This permit shall be effective from the date of issuance until May 31, 1989, shall be subject to the conditions and limitations as specified therein and shall void Permit No. 6485, issued March 11, 1981. If any parts, requirements, or limitations contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing before a hearing officer upon written demand to the Director within thirty (30) days following receipt of this permit, identifying the specific issues to be con- tended. Unless such demand ii made, this permit shall be final and binding. One (1) set of approved plans and specifications is being forwarded to you. C. 27611-7687 An Equal Opportunity Affirmative Action Employer • • NORTH CAROLINA ENVIRONMENTAL MANAGEMENT COMMISSION DEPARTMENT OF NATURAL RESOURCES AND COMMUNITY DEVELOPMENT RALEIGH PERMI T For the Discharge of Sewage, Industrial Wastes, or Other Wastes In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and other applicable Laws, Rules, and Regulations PERMISSION IS HEREBY GRANTED TO Milliken and Company Rutherford County FOR THE continued operation of a 31,000 GPD spray irrigation type non -discharge system con- sisting of the use of an existing treatment and storage pond with a total volume of 1.36 MG, dual 120 GPM spray pumps; chlorination; 12.25 acres of irrigation area; and associated piping, valves and spray headers to serve the Milliken Golden Valley Plant; with no discharge of wastewater from the irrigation site to the surface waters of the State, pursuant to the request letter received March 12, 1984, and in conformity with the project plans, specifications, and other supporting data, subsequently filed and approved by the Department of Natural Resources and Community Development and considered a part of this Permit. This Permit shall be effective from the date of issuance until May 31, 1989, shall be subject to the following specified conditions and limitations and shall void Permit No. 6485: 1. This permit shall become voidable unless the facilities were constructed in accordance with the approved plans, specifications and other supporting data. 2. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. The facilities shall be properly maintained and operated at all times. 4. The sewage and wastewater collected by this system shall be adequately treated in the Milliken and Company's Treatment Lagoon prior to being sprayed on the irrigation site. Permit No. 6485R Page Two 5. This Permit is not transferable. 6. The facilities shall be effectively maintained and operated at all times so that there is no discharge to the surface waters, nor any contamination of ground waters which will render them unsatisfactory for normal use. In event the facilities fail to perform satisfactorily, including the creation of nuisance conditions, or failure of the irrigation area to adequately absorb the wastewater, the Permittee, shall take such immediate corrective action as may be required by the Division of Environmental Management. 7. In event the facilities fail to perform satisfactorily, the Permittee shall take such immediate corrective action as may be reqired by this Department. 8. Solids, sludges, or other pollutants removed or resulting from the waste- water treatment process shall be contained and disposed of in such a manner as to prevent any contamination of the surface or ground waters of the State. 9. Adequate facilities shall be provided to prevent surface runoff from carrying any disposed or sorted material into the receiving stream. 10. Diversion or bypassing of the untreated wastewater from the treatment facility or spray field is prohibited. 0 11. Satisfactory controls shall be provided to contain the accidental discharge or spillage of hazardous or toxic substances either stored or being used in the facilities on the project site. 12. A suitable year round vegetative cover shall be maintained. 13. Irrigation shall not be performed during inclement weather or when the ground is in a condition that will cause runoff. 14. Dikes shall be constructed so as to prevent surface water (:unoff from the spray field. 15. The Permittee, at least six (6) months prior to the expiration of this Permit, shall request its extension. Upon receipt of the request, the Commission will review the adequacy of the facilities described therein, and if indicated, will extend the Permit for such period of time and under such conditions and limitations as it may deem appropriate. 16. The Permittee shallprovide and maintain monitoring facilities and a ground water monitoring program such as may be required by the Division of Environmental Mantement. 17. The application rate shall not exceed 1.10 inches/acres/week. 18. Freeboard in the treatment and storage lagoon shall not be less than one (1) 110 at any time. 411 Permit No. 6485R Page Three . 19. The final management plan for the spray.irrigantion facility shall be submitted to the Division of Environmental Management prior to placing the spray irrigation system in operation. 20. Any monitoring deemed necessary by the Division of Environmental Management to insure surface and ground water protection will be established and an acceptable sampling reporting schedule shall be followed. 21. The issuance of this permit shall not relieve Milliken and Company of the respon- sibility for damages to surface or ground waters resulting from the operation of this facility. 22. The facilities shall be effectively maintained and operated as a non -discharge system to prevent the discharge of any wastewater into the surface waters of the State. 23. Adequate inspection, maintenance, and cleaning shall be provided by the permittee to insure proper operation of the subject facilities. 24. Phenols shall be added to the following list of parameters to be closely monitored through the next two (2) cycles of the monitoring schedule and additional monitoring wells may be required by the Division if the concentration levels of these parameters continues to increase: a. dissolved solids b. bicarbonate c. calcium d. hardness e. specific conductance Permit issued this{'the 14th day of May, 1984.
