Good morning Kim,
Per our phone conversation yesterday, the ePCN application for the Bridgewater Landing project (D.
Logan) in Hampstead, Pender County lacks the information necessary to complete the review.
According to our conversation the drawings contained in the ePCN application submitted on
12/1/2021 to the DWR and USACE may not be the plans that are currently being used to actively
construct the project. The submitted ePCN application should be corrected to accurately reflect the
appropriate NW permit for this project. The DWR submitted the NW 29 permit request change on
your behalf yesterday and the public notice process has been initiated.
Additionally, based on reports (attached) and correspondence from DEMLR Sedimentation and
Erosion Control Inspector Trentt James, the plans provided to DEMLR may also not accurately reflect
what is currently being constructed on the ground. Any sediment that has entered the wetlands or
streams as a result of ongoing land disturbance must be restored prior to issuance of the DWR
Individual Water Quality Certification (WQC).
The submitted drawings include only "typical" cross sections of the proposed road crossings. The
notes on the "typical cross sections" drawings indicate the 24" and 36" pipes will be buried 12".
"Culverts shall be designed and installed in such a manner that the original stream
profiles are not altered and allow for aquatic life movement during low flows. The
dimension, pattern, and profile of the stream above and below a pipe or culvert shall
not be modified by widening the stream channel or by reducing the depth of the
stream in connection with the construction activity. The width, height, and gradient of
a proposed culvert shall be such as to pass the average historical low flow and spring
flow without adversely altering flow velocity. If the width of the culvert is wider than
the stream channel, the culvert shall include multiple boxes/pipes, baffles, benches
and/or sills to maintain the natural width of the stream channel. If multiple
culverts/pipes/barrels are used, low flows shall be accommodated in one culvert/pipe
and additional culverts/pipes shall be installed such that they receive only flows above
bankfull."
"Placement of culverts and other structures in streams shall be below the elevation of
the streambed by one foot for all culverts with a diameter greater than 48 inches, and
20% of the culvert diameter for culverts having a diameter less than or equal to 48
inches, to allowlow flow passage of water and aquatic life. If the culvert outlet is
submerged within a pool or scour hole and designed to provide for aquatic passage,
then culvert burial into the streambed is not required."
Wetland Notes #2 on Fig 1 state 'proposed design includes no impacts with the use of bottomless
culverts' which is inconsistent with the application and drawings submitted. Please clarify.
The proposed crossings depict rip rap aprons at the downstream pipe inverts. The typical cross
section drawing shows permanent impacts outside of the right of way and beyond the proposed
retaining wall that would provide slope stabilization. Please provide other cross section drawing
depicting the dimensions of the fill slope outside the R/W and rip rap aprons to determine if
minimization has been considered.
Additional cross section drawings for each crossing depicting the proposed wetland fill, retaining
walls and pipes must be submitted for review.
Please account for any temporary impacts associated with utility line construction.
The DWR recommends that you include draft deed language to ensure compliance with the
following condition:
"Deed notifications or similar mechanisms shall be placed on all lots/parcels with
retained jurisdictional wetlands, waters, and state regulated riparian buffers within
the project boundaries in order to assure compliance with NC Water Quality
Certification Rules (15A NCAC 02H .0500), NC Isolated Wetland Rules (15A NCAC
02H .1300), and/or State Regulated Riparian Buffer Rules (15A NCAC 02B .0200).
These mechanisms shall be put in place at the time of recording of the property or
individual parcels, whichever is appropriate."
The application is on hold until a response to this request for additional information has been
received by our office. A copy of the DWR Water Quality Certification 4256 has been attached to
assist in your completion of the request for additional information. Please feel free to call or email

I wanted to check in with you regarding the permit application we submitted for Bridgewater
Landing (aka Edens Lane). Have you had a chance to look at this one yet? Tom is ready to issue the
