Dear Mr. Pearson:
Division of Water Resources' Central and Regional staff has reviewed the application package
received October 25, 2021. However, additional information is required before the review may be
completed. Please address the items on the attached pages no later than the close of business on February
21, 2022.
Please be aware that you are responsible for meeting all requirements set forth in North Carolina
rules and regulations. Any oversights that occurred in the review of the subject application package are
still the Applicant's responsibility. In addition, any omissions made in responding to the outstanding items
in Sections A through E, or failure to provide the additional information on or before the above requested
date may result in your application being returned as incomplete.
Please reference the subject application number when providing the requested information. All
revised and/or additional documentation shall be signed, sealed and dated (where needed), with two paper
copies and one electronic copy submitted to my attention at the address below.

A. Residuals Land Application Program (FORM: RLAP 06-16) Application:

B. Operation and Maintenance Plan (O&M Plan):
1. No comments.
C. Land Application Site Certification (FORM: LASC 06-16) Form:
1. The provided LOA for field NC-LT-47-02 was signed by Randy Eugene Leatherman, but the red
property line shown on the map includes multiple parcels not directly owned by this signatory,
including parcel 2676393806 owned by the Calvin Eugene Leatherman Estate, parcel 2676390943
owned by the Susan Turpin Life Estate, and parcel 2677209058 owned by Eugene Leatherman.
Please provide information to prove that Randy Eugene Leatherman has the authority to sign for
these properties (such as being a beneficiary to the estates, or a successor -owner). If he does not,
new LOAs shall be provided from the authority for these properties, 50 foot buffer shall be provided
to all property lines on an updated site map, and any acreage changes shall be shown in an updated
LASC. The buffers can be waived through reciprocating setbacks waivers for all applicable
property lines. Setback waivers shall be written, notarized, signed by all parties involved, and
recorded with the appropriate County Register of Deeds.
2. There are several houses to the west of field NC-LT-47-02 that were previously described as
"offsite houses" in the February 6, 2020 permit issuance, with associated 400 foot buffers which
are all now described as "onsite houses". This includes the houses on the properties listed in Item
C.1. along with parcel 267703206098 owned by Mamie S. Leatherman (setback waiver provided).
Please provide information to prove that Randy Eugene Leatherman, the signatory of the LOA, has
the authority to sign for these properties to verify that they are onsite houses. If he does not, 400
foot buffers shall be provided to these houses on an updated map, and any acreage changes shall
be shown in an updated LASC. Alternatively, the buffers can be waived by the appropriate
authorities for these houses. Setback waivers shall be written, notarized, signed by all parties
involved, and recorded with the appropriate County Register of Deeds.
Item B on the Instruction for FORM: LASC 06-16 states that the Permittee shall provide a soils
and agronomic evaluation in accordance with the Soil Scientist Evaluation Policy for certain
modified field applications. The application requests to add 11.4 acres of new land application area
to field NC-LT-47-02 on parcel 2676393806. A modification of this size will require the above
referenced evaluations in accordance with the Soil Scientist Evaluation policy to verify that the
new land application area is consistent with the previously determined soils on site.
4. There are two places of assembly under separate ownership that are not indicated on the site map
for field NC-LT-48-13. These include a potential house on parcel 2675420442 to the east of the
field, and a church on parcel 2675336083 to the northeast. These structures are shown on the map,
but a buffer was not applied. The appropriate setback shall be applied to these structures and
provided in an updated site map. If the setbacks impact the current configuration of the field, the
reduced acreage shall be shown in an updated LASC. Setback waivers mat be submitted, and shall
be written, notarized, signed by all parties involved, and recorded with the Lincoln County Register
of Deeds.

5. There are a few buildings onsite to field NC-LT-48-15 which are not depicted on the application
map provided. Additionally, parcel 2665873683 to the south of the field is depicted as an onsite
parcel, but it is under separate ownership and has the offsite house setback applied to the house.
These structures and an accurate property line shall be depicted on an updated site map with any
appropriate setbacks. Any reduction in acreage shall be shown in an updated LASC.
D. Landowner Agreement (FORM: LOA 06-16) Form:
1. See Item C.1. If needed, provide updated LOAs for any parcel Randy Eugene Leatherman does not
have the authority to sign for that also have with land application area proposed.
