Dear Mr. Carson:
Division of Water Resources’ Central and Regional staff has reviewed the application package
received October 29, 2021. A draft permit was provided to the Town of Bath for review on January 14,
2022. However, at the Applicant’s request, additional information is required before the review and permit
drafting process may be completed. Please address the following item no later than the close of business
on February 21, 2022.
 It was determined that the high-rate infiltration system is not operational and irreparable;
therefore, the high-rate system has been removed from the permit. As such, the draft permit
provided to the applicant on January 14, 2022 was considerably different than the existing
permit. Our office understands that the applicant would like additional time to review the
draft permit with their counsel. Please review the attached draft and return with any
comments before the expiration date of the request.
Please be aware that you are responsible for meeting all requirements set forth in North Carolina
rules and regulations. Any oversights that occurred in the review of the subject application package are
still the Applicant’s responsibility. In addition, any omissions made in responding to this item, or failure
to provide the additional information on or before the above requested date may result in your application
being returned as incomplete.
