This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated December 6, 1983. The following permit conditions noted in the DRAFT permit have been retained in this FINAL permit: • Change in monitoring frequency from quarterly to weekly for total nitrogen and total phosphorus. Nutrient data collected by dischargers will be used during the next permit round to develop a nutrient management strategy for High Rock Lake and the Yadkin River Basin. • Delete the mass -based limit for ammonia (100 lbs/day monthly average, 150 lbs/day daily max). The concentration -based limit will remain as is. • The permit expiration date was changed to December 31, 2003. • This FINAL permit is based on the current permitted flow of 0.600 MGD and a production rate of 750,000 lbs LWK/day. As indicated by phone and letter, any request for expansion will require the submittal of an engineering alternatives analysis (EAA). Based on the new fee schedule effective January 1, 1999, a request for an increase in volume and/or pollutant load will be considered a major modification requiring a public notice (with 30-day comment period) and a major modification fee of $215. If any parts, measurement frequencies, or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. Permit No. NC0006548 SUPPLEMENT TO EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS SPECIAL CONDITIONS A (2). CHRONIC TOXICITY PASS/FAIL PERMIT LIMIT (QRTRL19 The effluent discharge shall at no time exhibit chronic toxicity using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised November 1995, or subsequent versions. The effluent concentration at which there may be no observable inhibition of reproduction or significant mortality is 3.9% (defined as treatment two in the procedure document). The permit holder shall perform uarterl monitoring using this procedure to establish compliance with the permit condition. The tests wi a performed during the months of January, April, July, and October. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGP3B. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above. Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will revert to quarterly in the months specified above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, then monthly monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will revert to quarterly in the months specified above. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. This is a minor renewal for a poultry processor (0.60 MGD). The discharge is 100% in ustria , with domestic wastewater piped to city sewer. Facility discharges via Outfall 001 to Fisher River (Class C), which is not listed in the 1998 303(d) list. Per 1998 Basin Plan, there are no impaired streams in this subbasin (030702). The Basin Plan reports that sedimentation is evident in Fisher River, although water quality generally remains good, and a Good bioclassification was assigned based on macroinvertebrate data. There is significant flow in Fisher River (s7Q10= 23 cfs), resulting in IWC of only 3.9%. Permit History. Facility has been permitted since 1979. Proposed effluent guidelines for poultry processing (40CFR 432) were previously used to develop technology -based limits for BOD, TSS, O&G, and Fecal based on production of 750,000 lbs LWK/day. Limits for ammonia and TRC were added during the last permit round and are water quality based. Effluent guidelines have never been finalized; therefore, technology -based limits should remain the same. In the permit renewal application, the facility has requested an increase in production to 848,400 lbs LWK/d (13% increase) and an increase in flow to 0.8 MGD (33% increase). However, an ATC issuance letter dated 4/21/97 stated that a permit mod and EAA would need to be submitted before DWQ would consider operation at flows >0.6 MGD. Since the EAA will take time to develop/review, NPDES is proceeding with renewal at current production, and will consider expansion later as a major permit modification. According to facility contact (Rob Poindexter), the construction associated with expansion is planned for the period May 1999- January 2000; therefore, there is still time to perform a major mod request. Proposed Permit Changes. NPDES is adding additional TN/TP monitoring to support development of nutrient management policy for High Rock Lake. NPDES is also recommending deletion of mass -based limits for NH3, since the existing concentration -based limits (20/30 mg/1) will always be at least as stringent. [Note: the mass -based limits were developed by multiplying the concentration -based limits by the design flow]. DMRs-Effluent Data. In 1998, flow averaged between 0.39-0.57 MGD (0.60 MGD limit). Effluent - limited parameters were well below mass -based limits. Monthly averages (lbs/d) ranged from 9-34 for BOD (versus 345 #/d limit); 0.5-3.3 for NH3 (versus 100 #/d limit); 20-79 for TSS (versus 465 #/d limit); 18-34 for O&G (versus 150 #/d limit). All NH3 values were < 1 mg/1 (versus 20 mg/1 limit). All TRC concentrations reported as "0" - WSRegion- please discuss the need to report less than detection limit with permittee. Violations were noted for fecals in 1998- one monthly average, and 14 daily max (due to broken chlorinator and faulty oxygen meter in AS basin) but problem does not appear to be chronic. Facility has passed 11/12 tox tests between 96-98. TN concentrations (mg/1) reported in 1998 were: 76, 56, 22. TP concentrations (mg/1) reported in 1998 were: 12, 7,7. DMRs-Instream Data. WSRegion. WS Regional Office conducted a Compliance Evaluation Inspection in March 1997 and found the facility to be well operated and maintained, and the facility was consistently meeting permit limits. The permittee has fairly consistently submitted monitoring data which references permit number NC0006548. We were unable to locate monitoring requirements ever written into that permit but did find reference in a 1986 sludge land application permit (Permit No. 10120-R) for the monitoring of 4 wells associated with the lagoons at the waste water treatment plant. There was also a requirement for the installation of 3 wells (1 up gradient and 2 down gradient) at one of the sludge land application sites. I am unaware if the additional wells were ever installed. Subsequent versions of the permit issued (WQ0004609) only reference the requirement for "any groundwater monitoring deemed necessary shall be provided". Since the land application of wastewater residuals permit includes many off -site fields, I recommend that the NPDES permit include the groundwater monitoring requirements. The monitoring wells are located on the Wayne Farms property near the wastewater treatment plant. The permit is due for renewal within the next 6 months so an application should be submitted to the Water Quality Sectiso T recommend that wells be sampled every March, July and November for the . dard parameters. Authorization is hereby granted for the construction and installation of the proposed modifications to the existing wastewater treatment system and all necessary appurtenances with discharge of treated wastewater into Fisher River in the Yadkin -Pee Dee River Basin.
