The subject site is bordered to the north by Highway 85, to the east and south by rural roads and active agricultural fields, and to the west by single family residences and rural roads. 4b. Indirect impacts to aquatic resources are assumed to be minimal due to stormwater detention basins and the avoidance of significant impacts to wetlands. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: Multiple site layouts were attempted to avoid impacts to onsite aquatic features. The current layout minimizes impacts to wetlands while allowing for the project to remain financially feasible. Chemical and physical connectivity between the northern and southern wetlands would be preserved via the construction of temporary diversion ditches, draining around the proposed building, into stormwater retention basins that would then overland flow into the southern wetland. As well as, a building underdrain within the flow path of the existing upland ditch to allow for the drainage of subsurface water that would drain into a stormwater detention basin. The proposed project would not impact the southern wetland. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: The selected contractor would implement best management practices during construction to reduce potential temporary, minor construction related effects from the proposed project. These would include the use of silt fences, phased grading and earth moving activities, gravel and rocked entrances to site, dust control, and the immediate application of seed and matting/straw upon completion of earth moving activities. 2. Terracon consulted the US FWS Information for Planning and Consultation (IPAC) website, Consultation Code: 04EN1000-2022-SLI-0307, to determine if Federally listed Threatened or Endangered (T&E) species were identified within the proposed project area. No critical habitats were identified within the project area. Terracon also conducted a pedestrian survey of the area to identify the presence of federally listed T&E species, none were observed. Habitat for the Schweinitz's Sunflower (Helianthus schweinitzii) was observed in the northern, western, and eastern portions of the site along the highway and rural roads right of way, however, these areas fall outside of the proposed project footprint. In addition, the proposed project would be developed on land that historically, and is currently, agricultural land and would not be expected to potentially adversely affect any of the listed species for the project area. 6. Although not required by section 7, many agencies request species lists to start the informal consultation process and begin their fulfillment of the requirements under section 7(c) of the Endangered Species Act (Act) of 1973, as amended (16 U.S.C. 1531 et seq.). The purpose of the Act is to provide a means whereby threatened and endangered species and the ecosystems upon which they depend may be conserved. Under sections 7(a)(1) and 7(a)(2) of the Act and its implementing regulations (50 CFR 402 et seq.), Federal agencies are required to utilize their authorities to carry out programs for the conservation of threatened and endangered species and to determine whether projects may affect threatened and endangered species and/or designated critical habitat. A Biological Assessment is required for construction projects (or other undertakings having similar physical impacts) that are major Federal actions significantly affecting the quality of the human environment as defined in the National Environmental Policy Act (42 U.S.C. 4332(2) (c)). For projects other than major construction activities, the Service suggests that a Biological Evaluation similar to a Biological Assessment be prepared to determine whether the project may affect listed or proposed species and/or designated or proposed critical habitat.
