RHODES, AICP DIRECTOR This is to advise you that the Pitt County Technical Review Committee conditionally approved the soil erosion and sedimentation control plan and construction plan for COUNTRY CLUB CREEK PHASE 2 on December 8, 2021. Conditions and requirements as a part of this approval are attached below. As these conditions have been met as of January 11, 2022, the soil erosion and sedimentation plan for COUNTRY CLUB CREEK PHASE 2 is APPROVED. Copies of the draft minutes from the meeting will be available upon request prior to the next Technical Review Committee meeting. As stipulated on the financial responsibility form, you are responsible for ensuring compliance with all aspects of the approved plan and the Pitt County Soil Erosion and Sedimentation Control Ordinance. Your primary objectives include, but are not limited to, preventing offsite sedimentation, preventing sediment from entering watercourses, and establishing vegetation on all disturbed areas within 7-14 calendar days, following any completion of a phase of grading. As of April 1, 2019, all new construction activities are required to complete and submit an electronic Notice of Intent (NOI) form requesting a Certificate of Coverage (COC) under the NCG010000 Construction Stormwater General Permit. This form MUST be submitted prior to the commencement of any land disturbing activity on the above named project. The NOI form may be accessed at deunc.gov/NCGO1. Please direct questions about the NOI form to Annette Lucas at Annette.lucas@ncdenr.gov or Paul Clark at Paul.clark�ncdenr.gov. After you submit a complete and correct NOI Form, a COC will be emailed to you within three business days. Please be aware that your project will be covered by requirements of the NPDES Construction Stormwater General Permit NCGO10000. Please become familiar with all the requirements and conditions of this permit in order to achieve compliance. Upon discovery of noncompliance by our office, the following actions may be taken: No further permits for building or other construction will be issued. 2. The authority to continue construction, other than for erosion control measures, will be terminated. 3. Penalties of up to $5000 per day may begin to accrue. Failure to immediately comply upon notice of noncompliance will result in injunctive and/or criminal action. Other Comments: 4. This erosion control plan shall expire three years following the date of approval if no land disturbing activity has been undertaken. 5. The Division of Water Quality may pursue legal action against you in order to enforce requirements of the NPDES, Phase II permit. 6. The Pitt County Soil Erosion and Sedimentation Control Ordinance authorizes County officials to inspect sites to ensure compliance with the Sedimentation Pollution Control Act. Title 15A NCAC 4B .0118(a) requires that a copy of the approved erosion control plan be on file at the job site. Also, this letter gives the notice required by G.S. 113A-61.1(a) of our right of periodic inspection to insure compliance with the approved plan. North Carolina's Sedimentation Pollution Control Act is performance -oriented, requiring protection of existing natural resources and adjoining properties. If, following the commencement of this project, the erosion and sedimentation control plan is inadequate to meet the requirements of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statute 113A-51 through 66), this office may require revisions to the plan and implementation of the revisions to insure compliance with the Act. Acceptance and approval of this plan is conditioned upon your compliance with Federal and State water quality laws, regulations, and rules. In addition, local city or county ordinances or rules may also apply to this land -disturbing activity. This approval does not supersede any other permit or approval. Please note that this approval is based in part on the accuracy of the information provided in the Financial Responsibility Form, which you provided. You are requested to file an amended form if there is any change in the information included on the form. Land disturbance shall not begin until a preconstruction meeting has taken place. Rip Rap Apron at FES #8: A rip rap apron has been added to FES #8 at the location called out on Sheets C4 and CIO. 2. A silt fence outlet detail is needed, as an outlet is shown on the plans. a. Silt Fence Outlet Detail: A silt fence outlet detail has been added to Sheet D1. 3. Will the angle of the pipe from CB #31 to CB #29 cause backups or erosion? a. Pipe Angle from CB #31 to CB 929: No, this should not cause backups or erosion. The water will be able to flow freely. 4. Any riparian buffers or floodways must be noted on subsequent maps. a. Notation of Riparian Buffers and Floodways: The floodway has been noted on Sheet C2. The note has been moved into a more visible position. [Southeastern Drainage} 5. It appears that there is a desire to use the Drainage Easement as a Future Greenway. The Southeastern Drainage Office supports Pitt County Drainage District #3 in their stance against allowing a drainage easement to be used as a Greenway. The drainage office has never approved a greenway to be placed within a drainage easement, and at this time does not plan to change this opinion. a. Overlap of Future Greenway and Drainage Easement: The 130' Future Greenway is required by the Town of Ayden and has therefore been shown on the plans. A note has been added to Sheet C2 stating that future greenway improvements are not allowed in the I50' drainage district easement. [General Comments] Soils located on site include Bb, Co, ExA, GoB, OcB, Ra, and WaB per the Pitt County Soil Survey, Sheet 68. ■ Soils are prime farmland or have statewide importance for farming. Development will remove the site from agricultural production. ■ The site is currently in woods. Development will remove the site from future timber production. ■ The adjacent drainage laterals should be cleaned out to their original bottom for improved drainage. ■ There are records of sub -surface drain tile on site. Please see the attached drain tile map. ■ Swift Creek Watershed ■ Swift Creek Watershed: A note has been added to Sheet C2 stating that the property is located within the Swift Creek Watershed. • The following agencies have reviewed the SESC/Construction Plan for COUNTRY CLUB CREEK PHASE 2 and have no comments: ■ Pitt County Emergency Management ■ Pitt County Engineering • The following agencies have reviewed the SESC/Construction Plan for COUNTRY CLUB CREEK PHASE 2 and have not returned comments: ■ NCDOT Notes in italics are comments/responses to the conditions received from Rivers and Associates via a memo on December 3rd 2021.
