Hello Mr. Washburn,
On December 28, 2021, the Division of Water Resources (Division) received your application requesting a 401 Water
Quality Certification from the Division for the subject project. The Division has determined that your application is
incomplete and cannot be processed. The application is on‐hold until all of the following information is received:
1. The Division has not received the application review fee. The application is not complete until the fee is
received. Please ensure the application review fee is paid. [15A NCAC 02H .0502(a)(10)]

2. Please provide a site plan showing the property boundaries, structures (buildings, docks, impervious surfaces,
etc.), location of the shoreline, location of the impacts to the shoreline and/or lake bottom (excavation,
dredging, rip rap, retaining walls, etc.), and the location and area (sqft) of any vegetated areas that will be
impacted within Zone 1 and Zone 2 of the Catawba Riparian Buffer Rule. [15A NCAC 02H .0502(a)(9)]
3. Please locate all protected riparian buffers as overlays on the site plan, clearly showing Zone 1 and Zone 2. [15A
NCAC 02B .0611(b)(1)(f)]
4. The shoreline stabilization application proposes impacts of 1030 square feet of impact within the Catawba
Buffer:
Please provide the total amount of disturbance within Zone 1:
Temporary: Include all clearing for construction corridors expressed in square feet. Buffer restoration
actions are required in all areas with temporary impacts.
Permanent: Include all clearing, back fill, excavation, rip rap, retaining walls, and the like expressed in
square feet.

Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the
proper consideration of the application. Please respond in writing within 30 calendar days. If all of the requested
information is not received within 30 calendar days of receipt of this letter, the Division will be unable to approve the
application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the Division
for approval, including a complete application package and the appropriate fee.
Please be aware that you have no authorization under the Section 401 of the Clean Water Act for this activity and any
work done within waters of the state may be a violation of North Carolina General Statutes and Administrative Code.
