Dear Dr. Sobol:
The Wilmington Regional Office received a copy of the Sedimentation and Erosion Control
application for the disturbance of 4.09 acres for the addition of landscaping and a fence at the
previously permitted subject project. Staff of the Wilmington Regional Office has reviewed the
current grading activity for the applicability of the Stormwater Management rules. Based on our
review, the proposed landscaping and fence installation activity will not require a permit
modification. Please be advised that other regulations will potentially apply to your proposed
activities.
If your project disturbs one acre or more and has a point source discharge of stormwater
runoff, then it is subject to the National Pollutant Discharge Elimination System (NPDES)
stormwater discharge requirements. You are required to have an NPDES permit for
stormwater discharge from projects meeting these criteria.
This exemption applies only to the Coastal Stormwater Management Permit for the currently
proposed grading activity. The subdivision itself received a high density stormwater
management permit on July 9, 2004, which remains in effect. If the proposed activities differ in
any manner from what is shown on the plans on file with the Division, then you must submit
the project for review of the applicability of the stormwater management rules prior to said
construction or development. If you have any questions concerning this matter, please do not
