Hello Ms. Parker,
On January 11, 2022, the Division of Water Resources (Division) received your application requesting a 401 Water
Quality Certification from the Division for the subject project. The Division has determined that your application is
incomplete and cannot be processed. The application is on‐hold until all of the following information is received:
1. The application for shoreline stabilization received proposes 795 linear feet of impacts to the shoreline of Lake
James. This project exceeds the Special Condition s of USACE GP 30 and cannot be authorized by the Division
with GC 4502. Please contact Crystal Amschler crystal.c.amschler@usace.army.mil with the USACE to discuss
404 permit requirements. If the USACE determines this project is covered by NWP 14 or another nationwide
permit, please submit a Pre‐Construction Notification at the following
link. https://edocs.deq.nc.gov/Forms/Pre‐Construction_Notification_Form .

Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the
proper consideration of the application. Please respond in writing within 30 calendar days. If all of the requested
information is not received within 30 calendar days of receipt of this letter, the Division will be unable to approve the
application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the Division
for approval, including a complete application package and the appropriate fee.
