DEED RESTRICTIONS AND PROTECTIVE COVENANTS For all subdivisions, outparcels, and future development, the appropriate property restrictions and protective covenants are required to be recorded prior to the sale of any lot. If lot sizes vary significantly or the proposed BUA allocations vary, a table listing each lot number, lot size, and the allowable built -upon area must be provided as an attachment to the completed and notarized deed restriction form. The appropriate deed restrictions and protective covenants forms can be downloaded from http://h2o.enr.state.nc.us/su/bml2 forms htm#deed restrictions. Download the latest versions for each submittal. In the instances where the applicant is different than the property owner, it is the responsibility of the property owner to sign the deed restrictions and protective covenants form while the applicant is responsible for ensuring that the deed restrictions are recorded. By the notarized signature(s) below, the permit holder(s) certify that the recorded property restrictions and protective covenants for this project, if required, shall include all the items required in the permit and listed on the forms available on the website, that the covenants will be binding on all parties and persons claiming under them, that they will run with the land, that the required covenants cannot be changed or deleted without concurrence from the NC DWQ, and that they will be recorded prior to the sale of any lot. The developer proposes to construct roads, and install sewer and water utilities to serve commercial office buildings, 361 multi -family units and 1,656 single-family homes. Phase 1 of Rice Creek Plantation consists of multi -family Tracts H, I, L, single-family Tract A and a portion of the Thoroughfare (as shown on the Rice Creek Plantation - Master Plan), totaling 175.35 acres. The developer will disturb approximately 122.14 acres during construction of Phase 1, which includes 361 multi -family units and 175 single-family homes. The erosion control permit for Rice Creek Plantation- Phase 1 (Bruns 2007-396) includes both Phase 1 and Town Creek Elementary School (21.21 acres of disturbance) for a total of 143.35 acres of disturbance. Stormwater runoff from Tracts H, I and L will be directed to ten (10) on -site wet detention basins. The developer proposes to install asphalt roads throughout the subdivision with 30" standard or 24" roll curb and gutter, which will direct runoff to the stormwater collection systems (Tracts H, I & L) or 100' vegetated swales (Tract A. and portions of the Thoroughfare). As established on the Stormwater Master Plan, limits will be established for all single-family lots, multi -family residential areas and commercial areas to the extent that the project as a whole meets low density criteria at the 30% (non -SA waters) level. The single-family lots within Tract A are limited to 3,000 SF of impervious surface. This modification request is to remove a portion of the Thoroughfare from the collection system that is directed to Pond 8, and provide 100' vegetative swale for this portion of the Thoroughfare.
