Dunn, Coastal Coordinator Habitat Conservation Division DATE: January 13, 2022 SUBJECT: CAMA Dredge/Fill Permit Application for Tom Chadwick, Brunswick County, North Carolina. Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit application with regard to impacts on fish and wildlife resources. The project site is located at 539 Lockwood Folly Road SE, adjacent to the A1WW in Bolivia, NC. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, the Endangered Species Act of 1973, as amended (16 U.S.C. 1331 et seq.), the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.), the Magnuson -Stevens Fishery Conservation and Management Act (FCMA), as amended (16 U.S.C. 1801 et seq.), and the Migratory Bird Treaty Act (16 U.S.C. 703-712 et seq.). The applicant proposes to excavate an access channel and boat basin around and beneath an existing docking facility to a final water depth of -5' NLW. The 80' by 50' cut would remove 417 CY of material via bucket to barge. The application states the material would be excavated and loaded into a barge that would offload to a dump trailer at the nearby NCWRC ramp. The material would then be moved to 540 Lockwood Folly Road and disposed in an upland area greater than 75' from the Estuarine Shoreline AEC. The AIWW in this location is classified SA HQW by the Environmental Management Commission. The NCWRC has reviewed the permit application. To minimi7e impacts to shallow water habitats with SA HQW classified waters, we request the applicant consider reducing the final water depths within the project area to -4' rather than -5' NLW. This would minimize the footprint and should still provide adequate water depths for vessels using the facility. Other activities are prohibited by rule. Requests can be routed through the NCWRC Land and Water Access Division for consideration of a Special Use Permit if the activity does not damage the site or significantly compromise intended public use of the area. The activity described in the application package is not an allowable activity and therefore must seek a Special Use Permit from our Raleigh office.
