Dear Dr. Sobol:
On May 19, 2010, the Wilmington Regional Office received a plan revision for
Stormwater Management Permit Number SW8 030917. The revisions include
reallocating built upon area (BUA) as shown in the enclosed summary tables. It has
been determined that a formal permit modification is not required for the proposed
changes. We are forwarding you an approved copy of the revised plans for your files.
Please replace the old approved plan sheets with the new ones.
Please be aware that all terms and conditions of the permit issued on August 22,
2008, remain in full force and effect. Please also understand that the approval of this
revision to the approved plans for the subject State Stormwater Permit is done on a
case -by -case basis. Any other changes to this project must be approved through
this Office prior to construction. The issuance of this plan revision does not preclude
the permittee from complying with all other applicable statutes, rules, regulations or
ordinances which may have jurisdiction over the proposed activity, and obtaining a
permit.or approval prior to construction.

The applicable state stormwater management permit supplement and operation an ex�ance f
must be submitted for each BMP specified for this project. The latest versions of the forms can be o

VL SUBMITTAL REQUIREMENTS
Only complete application packages will be accepted and reviewed by the Division of Water Quality (DWQ).
A complete package includes all of the items listed below. A detailed application instruction sheet and BMP
checklists are available from httQ//h2o.enr.state nc.us(su/bm-R formsht a. The complete application
package should be submitted to the appropriate DWQ Office. (The appropriate office may be found by locating
project on the interactive online map athft://h2o.enr.state.nc.us/su/msi malts htm.)
Please indicate that the following required information have been provided by initialing in the space provided for
each item. All original documents MUST be signed and initialed in blue ink. Download the latest versions for
each submitted application package from hft://h2o.enr.state.nc.us/su/bmp forms htm.
1. Original and one copy of the Stormwater Management Permit Application Form.
2. Original and one copy of the sighed and notarized Deed Restrictions & Protective Covenants
Form. (if reored as per Part VII below)
3. Original of the applicable Supplement Form(s) (sealed, signed and dated) and O&M
agreement(s) for each BMP.
4. Permit application processing fee of $505 payable to NCDENR. (For an Express review, refer to
http://www.envhely.org/pages/onestoRgWress.htnnl for information on the Express program
and the associated fees. Contact the appropriate regional office Express Permit Coordinator for
additional information and to schedule the required application meeting.)
5 A detailed narrative (one to two pages) describing the stormwater treatment/managementfor
the project. This is required in addition to the brief summary provided in the Project
Information, item 1.
6. A USGS map identifying the site location. If the receiving stream is reportedas class SA or the ,
receiving stream drains to class SA waters within 1/2 mile of the site boundary, include the 1/2
mile radius on the map.
7. Sealed, signed and dated calculations.
8. Two sets of plans folded to 8.5" x IV (sealed, signed, & dated), including: --
a. Development/Project name.
b. Engineer and firm
c. Location map with named streets. and NCSR numbers.
d. Legend.
e. North arrow.
f. Scale. #44>
g. Revision number and dates. .
h. Identify all surface waters on the plans by delineating the normal pool elevation/
impounded structures, the banks of streams and rivers, the MHW or NHW line of ti
waters; and any coastal wetlands landward of the MHW or NHW lines
• Delineate the vegetated buffer landward from the normal pool elevation of impounded
structures, the banks of streams or rivers, and the MHW (or NHW) of tidal waters.
i. Dimensioned property/project boundary with bearings & distances.
j. Site Layout with all BUA identified and dimensioned.
k. Existing contours, proposed contours, spot elevations, finished floor elevations.
L Details of roads, drainage features, collection systems, and stormwater control measures.
m. Wetlands delineated, or a note on the plants that none exist. (Must be delineated by a
qualified person. Provide documentation of qualifications and identify the person who
made the determination on the plans.
n. Existing drainage (including off -site), drainage easements, pipe sizes, runoff calculations.
o. Drainage areas delineated (included in the main set of plans, not as a separate document).
p. Vegetated buffers (where required)-
9- Copy of any applicable soils report with the associated SHWT elevations (Please identify
elevations in addition to depths) as well as a map of the boring locations with the existing
elevations and boring logs. Include an 8.5"xll" copy of the MRCS County Soils map with the
project area clearly delineated. For projects with infiltration BMPs, the report should also
include the soil type, expected infiltration rate, and the method of detiermining the iiiffitration rate.

11. For corporations and limited liability corporations (LLC): Provide documentation from the NC
Secretary of State or other official documentation, which supports the titles and positions held
by the persons listed in Contact Information, item la, 2a, and/or 3a. per NCAC 21-1.1003(e). The
corporation or LLC must be listed as an active corporation in good standing with the NC
Secretary of State, otherwise the application will be returned.

VIL DEED RESTRICTIONS AND PROTECTIVE COVENANTS
For all subdivisions, outparcels, and future development, the appropriate property restrictions and protective
covenants are required to be recorded prior to the sale of any lot. If lot sizes vary significantly or the proposed
BUA allocations vary, a table listing each lot number, lot size, and the allowable built -upon area must be provided
as an attachment to the completed and notarized deed restriction form. The appropriate deed restrictions and
Protective covenants forms can be downloaded from

In the instances where the applicant is different than the property owner, it is the responsibility of the property
owner to sign the deed restrictions and protective covenants form while the applicant is responsible for ensuring
that the deed restrictions are recorded.
By the notarized signature(s) below, the permit holder(s) certify that the recorded property restrictions and
protective covenants for this project if required, shall include all the items required.in the permit and listed
on the forms available on the website, that the covenants will be binding on all parties and persons claiming
under them, that they will run with the land, that the required covenants cannot be changed or deleted
without concurrence from the NC DWG and that they will be recorded prior to the sale of any lots

the lease agreement or pending property sales contract has been provided with the submittal, which indicates the
party responsible for the operation and maintenance of the stormwater system.
As the legal property owner I ackmowledge, understand, and agree by my signature below, that if my designated
agent (entity listed in Contact Information, item 1) dissolves their company and/or cancels or defaults on their
lease agreement, or pending sale, responsibility for compliance with the DWQ Stormwater permit reverts back to

Thanks for this info. I like the Draft that you wrote. However, the BLIA per lot summary is incorrect.
Lot #214 is now a residential lot w/ 4,000 sf of BLIA. There is no Lot 227,
Lot #72 is 5,000 sf, not 4,500 sf
Lot #130 is 4,500 sf, not 4,000 sf
Lot # 136 is 4,500 sf, not 5,000 sf
The total Lot BUA is 1,041,000 sf (see my attached spreadsheet)
The BUA Plan Revision Summary needs to be corrected as well. I don't want the total Impervious value of 1,748,918 sf
to change, so there will be no correction.
The Lots, ft2 Total Correction should be 1,041,000 sf
The Pond 2 Lots value should be 276,000 sf
The Curb Outlet for Lots should be 309,000 sf
Change the FUTURE for Pond #2 to be 47,224 sf and the Total Future to be 305,759 sf. (I don't want to lose the extra
9,000 sf for Pond #2). If you want me to, I will edit these spreadsheets for you if you send them to me (if you are
confused by all of what I just wrote - lol).
What do you need from me now to move this along so that you can issue the revised SW permit?
If the client wants to add lots later, we will file a MOD. But for now, let's get this revision settled.

It appears that the original SW application that was submitted and approved had a mistake in the calculations of the
BUA for the lots. The actual total BUA for the lots is 1,040,500 sf, not 1,050,000 sf. I arrived at the 1,040,500 sf
number by using your Lot BUA spreadsheet and filled in the assigned BUA for each of the 226 lots. What you have
shown in the spreadsheet for August 22, 2008, totaled 1,045,000 sf. This is also incorrect because you included Lot
#214 which was not a residential lot (if it was to be included, the total number of lots would then be 227 and not 226).
If you subtract out the 4,500 sf for Lot #214 from your total, the amount is 1,040,500 sf.
I have a follow up question for you.
What needs to be done now so that the SW Permit shows the 1,040,500 sf for all of the lots?
OR
In the latest design and lot layout assigned to Pond #2, the Lot BUA is 9,000 sf less than what was approved (276,000
sf vs. 285,000 sf). Can I increase the number of total lots draining to Pond #2 so that I arrive at the 1,050,000 sf Lot
BUA? If so then the total number of lots would be 228. Is this a problem for NCDENR-DWQ?

OK, thanks.... As for the pond, a pond can always be "bigger" than it is required to be. So, if the pond was originally
designed to hold 100,000sf of BUA, but the impervious has been reduced such that the pond only needs to hold
90,000sf then it is OK to still build the pond to hold 100,000sf as it was permitted. In fact, if you have "extra" BUA
that the pond can hold, you may want to claim that "extra" as "future" in case they want to add things later. For
instance, if they want to add a turn lane or put in a sidewalk in a few years then the permit will still show the pond to
be able to hold the 100,000sf and the permittee will just have to submit for a plan revision to reallocate the "future"
10,000sf to "sidewalk" or "road". Plan revisions in the regular program are free. If you don't claim the "extra" as
"future" then you may run into problems later if you want to add something because if you have to rewrite the permit
text (other than just reallocating BUA between BUA types), then you have to get a mod ($505). Having extra or
"future" is always a good thing to have because you never know what will come up.

I am working on responding to your comments dated May 10, 2010 and I have some questions for you.
But first, a few comments.
The original permit was for 226 lots. This has not changed - there still are 226 lots. When the original permit was
issued, the lots numbered from 1-227, but lot #214 was not a residential lot and therefore was not counted. Lot #214
was to be used for parking for the Amenities Area. Don't ask me why the original engineer did it this way, but that is
what he did. Now we moved the Amenities Area to a different location which changed some of the lots around. Lot #
214 was no longer needed for parking so it became a residential lot. The surveyor, unbeknown to this office,
redesigned the lots and road around the island on the north side of the project. Doing so, he lost a lot compared to
the original design. The gaining of Lot #214 was offset by losing the lot in the island. The result is that we
renumbered the lots from 1-226, there is no longer a Lot #227.
Please check your plans again to see if Lot #91 is shown on the August 22, 2008 plans. It is shown on the plans we
have (southwest of Lot #90). Lot #91 was accounted for in the assignment of BUA for this project (4,500 sf).
The original SW Permit DID include lots 59-64 and should have been included on the August 22, 2008 plans. I believe
that I did show Lots # 59-64 on the latest plans as being part of Phase 1, although it will be built at a later time.. I put
a Phase Line in the plans showing where Phase 1 ends and Phase 2 starts. As per your request, I will add a Project
Area Boundary to the plans.
Now for my question.
Can a pond be allocated more BUA than will actually be used? I am asking this because of Pond #2. It was permitted
with 285K sf and now requires less.
Please let me know.

The Wilmington Regional Office received and accepted a Plan Revision request for a
State Stormwater Management Permit for The Village at Motts Landing on March 5,
2010 and a response to my April 19, 2010 additional information request on May 6,
2010. A preliminary in-depth review of that information has determined that the
application is not complete. The following information is needed to continue the
stormwater review:
1.) Impervious allocation: I have enclosed the summary table that was previously
sent with my April 19, 2010 letter which specifies the amount of built upon area
(BUA) per lot previously permitted to drain to each pond and contrasts this
information with the currently -proposed BUA configuration. Your May 6, 2010
letter indicates that the table is correct.
a. The August 22, 2008 permit states, "The project is permitted for 226 lots.
Lots 1-46 and 136-154 are limited to a maximum of 5,000 square feet of
built -upon area, as defined by the stormwater rules, and as indicated in
the approved plans. Lots 130-132, 213, 215-227 and 155 are limited to a
maximum of 4,000 square feet of built -upon area, as defined by the
stormwater rules, and as indicated in the approved plans. All other lots
are limited to a maximum of 4,500 square feet of built -upon area..."

b. There appear to be some inconsistencies between what has been
permitted and what is proposed. 226 lots were previously permitted.
Some of the inconsistencies I have found include the following. There
may be others that I have not identified. Please make any necessary
corrections:
i. It is my understanding from March 2010 emails with your engineer
that the number of lots is intended to be maintained. If the number
of lots is changing, then this should be a permit modification rather
than a plan revision.
1. The enclosed table shows that Lot 227 was previously
allocated for 4,000sf. But, there is not a Lot 227 on the
plans received on May 6, 2010.
2. There does not appear to be a Lot 91 on the August 22,
2008 approved plans but Lot 91 appears on the May 6, 2010
plans.
ii. The permitted plans exclude the area covered by Lots 59-64, but
the impervious area for these lots (4,500sf per lot) appears to have
been included in the overall BUA accounting in the August 22, 2008
permit. The May 6, 2010 plans state that, "Phase 1A [Lots 59-64] is
part of Phase 1, but to be constructed at a later time than
remainder of Phase 1." Please clearly label the project area for this
permit on the plans.
c. The total BUA for Pond 2 on the table submitted on May 6, 2010 is shown
to be both 276,000sf and 285,000sf. Please make any necessary
corrections.
d. Please show the drainage area line for each BMP on the plans.
2.) Deed Restrictions:
a. Lot Summary: Please submit the information required by the enclosed
table which summarizes which lots drain to each drainage area, the BUA
per lot, the total BUA in each drainage area for all of the lots in the
drainage area, and that the total BUA in each drainage area for all of the
lots equals the total permitted BUA for each drainage area. If the lot
numbers in the enclosed table need to be revised, please do so.
b. Deed Restrictions: Please submit a copy of the recorded deed restrictions
containing all of the required statements as listed in the current permit. If
lot number have been revised such that the deed restrictions need to be
revised please do so and submit the most current recorded deed
restrictions.
Please note that this request for additional information is in response to a preliminary
review. The requested information should be received in this Office prior to May 19,
2010, or the application will be returned as incomplete. The return of a project will
necessitate resubmittal of all required items, including the application fee.
If you need additional time to submit the information, please mail, email or fax your
request for a time extension to the Division at the address and fax number at the bottom

The Village at Motts Landing
New Hanover County
Dear Dr. Sobol:
The Wilmington Regional Office received and accepted a Plan Revision request for a State
Stormwater Management Permit for The Village at Motts Landing on March 5, 2010. A
preliminary in-depth review of that information has determined that the application is not
complete. The following information is needed to continue the stormwater review:
1.) Impervious allocation: Please verify that the enclosed BUA Summary table reflects the
impervious area configuration requested for this project.
2.) Lot Configuration: It appears that lot 136 has been added north of lot 120 on the plans
submitted for this plan revision. However, the approved plans show that lot 136 is west
of lots 137 and 154. Please submit revised plans showing all of the lots for the entire
project in their revised configuration from the plans permitted on August 22, 2008. In the
revised plans, please show a project area line establishing the area that is covered
under this permit. In particular, please show whether or not the area labeled as "future
development" in hatched lines on the August 22, 2008 plans is included in this permit.
3.) Deed Restrictions:
a. Lot Summary: Please submit the information required by the enclosed table
which summarizes which lots drain to each drainage area, the BUA per lot, the
total BUA in each drainage area for all of the lots in the drainage area, and that
the total BUA in each drainage area for all of the lots equals the total permitted
BUA for each drainage area. If the lot numbers in the enclosed table need to be
revised, please do so.
b. Deed Restrictions: Please submit a copy of the recorded deed restrictions
containing all of the required statements as listed in the current permit. If lot
number have been revised such that the deed restrictions need to be revised
please do so and submit the most current recorded deed restrictions.
Please note that this request for additional information is in response to a preliminary review.
The requested information should be received in this Office prior to May 19, 201 G, or the
application will be returned as incomplete. The return of a project will necessitate resubmittal of
all required items, including the application fee.

approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject

I went through this package this afternoon and it looks like you may have a plan revision rather than a permit
modification (which means it is free). The overall BUA is maintained at the same amount as was permitted
(1,748,918sf). In DA112,535sf of BUA is moving from "future" to "streets". And, in the "overall" totals, the clubhouse
(6,707sf) and parking (5,832sf) have been removed and this BUA has been transferred to future. Can you confirm that
these are the only changes and that there are no other changes being proposed that would affect the permit text.
(Such as the # of lots is staying the same, you aren't adding or removing drainage area, you aren't doing any changes to
the design of any of the ponds; etc). If so, then we will return the check and process this as a plan revision.

We are requesting a modification to the abo eferenced e or a proposed
amenities area. The original permit included the impervious area for the proposed
clubhouse. We are now also proposing a pool, tennis court and parking area. The
additional impervious amount has been taken out of the impervious area listed as "future"
on the original permit. Therefore there is no net change to the total impervious area
permitted and no change to the design of the pond.
Enclosed please find two (2) sets of plans, one (1) signed original and one (1)
copy of the application form with narrative, a wet detention basin supplements, operation
and maintenance agreement, (2) sets of calculations and one check for the application fee.

The Village at Mott's Landing — Amenities Area is an existing vacant 2.88 acre tract
proposed for use with a clubhouse, pool, tennis Court and parking area. The location of
this Amenities Area replaces the one previously designed for this project. Stormwater
drainage from the Amenities Area will drain to Wet Detention Basin #1. The change in
location of this area has no affect on the previous design of Wet Detention Basin #1 since
the amount of the total drainage area and impervious area remains the same.
Wet Detention Basin #1 was designed as high density and treated by wet detention. This
pond was designed to meet the State's 1" and the County's 25-year pre -post requirement.
Outflow from all ponds drains to Mott's Creek, classification C-SW.
