Salisbury Street Raleigh, NC 27604 Re: 3127 Poole Road Towns Request for NWP 29, GC 4256, and Neuse Riparian Buffer Authorization Sage Project #2018.042 On behalf of Southern Purchasing Group, LLC (owner and applicant), please find attached a complete application and supplemental information requesting written concurrence from the US Army Corps of Engineers (USACE) that the activities associated with the proposed development of the 3127 Poole Road Towns subdivision (Project) may proceed under Nationwide Permit (NWP) 29, General Certification 4256 (GC 4256), and Neuse Riparian Buffer Authorization Project Purpose and Location The Project includes the construction of a residential townhome subdivision. The +/-5.672-acre tract is located at 3127 Poole Road, in Raleigh, Wake County. The coordinates of 35.7771 °N, 78.5857°W generally correspond to the center of the Site. Protect Detail The proposed Project consists of the construction of a townhome development with associated driveways, utilities, and roads. Municipal sewer and water are available to the Site. Access to the Site will be provided via Poole Road to the south. Heavy equipment typically used for utility installation projects (e.g., backhoes, bulldozers, etc.) will be utilized. No federally threatened or endangered species are listed to occur on the Site according to the NC Natural Heritage Program (NCNHP) Database. (see attached report dated December 16, 2021). The Site itself is not listed as a historic property. There are one hundred sixteen properties listed within 1.0 mile of the Site. Protect History The site is part of a larger, 17.77-acre parcel. The project site is undeveloped and forested. The southern portion of the parcel is currently being developed. One riparian wetland and four jurisdictional streams exist on the parcel. Residential property exists to the east, west and south of the site while commercial and industrial properties exist to the north. Previous DWR certification (DWR #19-1710) was issued January 27, 2020, and a Buffer Determination letter August 13, 2018. The USACE issued a PJD (SAW 2017-00565) previously. The Permit request in 2020 was below notification thresholds for USACE. Mr. Sean Clark of Sage Ecological Services, Inc., performed a wetland and stream delineation in 2018 with the USACE site visit conducted with Ms. Tasha Alexander on June 26, 2018. Avoidance and Minimization 3127 Poole Road Towns Page 1 of 2 This project has been designed to meet purpose and need while avoiding and minimizing impacts to onsite natural resources to the greatest extent practicable. There are 0.088 acres of onsite wetlands, of which only 0.036 acres are proposed to be permanently impacted. There are 1,788 linear feet of stream onsite, and only 145 linear feet are proposed to be permanently impacted. Only 12,042 square feet of Zone 1 buffers are proposed to be permanently impacted by the project, and 6,271 square feet of Zone 2 buffers are proposed to be permanently impacted by the project. Construction fencing will be used to define the construction corridor and prevent any accidental additional impacts, while silt fencing will be installed to provide additional protection from runoff. Protect Impacts The proposed road crossing will result in 0.036 acre of permanent wetland impact and 145 linear feet of permanent stream impact. Permanent riparian buffer impacts total 12,042 sf in Zone 1 and 6,271 sf in Zone 2 for the proposed road crossing. No other impacts are proposed. Mitigation Permanent wetland impacts total 0.036 acre and permanent perennial stream impacts total 145 linear feet which are below mitigation thresholds. Riparian buffer impacts total 18,313 sf and will be mitigated through the purchase of credits from the North Carolina Division of Mitigation Services. Based on the project area mapped with your request, a query of the NCNHP database indicates that there are no records for rare species, important natural communities, natural areas, and/or conservation/managed areas within the proposed project boundary. Please note that although there may be no documentation of natural heritage elements within the project boundary, it does not imply or confirm their absence; the area may not have been surveyed. The results of this query should not be substituted for field surveys where suitable habitat exists. A written submission shall also be provided within 5 business days of the time the applicant becomes aware of the circumstances. The written submission shall contain a description of the noncompliance, and its causes; the period of noncompliance, including exact dates and times, if the noncompliance has not been corrected, the anticipated time compliance is expected to continue; and steps taken or planned to reduce, eliminate, and prevent reoccurrence of the noncompliance. The Division may waive the written submission requirement on a case -by -case basis. 3. Protective Fencing The outside buffer, wetland or water boundary and along the construction corridor within these boundaries approved under this authorization shall be clearly marked with orange warning fencing (or similar high visibility material) for the areas that have been approved to infringe within the buffer, wetland or water prior to any land disturbing activities to ensure compliance with 15 NCAC 02H .0500. [15A NCAC 02H .0506 (b)(2) and (c)(2) and 15A NCAC 02H .0507 (c)] 4. This approval is for the purpose and design described in your application. The plans and specifications for this project are incorporated by reference as part of the Certification and Buffer Authorization. If you change your project, you must notify the Division and you may be required to submit a new application package with the appropriate fee. If the property is sold, the new owner must be given a copy of this approval letter and General Certification and is responsible for complying with all conditions.
