PROJECT SUMMARY: The applicant proposes to replace the existing bulkhead with associated coastal wetland fill, and replace the existing timber walkway and bridges adjacent to the shoreline. PROJECT DESCRIPTION Bald Head Island is part of an island group known as Smith Island, located east of the mouth of the Cape Fear River, between Fort Fisher to the north and the Atlantic Ocean to the south with Oak Island/Caswell Beach to the west. The island is accessed by private boat or private ferry service from Southport. The project site is located within the Timber Creek Condo complex off N. Bald Head Wynd, within the Village of Oak Island, in Brunswick County. The site consists of condominiums, two existing community docks with a boat ramp facility and a 4' wide wooden walkway along the shoreline which is predominantly bulkheaded. The waterbody measures approximately 200' in width in this location. The upland portion of the site is vegetated primarily with lawn grasses. The docks were originally constructed by Bald Head Island Limited, LLC under State Permit No. 151-84. The docking facility was replaced and expanded under State Permit No. 122-15 which was issued on November 5, 2015. State Permit No. 122-15 expired on December 31, 2018. No permit history was found for the existing bulkhead. The bulkhead runs the majority of the length of the shoreline, with short gaps along areas of where the coastal wetlands extend landward of the bulkhead. There are sparse narrow fringes of Salt Marsh Cordgrass (Spartina altemiflora) along this stretch of shoreline. The overall shoreline length for the property exceeds 1000' linear feet in total. The waters of Bald Head Creek are classified SA by the North Carolina Division of Water Resources. The area is not designated as a Primary Nursery Area (PNA) by the North Carolina Division of Marine Fisheries and is OPEN to the harvesting of shellfish. PROPOSED PROJECT: The applicant proposes to replace the existing bulkhead with associated coastal wetland fill, and replace the existing timber walkway and bridges adjacent to the shoreline. The proposed replacement bulkhead would be 575 linear ft. in length an average of 2 ft. waterward of the existing wall, which is at NHW. There are three Coastal Wetland impact areas measuring 80 sq. ft., 31 sq. ft. and 103 sq. ft. (see Sheets 4 and 5 of 10) for a total of 214 sq. ft. of Coastal Wetland Fill. Two existing bridges that span existing drainage ways are also proposed to be replaced. The eastern bridge would be a 33 ft. long by 4 ft. wide crossing and the western bridge would be a 48 ft. long by 4 ft. ft. wide crossing over Coastal Wetlands. Although water depths at the existing drainage ways are over 2 ft. at NLW, these drainage way areas are not navigable and these structures would not impact channel navigation. The timber bridges would tie directly into the proposed timber walkway. The timber walkway would be a 4 ft. wide shoreside walkway mostly directly adjacent to and landward of the bulkhead. The timber walkway would extend a total of 735 linear ft. The walkway would extend past the bulkhead to the high ground on the south side of the project and would tie into the existing timber walkway on the northern side of the project. There are no proposed changes to the existing docking facility. 10. ANTICIPATED IMPACTS: The project would result in the filling of approximately 1.511 square feet of Public Trust Area and Estuarine Waters and 214 sq. ft. of Coastal Wetland Area as a result of bulkhead replacement. The bridge replacement would result in the shading of 388 square feet of Estuarine Waters and Coastal Wetlands. High ground impacts for bulkhead replacement and timber walkway construction would be approximately 11,500 sq. ft. Temporary increases in turbidity can be expected during construction. The shoreline of the property runs southeast to northwest for approximately 650'. Structures include eighteen buildings and thirty six condominium units, attached decks, accessory structures, a community pool and asphalt pathways. Structures tend to be 10-50 feet from the normal high water line. The various units each have a different owner; all work is to take place in the common area managed by Timbercreek Condominium Association. The project shall consist of 575 LF bulkhead to be replaced, the new wall constructed approximately 2' waterward of existing bulkhead. Adjacent to the bulkhead, 735 LF of elevated timber walkway to be constructed in the same location as existing walkway. A site plan of the proposed improvements is shown on Sheet 04. A scoping meeting for this project was held on September 13, 2021. RECEIVED JAN 1 9 2022 DCM WILMINGTON, NC Bulkhead And Timber Walkway Replacement Major CAMA Permit Application — Narrative November 12, 2021 Page 1 of 4 PROJECT DESCRIPTION Two (2) floating docks accessed by gangways shall remain in their current positions. The docks are approximately 8' wide, L shaped, projecting some 30' to 35' from the existing shoreline. The eastern dock is about 61' in total length. The western dock is about 48' in total length. No proposed structure shall extend more than a quarter of the channel width, as measured from the normal high water line on either side of the channel. The property has 650 linear feet of shoreline. The maximum allowable shaded square footage is 5,200. The existing floating docks have a total area of 835 square feet. The most narrow width of the channel is 140'. There is aproximateLy 575 linear feet of existing timber bulkhead and 735 linear feet adjacent 4 foot wide timberwalkway along the shoreline used and maintained by Timbercreek Condominium Association. The project shall include the construction of the bulkhead to be constructed approximately 2' waterward of existing bulkhead, as measured from face to face. 735 linear feet of elevated timber walkway landward of existing bulkhead shall be removed and replaced, including the two bridges over existing drainage areas. The timber walkway includes two pile supported bridges with simple timber foundation piles which cross two drainage areas. Each existing bridge will be removed and replaced in same location. The water depth at the 33' long eastern bridge is 2.8" deep. The water depth at the 4B' long western bridge is 4.5' deep. The western bridge will cross the wetlands, and be 5' above wetlands. The bridges and walkway are not expected to impact channel navigation. EXISTING CONDITIONS Site Topography and Hydrography - The topography of the upland development site is relatively flat. The base flood elevation at the site is 9 feet (NAVD 88 datum). Land Use — The use of the site is as a residential townhome complex. Wetlands — Coastal wetlands are Located waterward of the existing bulkhead. Approximately 214 square feet of wetlands will be impacted by the new bulkhead, 44 SF of which will be filled in order to backfill the 1' wide area between the existing and proposed bulkhead. Navigation — The two (2) existing and floating docks shall remain in their current position, and outside the setback from the channel. Stormwater — No discharges are proposed as apart of this project. Existing drainage patterns will remain. Existing drainage is primarily sheet flow from onsite and offsite areas over vegetation. METHODS OF CONSTRUCTION Bulkhead will be constructed approximately 2' waterward of existing bulkhead, elevated timber walkway will be constructed in the same location. Construction of the bulkheads will be with conventional marine construction including barge cranes. Equipment will be on -site only a sufficient time to complete the installation. Walkway piles will be driven into the substrate to minimize turbidity. PROJECT SCHEDULE Construction of shoreline improvement project is expected to start soon after permit issuance and within the permitted time frame. COMPLIANCE WITH THE N. C. ENVIRONMENTAL POLICY ACT The Regulatory Reform Act of 2011 (SB 781) was passed by North Carolina Legislature in July 2011. This bill eliminates the requirement for an environmental assessment (EA) for any project requiring a Major CAMA permit. Therefore, the proposed project is not subject to N. C. Environmental Policy Act review. CAMA COMPLIANCE The project proponent hereby certifies that all information contained herein is true, accurate, and complete to the best of my knowledge and belief. The project proponent hereby requests that the certifying authority review and take action on this CWA 401 certification request within the applicable reasonable period.
