Subject: History of Notifications of Deficiencies in the Operation of the Kinnakeet
Shores Wastewater Treatment Plant.
Dear Mr. Tankard,
Under the North Carolina Public Records Law, G.S. §132-1., I am requesting an opportunity
to inspect or obtain copies of public records that identify all persons or entities that received
notification of deficiencies in the Kinnakeet Shores' Wastewater Treatment Plant (WWTP) since
January 1, 2017. This plant is owned and operated by Ray E. Hollowell, Outer Banks Kinnakeet
Associates, LLC. More specifically, these records should include notifications sent to Ray E,
Hollowell, Jr.; the Greater Kinnakeet Shores Homeowners, Inc.; Kinakeet Shores 16, LLC;
Coldwell Banker Seaside Realty Kill Devil Hills; and Bradley N. Beacham.
If there are any fees for searching or copying these records, please inform me if the cost will
exceed $200. However, I would also like to request a waiver of all fees in that the disclosure of
the requested information is in the public interest and will contribute significantly to the public's
understanding of the evolution and history of the sewer moratorium that was imposed on the
WWTP on October 13, 2021. This information is not being sought for commercial purposes. My
wife, Louise and 1. are the owners of Lot 30, Phase 16, Kinnakeet Shores Subdivision„and the
moratorium is preventing us from moving forward with plans to build our retirement home or
alternatively, from selling the property at a market value that existed prior to the imposition of
the moratorium.
The law requires that you respond to and fulfill this request "as promptly as possible." If you
expect a significant delay in responding to and fulfilling this request, please contact me with
information about when I might expect copies or the ability to inspect the requested records.
If you deny any or all of this request, please cite each specific exemption you feel justifies the
refusal to release the information and notify me of the appeal procedures available to me under
the law.
