Salisbury Street Raleigh, North Carolina 27604 Attention: Ms. Chem Smith Subject: NCDWR Request for Additional Information Nationwide Permit No. 39 Proposed Project ZDC Wake County, North Carolina USACE Action ID 201101006 DWR #14 -0106 Dear Ms. Smith: r�@oe� FEB 2 7 2014 On behalf of the Branch Bank and Trust Company (BBBT), and in cooperation with Little Diversified Architectural Consulting (LITTLE), STV /Ralph Whitehead Associates (STV /RWA), is submitting additional information in support of the Pre - Construction Notification (PCN) application form pursuant to U.S. Army Corps of Engineers ( USACE) Section 404 Nationwide Permit (NWP) Number 39 — Commercial and Institutional Developments (Federal Register Vol. 77, No. 34; updated February 21, 2012) for the permitting requirements of the proposed Project ZDC in Zebulon, NC. As per your February 18, 2014 letter requesting additional information for Project ZDC, we are enclosing four (4) copies of the following information: 1. A site plan of the project on a full -size plan sheet, with topographic contours shown, is attached (Drawing WD -6). 2. Wetlands, streams and riparian buffers are depicted on the site plan (WD -6). 3. The proposed limit of construction (LOC) is depicted and all wetland, stream and open water impacts are clearly labeled on the site plan (WD -6). 4. Drawing WD-4 is included and has been revised to clearly indicate 56 linear feet of impact to seasonal RPW Stream B. 5. Documentation from the Pancho Stream and Wetland Mitigation Bank indicating their willingness to sell wetland mitigation credits for Project ZDC. Project plans for the .development propose diverting the off -site drainage currently going to linear Wetland A to Pond C, and then filling linear Wetland A because it is located within the proposed development footprint. We have recently identified additional impacts resulting from the need to place the off -site drainage pipe outfall within Pond C. Therefore, an additional 0.014 Branch Bank and Trust Company Project ZDC - NCDWR Request for Additional Information February 26, 2014 acre of impact to Pond C is proposed for the construction of the drainage pipe outfall, riprap pad and grading. This 0.014 acre of impact was not accounted for in the permit application. Therefore, we have attached pages 4 and 5 of the PCN that have been revised to include the proposed 0.014 acre of open water impact to Pond C (revisions have been highlighted for your convenience). James Lastinger with the USACE was informed of this additional impact to see if it would change the mitigation requirements. According to the USACE, since this is an open water impact, no additional mitigation would be required. Restoration Systems (RS) attests to the fact that 0.43 wetland credits are currently available for immediate transfer from its Official Bank Credit Ledger to Applicant and that as of this date RS has placed 0.43 credits into "no- sale " - reservation status under the name of the project referenced on this document (Project). Forty -three one hundredths (0.43) credits will remain in reservation status until payment in full is received from the Applicant, resulting in the issuance of a Transfer of Mitigation Responsibility Form by RS acknowledging that the applicant has fully secured credits from the bank and RS has accepted full responsibility for the mitigation obligation requiring the credits. If RS does not receive payment in full for the Mitigation Credits within thirty (30) prior to the BB&T — Project ZDC — Compensatory Mi4gtWon — Rs — Page I initiation of Project construction, RS has the right to terminate this Reservation Letter, in which case RS will have no further obligation to provide mitigation credits to the Applicant. RS will issue the Mitigation Responsibility Transfer Form within ten (10) days of receipt of the Purchase Price. RS shall provide to Applicant the Transfer Certificate debiting credits from the Bank Official Credit Ledger showing the permit number and the resource type secured by the applicant, and will send an a copy of the Mitigation Responsibility Transfer Form with an updated Official Credit Ledger to regulatory agencies showing the proper documentation.
