This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Concerning Ocean Forest and the recommendation to revoke the permit, as I indicated to you over the phone, I did not think we were able to do this. Aqua is looking to regionalize one of their facilities and intends to then request rescission of the Ocean Forest permit. However, we are not sure they we be allowed to expand their facility (the Cape WWTP) due to some TMDL and impaired water issues. If this happens to be the case, then they will probably move forward with building the plant at Ocean Forest. With regards to Beau Rivage Plantation, the limits issued is based on numbers that are derived from a model used to determine allowable parameter limits. We do not tighten limits even if we know the facility can meet the lower limit. Once the facility expands, they will then be required to meet the lower effluent limits for ammonia nitrogen. Other Special Items: None PART IV - EVALUATION AND RECOMMENDATIONS This facility generally produces a quality effluent within permit limitations, but over the last year has experienced periods of high inflow from storm events. The average flow has been approximately 0.04 MGD. During heavy rain events the flow has increased to 0.08 MGD suggesting problems with I and I. The facility will be expanded to 0.20 MGD as a two phase upgrade. Phase II involves an upgrade to 0.50 MGD. Upgrades to 0.5 MGD will not affect the classification of the facility as nutrient removal will not be included in the permit limitations. The EAA provided by Aqua North Carolina indicated no alternatives to building the upgraded facility. According to the Cape Fear River Basinwide Water Quality Plan, the Cape Fear River within this segment is impaired for aquatic life due to low DO. The pH was also below the standard. Beau Rivage Plantation WWTP discharge is to class SC waters. It is recommended that the monthly average ammonia limits of 2.0 and 4.0 mg/L for summer and winter and daily maximum ammonia limits of 10.0 and 20.0 mg/L for summer and winter be included in the permit page for 0.10 MGD flow, rather than 20 mg/L monthly average and 35 mg/L daily maximum. A review of the DMRs for the past several indicates the facility has demonstrated the ability to treat ammonia to meet the more stringent effluent limits. All monitoring frequencies appear to be in accordance with 15A NCAC 2B.0500 or no less stringent than the previous permit. If no significant adverse public comment is received, WiRO recommends the permit be reissued to Aqua North Carolina (Beau Rivage Plantation WWTP (NC0065480)) in accordance with the Basinwide Plan strategy for the Cape Fear River. .o. Bidding the project took sometime because initial bids came back much higher than we expected. We rebidd the project and got much better results the second time. Presently, we are gearing up to start construction within the next month. Unfortunately, it looks like we will need the 0.1 MGD permit page for at least awhile longer. If not, I will leave this language and tier within the renewal. Let me know at your earliest.
