In accordance with the application for a discharge permit received January 3, 1996, the Division is
forwarding herewith the subject NPDES permit. This permit is issued pursuant to the requirements of
North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina
and the US Environmental Protection Agency dated December 6, 1983.
Within 180 days after issuance of this permit, the permittee shall comply with regulation 2H .0124
(2) which requires the permittee to provide stanby power on facility site.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this letter. This request must be in the form of a written petition, conforming to
Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative
Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such demand is
made. this decision shall be final and binding.
Please take notice this permit is not transferable. Part II, E.4. addresses the requirements to be
followed in case of change in ownership or control of this discharge.
This permit does not affect the legal requirements to obtain other permits which may be required by
the Division of Environmental Management or permits required by the Division of Land Resources,
Coastal Area Management Act or any other Federal or Local govemmental permit that may be required.

The permit shall become effective July 1, 1996
This permit and the authorization to discharge shall expire at midnight on June 30 2001.

SUPPLEMENT TO PERMIT COVER SHEET
Mr. Eddie Lewis
is hereby authorized to:
1. Continue to operate a 0.10 MGD dual extended aeration package plant which consists of a bar
screen, aerated sludge holding tank, tablet type chlorine contact tank and flow meter located at
Beau Rivage Development, 6230 Carolina Beach Road, Wilmington , New Hanover County (See
Part III of this Permit), and
2. After receiving an Authorization to Construct from the Division of Environmental Management,
upgrade the existing facility to not exceed 0.500 MGD (See Part III of this permit), and
3. Discharge from said treatment works at the location specified on the attached map into Cape Fear
River which is classified Class SC waters in the Cape Fear River Basin.

This is a permit renewal for an existing class II facility. Flow conditions for this facility are tidal.
This facility was previously issued for a flow of 0.500 MGD with an A to C for only 0.100 MGD. Permits
and Engineering is recommending that this permit be issued with existing secondary limits at 0.100
MGD. Given the low levels of dissolved oxygen in this area, any "unbuilt" flow will be given limits of
technology for oxygen -consuming waste. In this instance, the 0.5 MGD phase of the project will be
limited at 5 mg/1 (BOD-Summer) and 2.0 mg/1 (NH3-Summer). Also, a TRC limit of 28.0 mg/1 will be
given at this flow. For the design flow of 0.100 MGD, an ammonia limit of 20.0 mg/1 has been
recommended by the regional office. This plant has been in compliance with limitations with the
exception of two TSS violations within the past twenty four months. The ammonia toxicity is of some
concern here because they were in the range of 1.0 mg/1 to 30.0 mg/1 within the past twenty four months.
According to the region, sludge disposal should remain as a condition along with the reliability
condition requiring standby power.

5. Other Special Items: There is no standby power supply
available. It is recommended a permit condition be included
to require the Permittee to satisfy plant reliability criteria
under 2H .0124 (2) .
PART IV - EVALUATION AND RECOMMENDATIONS
Average flows at Beau Rivage are 0.014 MGD because of
construction of approximately 150 out of a proposed 1200
units. It is due to the proposed number of units to be built
that the current limit of 0.5 MGD is recommended be kept for
the new permit. A letter justifying need for the 0.5 MGD has
been requested from the Permittee.
The plant is generally is good mechanical condition and has
met existing permit limits over the past year with one
exception of TSS. However, NH3-N has been steadily increasing
and is currently running close to 30 mg/l. It is therefore
recommended an NH3-N limit of 20 mg/1 (20x4 + 30BOD = 110 UOD)
be placed in the permit. The limit will provide justification
for repairing potential aeration deficiencies and require
improved sludge management.
It is recommended that a draft permit be prepared and placed
at public notice. If no significant adverse public comment is
received, it is recommended NPDES Permit No. NC0065480 be
reissued to Mr. Eddie Lewis in accordance with the Cape Fear
River basin -wide permitting strategy.
