REGAN Water Resources ENVIRONMENTAL QUALITY Secrelaty S. JAY ZIMMERMAN Director August 10, 2017 Mr. Shannon Becker Aqua North Carolina, Inc. 202 Mackenan Court Cary, North Carolina 27511 Subject: Issuance of NPDES Permit NC0065480 Beau Rivage Plantation WWTP Class WW-2 Onslow County Dear Mr. Becker: Division personnel have reviewed and approved your application for renewal of the subject permit. Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). The final permit includes the following significant changes from the existing permit: • Section A. (6.) has been updated to reflect current language regarding electronic submission of effluent data. Federal regulations require electronic submittal of all discharge monitoring reports (DMRs). ➢ Regulatory citations have been added. • Effluent limitation page has been added for 0.3 MGD flow. • Revised the Components list added for the proposed 0.2 MGD expansion. Please note that the Cape Fear River is listed as an impaired waterbody on the North Carolina 303(d) Impaired Waters List. Addressing impaired waters is a high priority with the Division, and instream data will continue to be evaluated. If there is noncompliance with permitted effluent limits and stream impairment can be attributed to your facility, then mitigative measures may be required. Please note that Cape Fear River is also a primary nursery area. Primary Nursery Areas, as defined by the Marine Fisheries Commission, are those areas in the estuarine system where initial post -larval development takes place. These areas are usually located in the uppermost sections of a system where populations are uniformly very early juveniles. The Division of Marine Fisheries is responsible for preserving, protecting and developing Primary Nursery Areas for commercially important fmfish and shellfish. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. PERMIT RE -OPENER: SUPPLEMENTARY NUTRIENT MONITORING/TMDL IMPLEMENTATION [NCGS 143-215.1 (b)] Pursuant to N.C. General Statutes Section 143-215.1 and the implementing rules found in the North Carolina Administrative Code at 15A NCAC 2H.0112 (b) (1) and 2H.0114 (a) and Part II sections B-12 and B-13 of this permit, the Director of DWQ may reopen this permit to require supplemental nutrient monitoring of the discharge. The purpose of the additional monitoring will be to support water quality modeling efforts within the Cape Fear River Basin and shall be consistent with a monitoring plan developed jointly by the Division and affected stakeholders. In addition, the results of water quality modeling may require that limits for total nitrogen and total phosphorus be imposed in this permit upon renewal. The Division may, upon written notification to the permittee, re -open this permit in order to incorporate or modify effluent limits, monitoring and reporting requirements, and other permit conditions when it deems such action is necessary to implement TMDL(s) approved by the USEPA. A. (6.) ELECTRONIC REPORTING OF DISCHARGE MONITORING REPORTS [NCGS 143-215.1 (b)] Federal regulations require electronic submittal of all discharge monitoring reports (DMRs) and program reports. The final NPDES Electronic Reporting Rule was adopted and became effective on December 21, 2015. NOTE: This special condition supplements or supersedes the following sections within Part II of this permit (Standard Conditions for NPDES Permits): • Section B. (11.) Signatory Requirements • Section D. (2.) Reporting • Section D. (6.) Records Retention • Section E. (5.) Monitoring Reports 1. Reporting Requirements [Supersedes Section D. (2.1 and Section E. Monitoring results obtained during the previous month(s) shall be summarized for each month and submitted electronically using eDMR. The eDMR system allows permitted Page 8 of 12 Permit NC0065480 facilities to enter monitoring data and submit DMRs electronically using the internet. Until such time that the state's eDMR application is compliant with EPA's Cross -Media Electronic Reporting Regulation (CROMERR), permittees will be required to submit all discharge monitoring data to the state electronically using eDMR and will be required to complete the eDMR submission by printing, signing, and submitting one signed original and a copy of the computer printed eDMR to the following address: NC DENR / Division of Water Resources / Water Quality Permitting Section ATTENTION: Central Files 1617 Mail Service Center Raleigh, North Carolina 27699-1617 If a permittee is unable to use the eDMR system due to a demonstrated hardship or due to the facility being physically located in an area where less than 10 percent of the households have broadband access, then a temporary waiver from the NPDES electronic reporting requirements may be granted and discharge monitoring data may be submitted on paper DMR forms (MR 1, 1.1, 2, 3) or alternative forms approved by the Director. Duplicate signed copies shall be submitted to the mailing address above. See "How to Request a Waiver from Electronic Reporting" section below. Regardless of the submission method, the first DMR is due on the last day of the month following the issuance of the permit or in the case of a new facility, on the last day of the month following the commencement of discharge. Starting on December 21, 2020, the permittee must electronically report the following compliance monitoring data and reports, when applicable: • Sewer Overflow/Bypass Event Reports; • Pretreatment Program Annual Reports; and • Clean Water Act (CWA) Section 316(b) Annual Reports. The permittee may seek an electronic reporting waiver from the Division (see "How to Request a Waiver from Electronic Reporting" section below). 2. Electronic Submissions In accordance with 40 CFR 122.41(1)(9), the permittee must identify the initial recipient at the time of each electronic submission. The permittee should use the EPA's website resources to identify the initial recipient for the electronic submission. Initial recipient of electronic NPDES information from NPDES-regulated facilities means the entity (EPA or the state authorized by EPA to implement the NPDES program) that is the designated entity for receiving electronic NPDES data [see 40 CFR 127.2(b)]. EPA plans to establish a website that will also link to the appropriate electronic reporting tool for each type of electronic submission and for each state. Instructions on how to access and use the appropriate electronic reporting tool will be available as well. Information on EPA's NPDES Electronic Reporting Rule is found at: http: / /www2.epa.gov / compliance / final-national-pollutant-discharge-elimination- system-npdes-electronic-reporting-rule. We had requested 2 compliance schedules to evaluate their current system hydraulically and clean & do repairs on it until they can replace the plant. We also asked for increased Ammonia and Bacti monitoring. • Joel Mingus for Aqua, "Aqua is interested in setting up a time to discuss a possible "voluntary consent" on the Beau Rivage WWTF until the new plant is online. The current plan is to break ground in the next few months, and have the entire plant on line by the end of Q2, 2018. Determined the SOC is not best option, since it is more for long-term projects. Explained the possibility of entering into a Compliance Agreement for a short-term period while the facility is undergoing construction, for the planned expansion to 0.2 MGD. Thanks for your comments regarding the Beau Rivage NPDES Permit renewal. Please move forward with the renewal with the following modifications and responses to your comments: 1. Aqua's growth plan for this plant has been modified. The next expansion will be to 0.20 MGD and not 0.30 MGD. Therefore please maintain the current limits identified in the existing NPDES permits that provides limits to 0.20 MGD. 2. Aqua does plan to upgrade and expand the plant flow to 0.500 MGD in the future and desires to keep this permit condition. 3. Aqua is currently providing an upgrade and expansion to the existing facility to increase treatment capacity from 0.10 MGD to 0.20 MGD. The new process will include the following additions a. New headworks consisting of screening and grit removal, with manual bar screen bypass b. Flow control box. c. Increased Flow EQ Volume with pumps d. Increased solids storage e. Two IFAS aerobic treatment trains f. Two Secondary clarifiers g. Required blowers for process air, flow eq and solids mixing, and clarifier scum and air lifts. h. New cloth media tertiary filters (not sand) i. UV disinfection j. Effluent flow meter Regarding item 3, please let us know how you wish to proceed. We plan to submit a new ATC application to the state on June 23, incorporating the items outlined above. These will need to be included in the permit, and if we issue the NPDES permit prior to then it will require a permit modification. Please provide us with a decision on which way you wish to incorporate the upgrade into the permit, i.e.; wait until June 23 to incorporate changes into permit renewal, or issue renewal now and Aqua to submit a permit modification later. Aqua desires to have the new conditions incorporated into our permit renewal as it reduces paper work. Thanks, Mike P. AQUA. Michael D. I doubt they will follow through with anything before Ron wants to "return" it. I don't know if there is a policy or statutory limit on the issuance or not. Only potential impact on issuance is if they have requested an removal of some of the expansion limits if they don't see the need to have them any longer since the CFPUA has really boxed in them in as far as a service area, but none of that is really tied to the A-to-C since you have nothing new to add to the permit as far as future treatment units. Aqua tends to spend pennies when they need to spend dollars whether it be on O&M or replacement, thus no idea what they will do from here or when. They already had an A-to-C from 2006 for expansion to 200K, but never moved on it so they are in a real pickle now due to structural issues and hydraulic flow at 89.8% of design capacity for 2016 (may be placed on a sewer moratorium) which probably the key factor in the numerous violations with many assessed fines over the past 2 years and complicated by a single -train treatment system. They recently installed only 2 of 4 components of an upgrade at their Cape facility and promise rest will happen next fiscal year for them — we will see. The lower TSS limit is based on the Red Book limits for receiving stream classification. PNA— Primary Nursery Area which is a HQW (high quality water) water type. Expansion and/or WWTP replacement will not only require the A-t-C, but erosion control, maybe DWR/Corps approval for wetlands, and maybe CAMA if within their AEC (area of environmental concern) like new or modified outfall pipe. Dean, I received the A to C application package 1/31/17 and was not able to review it until today. As you stated there are two Phases listed in the 1/31/17 A to C application. Phase I is to install a complete new MBR based treatment facility with UV, repurpose the aeration basin for EQ, and expand to 0.2 MGD. Phase II is for a further expansion of the MBR facility to 0.3 MGD. The current NPDES permit lists an expansion page for 0.2 MGD and an existing active A to C issued in 2006 (065480A01) for expansion to 0.2 MGD involving upgrades/new components to the existing aeration based system, addition of EQ and tertiary filters, new UV system. Also, the current NPDES permit list the approval for expansion up to 0.5 MGD along with citing that an A to C approval will be required. The NPDES permit expired in Dec 2016, and the renewal application is in house but has no request to add an expansion page for 0.3 MGD. 1 Hey Ron, I saw this in Jim's box this morning. This is very much needed and has been for some time as they never moved forward with the previous approval from 3-30-2006. I noticed that a RO staff report request event was added or updated on that old one in BIMS, but not sure why. A couple of things that we have been trying to get resolved in the permit — with last renewal and should be now again is that this discharges to a PNA which has tighter limits on TSS. Cary, NC 27511 Mr. Thompson: The Division received your Authorization to Construct (A to C) application on January 31, 2017 for the Beau Rivage Plantation WWTP NC0065480, requesting approval to construct a new treatment facility to expand to a Phase I flow of 0.2 MGD and to a Phase II flow of 0.3 MGD. Currently, there is an active A to C 65480A01 issued in 2006 to expand to 0.2 MGD that is no longer valid as the original facility's proposed components and applied technology have changed. Therefore, a corrected A to C 065480A01 will be developed and issued for Phase I based on your January 31, 2017 application and Division approval. 1 To address the Phase II expansion, you need to submit a written request to the Division's NPDES Compliance/Expedite Permitting Unit requesting a limitation page be added to the NPDES permit NC0065480 for a permitted flow of 0.3 MGD. Once requested, this will be incorporated into the NPDES permit as part of the current renewal process. A new A to C 065480A04 will be developed and issued for Phase II based on your January 31, 2017 application and Division approval. As the Division continues to review your application and support documentation, it will contact your representative, Deihl & Phillips, P.A., if additional information is needed. At this point, the actions needed for A to C are: 1 1) Inform the Permittee he must submit a letter to the Division requesting addition of a 0.3 MGD limitation page as part of the NPDES renewal application. 2) Send email acknowledgement to the Permittee for the receipt of the A to C application, including notification that the active 065480A01 as issued is invalid as a different technology is being proposed, and a new corrected 065480A01 A to C approval will be required reflecting Phase I expansion to 0.2 MGD. Also, a new A to C 065480A04 will be developed for the expansion to 0.3 MGD. 3) I will contact the consultant and confirm Phase I will met 10/15 mg/L TSS limits. In regards to BIMS: 1) I had updated BIMS Events for 065480A01 "RO staff report requested" as an indicator/tracking method showing the regional office is being notified of the 1/31/17 A to C via copies of the application and acknowledgement so the regional office can responded if desired (acknowledgement not sent yet). 2) Added new item to BIM IS Events for 065480A01, "Additional information received" to insert commentary on the current active A to C being re-issued/corrected based on the 1/31/17 application. 3) Activated new A to C 065480A04 in BIMS. As far as changing the existing 0.2 MGD TSS effluent limits to 10/15mg/L you need to coordinate that with John Hennessy so he can inform Brianna Young. Any other deletion or modifications to the NPDES permit are up to whatever the Permittee request and the Divisions will approve. COASTAL REGION RESIDUALS PLAN Sludge hauling from the Coastal WWTPs is handled through an agreement with Lewis Farms and Liquid Waste Inc. During normal operation, waste solids are wasted to the solids holding tank to be thickened by settling & decanting. Thickened sludge is tested to determine when it reaches approximately 2% solids content before hauling. Class B residuals generated by Aqua's Coastal Plants are picked up Lewis Farms and hauled for a land application as referenced in Permit No. WQ0000455. In accordance with Section IV Monitoring and Reporting Requirements of this permit, Lewis Farms is responsible for analyses of corrosivity, ignitability, reactivity, and toxicity characteristic leaching procedure (TCLP) at the frequency specified. Lewis Farms shall maintain these results for a minimum of five years. Attached to this plan is the Operation and Maintenance Plan as submitted by Lewis Farms and Liquid Waste Inc. . LEWIS FARMS AND LIQUID WASTE, INC. BIOSOLIDS OPERATIONS AND MAINTENANCE PLAN I. Purpose To put into place a plan that implements the requirements of North Carolina Department of Environment and Natural Resources — Division of Water Quality (NCDENR-DWQ) Permit # WQ0000455 for Lewis Farms and Liquid Waste, Inc. (Lewis Farms). Requirements are included for the industrial and municipal biosolid sources (WWTP's) and Lewis Farms (land application contractor). All biosolid sources are listed within the permit. II. Operational Functions The operational functions of this program involve hauling biosolids from the respective WWTP's to the land application sites currently permitted under Permit # WQ0000455 and land applying the biosolids in accordance with regulatory requirements. Residuals will be land applied at or below agronomic rates that are determined using the Realistic Yield Expectations (RYE) as outlined in the permit. Lewis Farms will also account for any nutrient sources the landowner/lessee has applied. Some sources will be land applied as a liquid material utilizing either pumper trucks, vacuum trucks, tractor and pull tank, and/or a traveling reel system. Some sources will be land applied as a cake material utilizing a tractor and box spreader. In some instances, biosolids may have to be injected or surface applied with incorporation depending upon the pathogen and vector attraction reduction methods employed by the respective WWTP. Whichever method is utilized to land apply the biosolids, Lewis Farms will spread evenly and at consistent rates. Biosolids will be land applied on fields that are used for hay production, grazing, or harvested for animal feed. In the case where biosolids are land applied on fields utilized for grazing, applications rates will be reduced by 25% in accordance with USDA-NRCS 590 Nutrient Management Standards. Grazed fields will be determined by Lewis Farms Operations Manager on site. III. Maintenance Schedules Lewis Farms will follow the maintenance schedule as recommended by the manufacturer for the equipment utilized to complete the job within the limits of the permit. IV. Safety Measures Lewis Farms takes pride in operating a safety conscious manner. Employees participate in regular safety training that is designed to help employees recognize safety issues and take steps to prevent potential accidents from occurring. Lewis Farms employees have the authority to stop operations if they think any aspect of the operation is going to lead to the cause of an environmental or personal accident. Shared/WMSS Projects/2015/15-20 Lewis Farms/O&M Plan 7-5-16 1 LEWIS FARMS AND LIQUID WASTE, INC. BIOSOLIDS OPERATIONS AND MAINTENANCE PLAN V. Spill Response Plan • Halt the source of the spill: Such as a ruptured line or valve, or damaged transportation unit. • Contain spill: Use straw bales to form a barrier. Straw or hay bales can be obtained from several sources for this purpose. Soil near the site can also be used to form a barrier for containment. • Clean up: Use biosolids application equipment to recover as much of the material as possible. After the application equipment has recovered as much material as possible, it will be land applied as per the management plan. A temporary sump pit may be dug in the containment area and spilled material washed into it to enhance recovery. • Final Clean up: The ultimate goal will be to restore the spill area to its original condition if possible. • Notification: As soon as possible after a spill occurs notify: • Lewis Farms — Wesley Wooten (910) 604-0049 Cell (910) 283-5444 Office • WMSS, PLLC — Martin Mabe • Department of Environmental Quality Division of Water Resources Wilmington Regional Office (336) 312-1396 Cell (910) 796-7215 Office • Fire Department if assistance is required for wash down • Management of clean-up efforts: The field superintendent shall take immediate charge of the clean-up activities. Additional labor will be requested from Lewis Farms as needed. VI. Reporting: Within 24 hours of a spill the field superintendent shall present a written report detailing the cause of the spill and all action taken in response to the spill. Lewis Farms will notify the Wilmington regional office as soon as possible, but not more than 24 hours after, or on the next working day following the occurrence VII. Inspection Plan Inspections for the land application of biosolids will be conducted at a minimum of a weekly at the land application site during land application events. Inspections will consist of inspecting the current field(s) that are being applied on as well as inspecting random fields that have previously received biosolids applications. Inspections will be performed by Lewis Farms personnel on a rotational basis to ensure that all employees are familiar with the inspection processes. At a minimum, these inspections will consist of the following: Shared/WMSS Projects/2015/15-20 Lewis Farms/O&M Plan 7-5-16 2 LEWIS FARMS AND LIQUID WASTE, INC. BIOSOLIDS OPERATIONS AND MAINTENANCE PLAN • Verify that a residuals analysis has been collected prior to land application activities being performed and that it meets the criteria for land application. • Verify that pathogen and vector attraction reduction data has been collected for the source to be land applied and that it meets the criteria for land application. • Verify the crop that is planted or is to be planted on the respective field(s). • Confirm that the correct amount of biosolids are being land applied. • Confirm that manned equipment has a copy of the permit and the operations and maintenance plan. • Check that the field has been properly flagged and that buffers are adhered to. • Check that proper signage is posted. • Confirm that records are turned in at the end of each business day. Inspections will also be conducted by the respective employees of the biosolids generating facilities (at the source generating facility). Lewis Farms is not responsible for inspections at the source generating facilities. These inspections should be conducted by the respective ORC of each facility and should fall under their own Operations and Maintenance Plans. VIII. Sampling and Monitoring Plan • Sampling for this project consists of sampling the soils of the fields in the respective permit in order to document that the fields are suitable for land application. • Biosolids samples are to be collected by the ORC at the respective source generating facility. This may include nutrient and metal, pathogen, vector attraction reduction, and TCLP samples. Samples should be provided to Lewis Farms prior to any land application activities being performed in order to verify that samples meet regulatory requirements set forth in the permit. Samples should be collected at the frequency specified in permit # WQ0000455. • Lewis Farms may perform alkaline stabilization of biosolids at some of the respective source generating facilities. However, it the responsibility of the ORC at each facility to provide documentation of times, temperatures, and pH of the biosolids for the lime stabilization events. Each ORC at the respective source generating facility must be certified by the NCDEQ-Lab Certification Unit before collecting this data. Lewis Farms only provides the alkaline stabilization materials and personnel to perform this operation and is not responsible for the documentation that the biosolids have passed the alkaline stabilization process.
