Dear Mr. O'Neal:
On July 13, 2005, the Division of Water Quality (DWQ) issued a 401 Water Quality Certification to
place fill within or otherwise impact 0.3006 acres of wetlands for the purpose of constructing Moss
Creek Village Phases 3 and 4, as described within your application dated April 19, 2005.
In order to meet Condition 6 of the 401 Certification for this project, a stormwater management plan for
this project was received by the DWQ on March 28, 2007. A revised stormwater management plan was
received by the DWQ on J my ~, 20U7. This revised stormwater management plait lias been reviewed alit(
satisfies the stormwater management conditions of the 401 Water Quality Certification.
The structural stormwater practices as approved by DWQ as well as drainage patterns must be
maintained in perpetuity. No changes to the structl-tral stoi~nwater practices shall be made
without written authorization from the DWQ. Storn~water easements shall be recorded for a
distance of at least 10 feet on each side of all storm water conveyances on all lots containing
these structures including future access for maintenance. The stormwater easements shall allow
for the ability to maintain the structures, perform corrective actions as described above and shall
provide protection of the structures fi•om potential alternations by future property owners.
This letter completes the review of the DWQ under Section 401 of the Clean Water Act. If you
