PROJECT DESCRIPTION: Mill Creek is a tidal creek located in Pender County, west of the Atlantic Intracoastal Waterway (AIWW) and north of Futch Creek. It is adjacent to four residential subdivisions: Long Point Estates, Washington Acres, Deerfield, and Water's Edge at Deerfield. The project site consists of Horn Creek, Deep Bottom Branch, and several manmade canals, which connect via Mill Creek to the AIWW. To access Long Point Estates Canal from Wilmington, take US Hwy 17 N. Travel approximately 11 miles to Washington Acres Road. Turn right onto Washington Acres Road and travel approximately 1.6 miles to Hughes Road. Turn left onto Hughes Road and travel approximately 0.1 miles to the Washington Acres community boat ramp located on the right. The applicant states that the entire creek and canal system had been dredged between 1959 and 1970 with the exception of Deerfield Creek and a section of Horn Creek (neither of which are within the scope of this project). The adjacent highground is zoned residential, and a majority of the homesites in the project area have already been developed. Many properties also have existing boat docks. Approximately 120 homeowners have deeded access to the aforementioned Washington Acres community boat ramp located on the southernmost canal. A second boat ramp is located on the adjacent property, which is privately owned. This canal is referred to as the Long Point Estates canal (Site #7) in the permit application and measures approximately 1,270 feet in length and ranges from 20' to 160' feet in width. (Please refer to "Map #B" for an overview of site numbers and their location.) Current water depths range from -0.3 to -6.7 feet at Mean Low Water (MLW). There are 5 existing docks within the canal. Grady Scott Canal (Site #8) is located off of Long Point Estates Canal and measures approximately 370' in length by an average 60' in width from marsh to marsh. A bulkhead extends nearly the entire length of its northwestern bank. Current water depths within the channel range from +2' to -2.5' at MLW. There are currently 3 private docks on this canal. Traveling north from Long Point Estates canal, Mill Creek (Sites #6A, B and C) runs in a northwesterly direction. The channel generally runs on the western side of the creek. Current water depths along the creek's channel average approximately ~.5' at MLW. The applicant states that shoaling has recently occurred at three locations along the channel where water depths range from -1.2' to --4.5' at MLW. Battery Lane Inlet (Site #9A) is the next canal off Mill Creek when traveling north. The entire length of the canal measures approximately 1,500 feet in length and averages 60' in width. Current water depths range from -0.4' to -2.8' at MLW. There are currently 18 private docks on this canal. A side channel also exists midway along the canal (Site #9B, see Attachment #12). Depths within the side canal currently range from +1.8' to - 0.2' at MLW. Short Circle Inlet Drive (Site #5) is a small manmade canal located off Mill Creek, north of Battery Lane Inlet. This canal measures approximately 479 feet in length and ranges from 140 feet in width at the mouth, to an approximate width of 30' at its terminus. There are 5 docks on the canal and current depths range from -0.5 to -2.4' at MLW. Horn Creek (Sites #3A-3C and Site #4) is located north of Short Circle Inlet Drive. It consists of a main channel, measuring approximately 2,700 feet in length and averages approximately 100' in width. A side channel (Site #3B), situated near the mouth of the canal, runs south of a marsh island. It is currently elevated above the MLW contour. An "extension" of Horne Creek runs west of the main canal. Excavation was originally proposed within the extension (as Site #4, shown on Sheet 1 of 5), but the request was withdrawn from this permit application. Water's Edge (Site #2) branches off Mill Creek to the north, measures 868' in length, varies from 60' to 130' in width, and ranges in depth from -0.5' to -4.2' at MLW. There are 5 private docks and 2 community docks, serving Water's Edge at Deerfield, along this creek. Deerfield Creek branches off to the east, but has not been previously dredged, and is therefore not included in the scope of this project. Deep Water Branch (Site #1) would be the northernmost excavation site and is located due north of Water's Edge. It measures approximately 870' in length and 60-135' in width. Current water depths range from +0.7' to -2.0' in depth. There are 5 existing docks on this canal. The applicant had also proposed to include the Inlet channel from the AIWW (Site #10) in the scope of this project, but it was recently dredged to -4' MLW in September 2006 and is not requiring excavation at this time. Accordingly, it is no longer included in this application. There are four known permits previously issued for dredging within the project area. State Permit # 111-90 was issued to Mr. & Mrs. J.H. Turner and Mrs. Effie Roos on August 8, 1990 for maintenance excavation of the manmade canal labeled in this application as Battery Lane Inlet (Site #9A) The permit authorized the dredging of a portion of the canal measuring 460' in length by 30' in width and to a final project depth of -3.5' at MLW. The permit expired on December 31, 1993. State Permit #12-02 was then issued to Darby Frank, Dudley Malpass & Jonathan Earle on February 1, 2002 for maintenance dredging of the same canal. The permitted dimensions of excavation measured 320'' in length, 28' in width and a final project depth of =-4' at MLW. The permit was transferred to Mark & Kim Clements on March 8, 2005 and expired on December 31, 2005. State permit # 143-88 was issued to Raymond Hughes on July 22, 1988 for the maintenance excavation of a channel within Long Point Estates Canal (Site #7) measuring 400' in length by 40' in width and to a final project depth of -4' at MLW. It expired on December 31, 1991. No documentation has been submitted to substantiate previous permitted excavation in the other canals, however, these canals do appear to be man-made. Highground vegetation in the vicinity of the project area is primarily composed of lawn grasses, oak (Quercus spp.) and ornamental plants. Wetland vegetation consists of: Common Reed (Phragmites australis), Sea Oxeye (Borrichia frutescens,) Grounsel-bush (Baccharus halimifolia), Spike Grass (Distichlis spicata), Glasswort (Salicornia spp.), Sea Lavender (Limonium sp. ), Salt Meadow Grass (Spartina patens) and Smooth Cordgrass (Spartina alterniflora). This area has been classified by the Division of Marine Fisheries as Secondary Nursery Area. The proposed spoil site is located approximately 1 % miles north of Mill Creek. It is a privately owned island identified as "AIW_U_0205" on USACE Map # "sawgis-06-124". A signed agreement with the property owners has been submitted in the application package. A Notification of Jurisdictional Determination from the USACE has also been submitted for the site. It falls within the USACE "Right of Way" and therefore also requires their approval. The applicant states a consent agreement has been submitted to the U.S. Army Corps of Engineers, the approval of which is currently pending approval for the use of the spoil island. The 404 wetlands were flagged by a consultant and were verified by Brad Shaver of the USACE. The waters of the AIWW adjacent to the project site are classified as SA by the North Carolina Division of Water Quality. They are NOT designated as a Primary Nursery Area (PNA) by the North Carolina Division of Marine Fisheries, and they are CLOSED to the harvest of shellfish. The waters of the AIWW adjacent to the spoil site are also classified as SA by the North Carolina Division of Water Quality. They are ARE designated as a Primary Nursery Area (PNA) by the North Carolina Division of Marine Fisheries, and they are OPEN to the harvest of shellfish. PROPOSED PROJECT: The applicant is proposing maintenance dredging at 14 sites to promote tidal flushing and facilitate navigation. All channels would be excavated to a final project depth of -4' at MLW and a width of 20 to 30 feet. Additional excavation is also proposed to access docks from the channels at a width of 25 feet with an average estimated length of 11 feet (actual lengths range from 0-80'). The total combined length of the excavation within Mill Creek and its tributaries would be approximately 8,458 linear feet. The entire proposed dredge area is shown as gray-hatched areas on the plans. Please refer to the table attached to Form DCM MP-2 for the total proposed dimensions of excavation to be performed with estimated volumes of excavated material. The plans and applicant's narrative states that all excavation would be performed a minimum distance of 10' from the coastal wetlands to the excavated channel. The excavation would be performed using a hydraulic dredge and the spoil would be placed on USACE DA 205, which is privately owned. The spoil site would be located on the western end of the island. The application states 1,7501inear feet of levees will be constructed on the disposal site to an elevation of +15' NGVD and with an internal elevation of +5 feet NGVD (resulting in a dike height of approximately 10 feet). It is estimated that the dike-enclosed area will have a spoil capacity of approximately 33,000 cubic yards. The spoil site dimensions would measure 505' in length by 595' in width (6.9 acres). The excavated volume for all sites would total an estimated 27, 019 cubic yards. The plans show a maximum fill elevation of +11' NGVD and maximum water level of +13' NGVD. (Please note that the spoil site plans labeled DA1-5 of 5 are at half scale.) Silt fence would be installed at the waterward base of the dike structure, landward of the wetland line. The spillway would be constructed on the west side of the disposal area and would discharge the clear water to OPEN shellfish waters. The applicant states a consent agreement has been submitted to the U.S. Army Corps of Engineers, the approval of which is currently pending approval for the use of the spoil island. 10. ANTICIPATED IMPACTS The excavation of the 14 sites would disturb approximately 225,700 ft.z (5.18 acres) of shallow bottom. The dredging operation would likely result in a temporary increase in turbidity. The spoil disposal would result in approximately 300,475 square feet (6.9 acres) of highground disturbance. Provided the project is timed to avoid periods of peak biological activity, no long-term adverse impacts are anticipated from the dredging activity. MILL CREEK DREDGING-PHASE 2 (Revised July 26 2007) (iF,NF,RAi, Mill Creek Waterway Restoration Inc. is seeking approval to dredge the extremely important natural resource area known as Mill Creek located in Pender County starting in the Fall of 2007. Mill Creek is located west of the AIWW, north of Futch Creek in New Hanover County and south of Nixon Creek in Pender County. This estuarine waterway complex comprises over 1 %2 miles of navigable channels consisting of three watershed creeks, four inlets and two boat ramps. Navigational access to and from the AIWW is via a dredged channel at the southern end of the mouth of the Creek. The location and configuration of the Creek complex is shown on MAP "A" attached. The Mill. Creek community consists of four residential subdivisions- Long Point Estates, Washington Acres, Deerfield, and Water's Edge at Deerfield in Hampstead. The configuration is shown on the attached MAP "A" and in perspective in the attached aerial photographs # 1 thru 4. There are approximately 89 single-family home lots with docks along Mill Creek with another 241ots with access to the water not yet developed. Nine of these lots in Water's Edge at Deerfield have recently completed docks. Furthermore, property owners within Washington Acres subdivision have rights to use the community boat launch ramp. An estimated 124 additional property owners, most boaters, have rights to use the ramp. Thus, 77% of the available home sites along Mill Creek are currently developed and another nine are being developed. Most of the homes on Mill Creek have boat docks. Several commercial fishermen use the inlet to access the Intracoastal Waterway and two commercial crabbers crab in the Creek. The Creek also contains oyster beds; however, harvesting is currently prohibited. The Creek is classified as a "secondary nursery area." PREVIOUS DREDGING The Inlet Channel was dredged -Mill Creek Dredging Phase 1 -September 2006- to restore low-tide navigation (- 4' MLW) to and from the AIWW. The inland portion of the largest of the three inlets (Battery Lane/ Circle Drive) was also dredged in 2005/6. The other inlets were last dredged in 1995. With the exception of Deerfield Creek, the remainder of the Mill Creek complex, including the two watershed creeks Horn Creek and Deep Water Branch, was previously dredged over the period 1959 to 1970. ( Deerfield Creek has never been dredged and is not included in the scope of thi s CAMA major permit application.) ~ ~ {-%~ i ~ ~ ~.. t~CM WILluIiNG~'C~1~1. N~_. J~1~. 2 ~ 2 0~1 PROPOSED DREDGING -PHASE 2 -continued The surveys showing the currently proposed dredged channel templates & locations are drawn on the attached maps Sheets # 1 thru 5 and the attached sketch (Attachment # 12) showing the proposed side channel off Battery Lane Inlet. On Sheet #l, Site #4, Horn Creek Extension has been withdrawn from the scope of this permit application at this time together with the Inlet Channel off the AIWW dredged in 2006 and shown on Sheet #2. The precise location of each channel (its width and routing) will need to be adjusted at the time of the Project taking into account variation over time with the location of marsh grass. Additionally, along each channel, the amount of dredging material to be removed may vary due to the shifting nature of the bottom. The target project depth is -4'MLW These depths are reflected in the estimated excavation volumes summarized in the foregoing table totaling 24709 cubic yards. The precise location of dredging within the prescribed channel to realize project depth may vary as bottom conditions change. Each Survey Map carries the designation that no dredging may be performed within 10' of the marsh grass and this will again be reiterated in the Dredging Contracts. The proposed dredging will remove the run-off silt that has settled in the various sections. This material impedes boating access and navigation. Dredging also has the potential to enhance the quality of the water and aquatic eco-systems through improved tidal flushing and silt removal. REGULATORY PERMITS. The North Carolina Department of Environmental and Natural Resources (NCDENR)- Coastal Area Management Division has stipulated that the Mill Creek complex is not subject to the NC Environmental Protection Act, and both it, and the Division of Marine Fisheries, following site inspection and a review of documentation in several "pre-application" meetings, have agreed that the proposed dredging will be classified as "maintenance", thus paving the way for this application fora CAMA Major Maintenance Dredging Permit. Assuming this application is approved, and so as to not delay any further the current application, it will be our intention to apply for subsequent alteration to the scope of the permit to allow us to plan the future dredging of the Horn Creek Extension and the natural area between the two sections of Horn Creek. SPOIL DISPOSAL The project dredging plan calls for hydraulic dredged material to be pumped from the Mill Creek dredge sites to a spoil island located approximately 1 %2 miles north of Mill Creek on the ocean side of the AIWW in Section 3 Tangent 8. This spoil island is designated "AIW U_0205" on USACE Map # "sawgis-06-124" dated 12/11/2006. iN~l.,C1VCt...~ JCP~~ WILM-NGTON, NC JUL ~ 7 Z~~J7 The proposed spoil site is privately owned (Pender Co. Pin # 3292-82-6560-0000) and permission has been obtained from the owners to build and use a spoil disposal site in the form of a "Permit and Easement for Disposition of Dredging Spoils" dated March 28 2007(Copy furnished to CAMA) SPOIL DISPOSAL- continued The proposed spoil site falls within the AIWW "Right of Way" requiring a "Consent Agreement "from USAGE for which an application is being made concurrent with this application. CAMA has inspected the proposed site and flagged coastal wetlands. 404 wetland delineation has also been flagged by a coastal biologist and surveyed. USACE have inspected the site and issued an "Approved Determination" for the entire 7.5 acre site.(Copy furnished to CAMA) The dike-enclosed disposal site (dikes, spillway, etc) has been designed to meet USACE /CAMA guidelines. It will be enclosed by approximately 17501inear feet of levees to a height of +15' NGVD with an internal depth of 10 feet providing a spoil capacity of at least 33000 CY requiring an area of 6.9 acres(595' X 505') including the levees. The dredging plan estimate of 24709 CY is thus well within this design capacity. EXPECTED BENEFITS 1) Restoration of small craft navigation at all states of tide for improved recreational access to this beautiful natural resource. 2) Has the potential to improve.water quality in all sections of the Mill Creek waterway complex due to increased tidal flow. After a heavy rain that muddies the creeks, larger flushing volumes should allow quicker dissipation of the silt run off from upstream. 3) Has the potential to increase sea life activity (more dolphins, otters, schools of small fin-fish and increased fish and shrimp populations. 4) Has the potential to increase the population of crabs for commercial and recreational users, 5) Safer passage by all users, local and regional, recreational and commercial. PROJECT JUSTIFICATION Mill Creek Waterway Restoration Inc. is a NC non-profit corporation, which, with the support of the Mill Creek Community and its various Home Owners Associations', as well as Pender Watch and Conservancy, is committed to preserving, maintaining, and improving the water quality of the waterways within the Mill Creek estuary for the continued use of the waterway complex for recreational, environmental, and economic purposes. Furthermore, it is safeguarding and perpetuating the biological, economic and aesthetic value. Its goals are also consistent with the objectives of the US Army Corps of Engineers proposed 206 Restoration Project for Mill Creek currently on hold due to lack of Federal funds. The construction of the proposed new spoil disposal site along the AIWW is justified because there are presently no viable alternatives to dispose of dredging spoil. USACE will not allow tidal creek dredged material to be mixed with beach renourishment sand presently inventoried at existing USAGE soil sites (e.g. those at the; old Topsail Channel and Green Channel) Furthermore, there do not appear ~,Q ECn~ ~ ~ ~ i~CM ~11LMINC,:TQOV, N~ JUG ~ 7 ~~Q7 available shore sites between Surf City and Wrightsville Beach where a dike enclosure (requiring unpopular clear cutting for hydraulic dredging) might be built. Indeed, there appear to be few, if any, areas remaining where mechanically dredged material might be brought ashore and drained prior to being hauled inland as fill. FUTURE DREDGING Armed with this renewable Major Maintenance permit, MCWR Inc. will periodically maintain project depths in all areas of the Mill Creek complex covered by this permit scope.
