SW8 070333MOD & SW8 071210MOD Rice Creek Plantation and Town creek Elementary School Brunswick County Dear Mr. Bowman: Dee Freeman Secretary In response to your letter, dated February 24, 2010, we agree that there are a few areas of minor erosion that need repair (item #2 of your letter). The more important question is what to do about item #1, the cut made in the shoulder behind the curb on Lake Park Drive. The issue isn't that the pond will not meet design capacity. The issue is stormwater runoff bypassing the forebay. As you are aware all stormwater to be treated in a stormwater pond must enter the pond via the forebay and meet the 2 to 1 length to width ratio for the 1995 stormwater rules that these permits were issued under. If inspected after a significant storm event I believe you will be able to observe sediment in the ditch downstream from the stormwater pond effluent structure. This is the sediment we are trying to settle out within the forebay and main body of the stormwater pond. Because of the shoulder cut stormwater is entering the pond bypassing the forebay and short circuiting through the outlet structure. These issues must be addressed prior to the issuance of the stormwater permit modifications submitted to our office. Please keep in mind that "Additional Information Requests" were sent to both permit holders January 22, 2010. As the issues regarding the stormwater pond have not been resolved and no plan of action has been submitted to our office protocol requires the return of the modification requests that includes forfeiture of the permit fees. However considering possible confusion as to how to proceed we are granting until lil!ar _^ 10 for resolution of the stated issues or a plan of action detailing a proposed solution. Otherwise projects will be returned as incomplete and the permit fees will be forfeited. Please note that this will not relieve the requirement to address the issues to the stormwater pond. The cut made into the shoulder behind the curb on Lake Park Drive does not affect the state and county mandated stormwater storage requirements. The first one inch of rainfall runs into the pond through the piped stormwater collection system and is stored in the pond up to a temporary pool of 24.08 feet. In order to meet Brunswick County's stormwater ordinance, the additional volume produced by the increase in post development runoff over predevelopment runoff is also piped to the stormwater pond and stored at an elevation up to 24.21 feet. The reason for the cut through the shoulder is that there have been several storms over the past year that exceeded the 10 year storm intensity, causing water to pond in the roadway. Without some type of emergency relief, stormwater could pond at least a foot deep in the roadway, making travel extremely dangerous, especially during peak traffic from the adjacent school. Please note that this is not a curb cut, but a cut in the shoulder acting as an emergency outlet. The elevation of the top of curb at this overflow is 24.83 feet, more than seven inches above the temporary pool elevation required by Brunswick County, and nine inches above the temporary pool elevation required by the Division of Water Quality. I believe that allowing this emergency overflow through the shoulder allows us to meet both state and local stormwater runoff requirements, while avoiding a condition that seriously floods the roadway. 2. I agree that there are a few eroded areas along the slope of the pond that are in need of repair, though all of those areas appear to have been eroded earlier in the construction process and do not show signs of fresh erosion. The owner will have his landscaper go in and repair the worst areas, but in most cases the areas in question now have vegetation growing. We do not want to cause more harm than good by disturbing areas so that we can stabilize them. Please contact me if you have any questions or require any additional information. Sincerely, David B. Box 19808 Raleigh, NC 27619 Subject: NOTICE OF INSPECTION Rice Creek Plantation — Phase I Permit No. SW8 070333MOD Brunswick County Dear Mr. Baker: On January 20, 2010, Chris Baker of the Wilmington Regional Office of the Division of Water Quality (DWQ) inspected Rice Creek Plantation — Phase I stormwater detention pond #8 in Brunswick County to determine compliance with Stormwater Management Permit Number SW8 070333MOD issued on December 12, 2007. DWQ file review and site inspection revealed that the site is not compliant with the terms and conditions of this permit. Please find a copy of the completed form entitled "Compliance Inspection Report" attached to this letter, which summarizes the findings of the recent inspection. As indicated in the attached inspection report, the following deficiencies must be resolved: 1. A cut was made in the shoulder behind the curb allowing stormwater runoff to bypass the forebay and short circuit the stotmwater pond. 2. A few places along the pond slope on the property boundary with the school have eroded and are in need of repair. Please inform this Office in writing before February 26, 2010, of the specific actions that will be undertaken and the time frame that will be required to correct the deficiencies. Failure to provide the requested information, when required, may initiate enforcement action including the assessment of civil penalties of up to $25,000 per day. If a written plan of action is not submitted to this office by February 26, 2010 then DWQ staff will re- inspect the site and issue a Notice of Violation if the listed deficiencies have not been addressed. Please be reminded that if any ownership or name change has occurred it is the permittee's responsibility to notify this office in writing.
