated, but this is not economically feasable. Although I have not seen the submitted plan, but understand that Raleigh has a copy, I would suggest that an A-C be issued in accordance with 15A NCAC 2H .0138 and that Wayne Farms must comply with all terms and conditions of the Land Application permit WQ0004609. The installation of a liner appears to be a great idea. Any way I can help, please let me know. The situation, Dave, sounds so much like the MSD Buncombe County one on which we have been working on that it incredible. There are two'sludge digesting/drying/holding ponds at this facility which were approved for construction under an ATC in the mid-1980s. Soon after this ATC was issued, a letter was written to require that groundwater monitoring wells be placed around the ponds, sampled/analyzed, and reported to us. Even though this language was never incorporated into a permit, the Permittee has been diligently complying with it ever since. The receipt of the data actually confused WSRO-GWS because they couldn't figure out why it was being submitted (i.e., it wasn't a requirement of WQ0004609)!!! Here are our questions: * Can we handle this the same way that we handled MSD Buncombe County? This permit expires on 12/31/2003, so the groundwater monitoring conditions could be easily incorporated into the renewed permit. BTW, the Permittee told Sherri that they submitted an application to renew this permit back in April; however, BIMS does not show that we ever received it??? * The groundwater monitoring does show some elevated groundwater levels. The Permittee is wanting to be very proactive and re -line the two ponds (existing liners are clay). Is an ATC required before the Permittee may initiate this work? Sherri does want to continue to encourage this proactive spirit, so the quickest way to accommodate this is the best. Thanks for any input that you might be able to provide...
