O'Neal V 5 Nicklaus Way Clayton, North Carolina 27520 Subject Property: Moss Creek Village, Phases 3 and 4 Clayton, NC REQUEST FOR MORE INFORMATION: STORMWATER MANAGEMENT PLAN Dear Mr. O'Neal: On July 13, 2005, the Division of Water Quality (DWQ) issued a 401 Water Quality Certification to place fill within or otherwise impact 0.3006 acres of wetlands for the purpose of constructing Moss Creek Village Phases 3 and 4, as described within your application dated April 19, 2005. In order to meet Condition 6 of the 401 Certification for this project, a stormwater management plan for this project was received by the DWQ on March 28, 2007. The DWQ has determined that your stormwater management plan was incomplete as discussed below. General Certification 3402 requires that if a development is within a Nutrient Sensitive Waters (NSW) watershed and has impervious surface that exceeds 30 percent of the project area, all of the stormwater from the site must be treated by either: an extended detention wetland, a bioretention area or a wet detention pond followed by a forested filter strip (with a minimum length of 100 feet). The current stormwater plan shows a wet detention pond followed by a level spreader and a 50-foot forested filter strip. This project could be brought into compliance with General Certification 3402 by converting the wet detention pond to an extended detention wetland. 2. Please move the level spreader so that it is not upslope of the grass bypass channel for the stormwater BMP. The DWQ will require the above additional information to finalize review of the stormwater management plan for the Moss Creek Village Phases 3 and 4.
