Division personnel have reviewed and approved your application for renewal of the subject
permit. Accordingly, we are forwarding the attached final NPDES discharge permit. This permit is
issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum
of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15,
2007 (or as subsequently amended).
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty
(30) days following receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such
demand is made, this permit shall be final and binding.
Please take notice that this permit is not transferable. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division of Water Quality or permits
required by the Division of Land Resources, Coastal Area Management Act, or any other Federal or
Local governmental permits which may be required.

This permit shall become effective January 1, 2012.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES permits issued to this facility, whether for operation or discharge are hereby
revoked. As of this permit issuance, any previously issued permit bearing this number is no longer
effective. Therefore, the exclusive authority to operate and discharge from this facility arises under the
permit conditions, requirements, terms, and provisions included herein.
Aqua North Carolina, Inc. is hereby authorized to:
1. Continue to operate an existing 0.100 MGD single train extended aeration wastewater treatment
facility (package plant) with the following components:
• Manual bar screen
• Flow control box
• 35,000 gallon flow equalization with 2 flow equalization pumps
• 3 - Blowers
• 35,000 gallon aerated sludge holding tank
• 75 kW standby generator
• Tablet chlorination
• Liquid dechlorination
• Flow meter
The facility is located at 6606 River Road, Wilmington, NC at Beau Rivage Plantation, New
Hanover County.
2. Operate a 0.200 MGD wastewater treatment facility following the construction of a 0.200 MGD
wastewater treatment plant consisting of flow equalization basin, two aeration basins, two
secondary clarifiers, two tertiary sand filters, post aeration, sludge holding basin, and UV
disinfection. [Authorization to Construct No. 065840A01 i ued March 30, 2006]
After receiving an Authorization to Construct from the Divisionon of Water Quality, upgrade the
facility not to exceed 0./p0 MGD.

4. Discharge from said treatment works at the location specified on the attached map into the Cape
Fear River, currently classified aters in sub -basin 03-06-17 of the Cape Fear River
Basin.

A. (4.) PERMIT RE -OPENER: SUPPLEMENTARY NUTRIENT MONITORING/TMDL IMPLEMENTATION
Pursuant to N.C. General Statutes Section 143-215.1 and the implementing rules found in the North Carolina
Administrative Code at 15A NCAC 2H.0112 (b) (1) and 2H.0114 (a) and Part II sections B-12 and B-13 of this
permit, the Director of DWQ may reopen this permit to require supplemental nutrient monitoring of the discharge.
The purpose of the additional monitoring will be to support water quality modeling efforts within the Cape Fear .
River Basin and shall be consistent with a monitoring plan developed jointly by the Division and affected
stakeholders. In addition, the results of water quality modeling may require that limits for total nitrogen and total
phosphorus be imposed in this permit upon renewal.
The Division may, upon written notification to the permittee, re -open this permit in order to incorporate or modify
effluent limits, monitoring and reporting requirements, and other permit conditions when it deems such action is
necessary to implement TMDL(s) approved by the USEPA.

143-215.1(a1) states : In the event that both effluent standards or limitations and classifications and water quality
standards are applicable to any point source or sources and to the waters to which they discharge, the more stringent
among the standards established by the Commission shall be applicable and controlling.
The water quality standard of 10 mg/L is more stringent and controlling. I'm going to get on my soap box here for a
moment. We have grossly missed the proper classification of a huge segment of the Cape Fear River for PNA/HQW long
ago. I assure you the PNA status was established before these two facilities were built. So, we can also argue that when
we have found a mistake in our permit limitations (I'll find that reg in the general statute if you give me time... ) we are
obligated to correct the issue in the permit. All we are asking in the region is for DWQ to honor the general statute 143-
215.1(a1) and impose the 10 mg/L limit if the facility has tertiary treatment. We agree, at this point, we can't impose
the tighter standards on the rest who don't have tertiary treatment, but will provide appropriate limitations upon
expansion or upgrade. I'm not sure how we would explain to our good friends with CHPP that we aren't going to make
our ww facilities use their tertiary filters (when they have them) to meet a PNA standard.
Please, I've been battling this PNA issue for over two years... I had to explain to the CHPP steering committee, how we
managed to miss this.. let's get the stakeholders involved and make sure we make a good and defendable decision on
this. Please....

Dean if you look at the rules for HQW (15A NCAC .02B .0244) you are correct that new discharges get a TSS limit of 10
mg/L. We have assumed that meant that was for a monthly average, and have been giving a 1.5 times value for daily
maximum.
However, you review the rule for expanded discharges, it reads, "All expanded NPDES wastewater discharges in High
Quality Waters shall be required to provide the treatment described in Sub -Item (1)(b), except for those discharges
which expand with no increase in permitted pollutant loading".
So, what I took this to mean was that expanded discharges did have to meet the same 10 mg/L for TSS spelled out in 15A
NCAC .02B .0224 (1)(b) that new discharges had to meet unless they could discharge at the higher volume without
adding to the total TSS load. Being the new guy, and thus not sure of my interpretation, we brought the issue up at

Monday's staff meeting. The discussion that occurred at the meeting confirmed my interpretation. So, what that
means, is that limits for an expanded discharge are based on a mass balance calculation. In this case, a doubling of the
discharge from 100,000 to 200,000 reduces the concentration from 30 mg/L to 15 mg/L. The increase to 500,000
reduces to 6 mg/L so the limit then becomes the prescribed 10 mg/L. The presence of absence of tertiary filters doesn't
come into play in the limit calculation, as much as we might like it to.
I hope this helps explain why we used the limits that we did in the various permits that have been swirling around lately.
We will be working with Planning to get the PNA/HQW issue in BIMS rectified.

For NC0065480:
• The address for the facility is 6606 River Road as in BIMS. It is not located within Beau Rivage Plantation nor on
Hwy 421.
Thank you for the clarification. The address was carried over from the current permit. I'll make the correction.
• In the Description put the flow EQ pump info with the EQ tank size; put the blower info as serving the EQ &
digester; add that it is a 100K single train extended aeration package plant with two blowers; tablet chlorination
and dechlorination; flow meter
The permit description/list of components is pulled from information provided in the renewal application. Both
that and the inspection report you provided with the staff report reference 3 blowers.
• Why is the stricter TSS limit not being applied to the 200K flow level as their A-to-C had tertiary filters included?
Need to change #2 in the Supplement as they already have the A-to-C.
They did get new TSS limit based on 15A NCAC 02B .0224(1)(c). The rule does not cover tertiary treatment and
the TSS limits are being changed only for new or expanding discharges.
#2 on the Supplement page will likely stay, or be modified depending on how far along they are with the
construction. Once complete and we receive an engineer certification the list of components will need to
transition anyway.
• Do the monitoring frequencies not increase as flow increases?
Not necessarily — monitoring frequency is typically based on the class of the facility. See 15A NCAC 2B .0500.

I was able to make some quick corrections to the Supplemental sheet before Dina took the files to process for public
notice. Any other tweaks may be made during the comment period. Pardon my rush but I'm running in several
directions today on several projects.
NC0065480:
• The existing plant is only 0.100 MGD without tertiary filters, thus existing 0.100 MGD flow & TSS limits should
remain. Both the 0.200 & 0.500 MGD flow limit pages are expansions and should get the new 10 & 15 TSS
limits. The A-to-C for 0.200 MGD already approved had tertiary filters included along with UV, but in theory they
could request an modified A-to-C to remove the filters and UV as not required and the tighter TSS limits would
prevent that.
John calculated the limits for the 0.200 MGD limits pages (TSS 15 & 22.5) based on the rule that covers
expansions with no increase in permit pollutant loading.
The 0.500 MGD limits page did get 10 & 15.
John, do you have any thoughts on this? I understand what Dean is saying but based on our units interpretation
of the rule....
• Would still list the dechlorination system as liquid and work in "package plant" in the opening sentence of the

PLAN OF ACTION FOR THE DOLPIIIN BAY WWTP
Aqua's long range plan for maintenance & upkeep to the Dolphin Bay WWTP includes replacement of
the effluent tank in 2013 & painting of the plant in 2014. These planned Capital improvements are a part
of Aqua's 5 year Capital Budget Plan just recently revised & approved. Aqua's 5 year Capital Budget is
reviewed & revised yearly to reflect current needs. While these are specific planned larger capital
outlays, Aqua will continue to evaluate & make necessary repairs to the air & diffuser system, & other
plant components on an as needed basis. Aqua has just recently implemented an Asset Management
Program, Maintenance Connection, which will help identify & track needed maintenance on all of our
facilities. Maintenance Connection will be linked in with our work order program & budgeting process to
allow for a more thorough review & tracking of our facility maintenance needs.

Thank you for the link and the info.
At this point, the permit classification has to match the classification in BIMS. PNAs were brought up about a year ago
but no real instruction on how to implement changes in the permit and communicating them to the permittee were
delved into. I have asked that PNA designated facilities up for renewal be discussed.
Jeff mentioned there were some discussions with planning on putting them in BIMS but Planning was opposed to doing
so...I'm sure there is probably a reason for this - but I'm not sure what that is at this point, I have a feeling it'll come up
again. I'll pass on anything that comes along.
I don't know about Southport. I'm being told that we can not threaten to not renew their permit. That decision isn't
really mine, I can only recommend that Jim, John, Jeff & Matt come to some consensus on that issue and how to
communicate that to the permittee. The Cape is due to go to public notice on 10/12.

PNA status & location is very static as far as we know. Classification was changed on draft paper permit for NC0075540
think. Planning/Basin group was supposed to get all these fixed during the past year from what we were led to believe

Can you send me or show me where it is shown that their outfall is in PNA area? I'll poke around on my end and ask
some of the other permit writers. I'm not sure who else has dealt with them but we/CO needs to discuss them and be
sure we're all on the same page.
I need to be able to show this somehow so that I can document any changes. It's my understanding that whether a
facility is in PNA or not could change from year to year.
Is there a map you use that is online? If so can you point me to the correct area? Is there a list of permits that are
affected?
If this is indeed in PNA then the TSS limits for the expanded limits will be changed to 10.0 mg/L. Per 15A NCAC 02B
.0101 (e)(5) & 15A NCAC 02B .0224(1)(b)(i0. Will put this in the draft cover letter for their reference.
The classification in the permit will remain "SC" but will be treated as HQW.
On a separate note...we can't make them connect Dolphin Bay but what was decided was that we'll put in
language/condition that specifies that the expanded limits only apply upon connection of....we haven't worked out the
language yet....but something to that affect.

Can we discuss the renewal of The Cape WWTP when you return to the office Wednesday? I've attached a copy of
Dean's staff report for your review along with an updated draft.
• The TSS limit has been re -corrected (see attached draft). Dean's staff report states in bold that the expanded
permit TSS limits should be changed...perhaps I misunderstood....regardless, I've changed the expanded flow
limit back to what it was.
• The permit is currently classified "SC." The staff report recommended the permit be "corrected" to water
classification of PNA HQW. PNA is not used currently, it is not an "official" stream class and changing the stream
class isn't something done by our unit. BIMS says it's "SC."
• May want to meet with Matt to since Dean mentions Matt was onboard with requiring Dolphin Bay (55107 —
expires 1/31/12) to connect to this permit, The Cape (57703 — expires 12/31/11). It's not our usual procedure to
hold up one permit renewal for another. Permits up for renewal are on a schedule based on their expiration
dates - and are sent to notice based on those. If mgmt is okay with delaying a renewal, I'm okay with it.
However...the issue of forcing Dolphin Bay to connect to The Cape (the subject draft -attached) and whether we
can threaten to not renew their permit next cycle is not typically done. If so, I will need some direction.
Let me know when you want to discuss this draft. It's scheduled for public notice on 10/12. Feel free to pass this onto
Matt if necessary.

So what reason are we giving for lowering the TSS limit? It is a HQW classification, I do not know about the PNA. The
Belville WWTP (NC0075540) has been listed as SC-HQW in it draft/renewal, thus assume that is how we are listing it.
We are not asking that this facility be connected to anything. We are requesting that we require their Dolphin Bay
facility (NC0055107) be connected to this facility by not renewing its permit next time —just like we did to Southport in
2006 which got them off-line in the past year. Reason that Matt signed off on the staff report was that he was on -board
with it.
We should simply notify them in this permit of our intent for Dolphin Bay to make sure everyone is clear. I would not
issue the two permits separately as they are linked by our request. Otherwise, we should take back the expanded,
regionalization flow from 0.4 to 0.75 at the bare minimum if not all the way back to 0.26 MGD.

RESIDUALS PLAN
AQUA, NC, COASTAL REGION
Sludge hauling from the plant is handled through an agreement with McGill Environmental. During
normal operation, waste solids are wasted to the solids holding tank to be thickened by settling &
decanting. Thickened sludge is tested to determine when it reaches approximately 2% solids content
before hauling. McGill brings a mobile dewatering unit onsite & dewaters the sludge, adding polymer &
returning the released water back to the head of the plant. The sludge is stabilized by McGill's
composting process to meet the requirements of Class A Biosolids, at McGill's permitted facilities,
WQ0006816 & SWC1906. TCLP analyses are kept on file at McGill & Aqua offices.
