Sea Side Bay, LLC Page 2 9. PROJECT DESCRIPTION The proposed project is located near Supply in Brunswick County off Stone Chimney Road (SR1115), adjacent to the Lockwoods Folly River. To reach the project area, travel south on US Hwy 17 to the intersection with NC Highway 211 near Supply, NC. Turn left onto NC Hwy 211 and travel approximately 0.3 miles to Stone Chimney Road. Turn right onto Stone Chimney Road and travel approximately 1.3 miles, on the left will be a sign "Doe Creek Subdivision", turn left into the subdivision and take the first right (there are no street signs within the subdivision) and travel to the end of the street and then turn right. Travel to the end of this street and turn left. Travel approximately 0.3 miles and the pavement ends in a cul -de -sac. Travel straight across the cul- de -sac to a dirt road and travel approximately 0.2 miles and the dirt road terminates at the site at the Lockwoods Folly River. The subject property consists of a separate 0.64 acre peninsula shaped parcel that is a part of the Doe Creek Subdivision which is accessed via an easement (Eden Lane Extension) through a portion of the Ruffins River Landing Subdivision which is adjacent to Doe Creek. The subject parcel is bordered to the east and west by a 16.18 acre tract, predominately §404 wetlands, owned by Seaside Bay LLC, vacant land to the south and the Lockwoods Folly River to the north. The total shoreline frontage for both parcels is approximately 1,500 lineal feet. The highground portion of the 0.64 acre parcel has an elevation range from 0 to 5 feet above normal high water (NHW). Vegetation on the high ground portion of the 0.64 acre parcel consists of grasses, Loblolly Pine (Pinus taeda), Turkey Oak (Quercus laevis), Eastern Red Cedar (Juniperus virginiana) and Saw palmetto (Serenoa repens). The predominant coastal wetland species in the project area consists of Smooth Cordgrass (Spartina altemiflora), Saw Grass (Cladium spp.) and Giant Cordgrass (Spartina cynoroides). The Corps of Engineers has previously approved the wetland delineation (SAW- 2005 -1269) of the site. CAMA Major Permit #99 -09 was issued to Doe Creek Plantation, LLC clo Tom Morgan on July 24, 2009 and authorized the excavation and construction of a boat ramp, bulkhead, two (2) fixed piers and two (2) floating docks. Construction of the facility was completed November 2013 and is currently in compliance with the existing permit. This permit was due to expire on December 31, 2012. This permit is subject to extension by the Session Law 2009 -406, and as amended by Session Law 2010 -177, the Permit Extension Act, therefore the permit is now due to expire on June 9, 2015. However, due to the ownership change, completion of the work authorized by the existing permit and the scope of the proposed new development, this application is being processed as a new major permit for Seaside Bay, LLC, the new owners. The Brunswick County Land Use Plans classifies the upland areas of this project as Rural, Conservation. The waters of the Lockwoods Folly River in the vicinity of the project area are classified SC by the NC Division of Water Quality. The Division of Marine Fisheries has designated this area as Primary Nursery Area and it is closed to the harvesting of shellfish. 10. PROPOSED PROJECT The applicant proposes to construct two (2) concrete walkways and two (2) fixed shore side access piers with floating docks and a fixed observation platform. As proposed, the concrete walkways would connect the existing wooden access piers adjacent to the existing boat ramp to the parking and driveway area. As proposed, each concrete walkway would be approximately 4 feet in width and 40 feet in length and would be constructed landward of the 30 foot Coastal Shoreline AEC. Seaside Bay, LLC Page 3 The applicant is proposing two (2) shore side access piers originating from the bulkhead, one on either side of the existing boat ramp. The access pier to the south would measure approximately 6 feet in width and 70 feet in length. The proposed access pier would be located approximately 3 feet landward of the NHW boundary and would be located over a mix of 404 and coastal wetlands. As proposed the southern access pier would connect via access ramp, measuring approximately 4 feet wide by 12 feet long, to two (2) floating docks each measuring approximately 6 feet wide by 20 feet long. The proposed floating docks would parallel the shoreline in a southeasterly direction. The proposed floating docks are labeled dock #1 and dock #2. Please note that dock # 3 and dock #4 were authorized by CAMA Major Permit# 99 -09 (see sheet 1 of 2). The proposed access pier to the north would measure approximately 6 feet in width by 225 length and would terminate at an observation platform measuring approximately 16 feet in width by 20 feet in length. This pier is also proposed 3 feet landward of the NHW boundary and would be located over a mix of 404 and coastal wetlands. As proposed, the observation platform would be uncovered and would have a wooden eight (8) canoe vertical storage structure. A proposed floating platform measuring approximately 10 feet wide by 10 feet long would be connected by an access ramp, measuring approximately 4 feet wide by 12 feet long, to the observation platform. The proposed floating platform would be for swimming and canoe launch. The applicant states that this platform will have no tie -ups for boats, by having no cleats, and the pilings would be located on the landward side of the platform to prevent dockage. The proposed northern access pier would connect by an access ramp, each measuring approximately 4 feet wide by 12 feet long, to six (6) floating docks measuring approximately 6 feet in width by 20 feet in length, these floating docks are labeled dock #5 thru dock #10 (see sheet 1 of 2). As proposed, the floating docks would be evenly spaced along the northern shore side access pier and would parallel the shoreline in a northeasterly direction. The applicant states that the floating docks would be removable and the support pilings would be located on the landward side of the floating docks. As proposed, the floating docks would be located, on average, approximately 15 feet water ward of the Normal High Water boundary (NHW) and would conform to the'/ width of water body limitation. The proposed observation platform and floating platform would be located approximately 24 feet from the NHW boundary and would also conform to the % width of water body limitation. The application states that the water depths at the waterward edge of the floating docks would be approximately -5 feet to -10 feet @ NLW. As proposed the floating docks would be used by the residents of the subdivision. The width of the Lockwoods Folly River is approximately 98 feet to 100 feet wide at this location and is designated a Federal Channel from bank to bank by the U.S. Army Corps of Engineers. As proposed, the access piers would be elevated a minimum of three feet above the wetlands substrate. The proposed floating docks would provide mooring for ten (10) vessels. 11. ANTICIPATED IMPACTS The proposed concrete walkways would result in approximately 320 square feet of impervious surface within the Estuarine Shoreline AEC and would be located landward of the 30 foot Coastal Shoreline buffer. The proposed access piers and observation platform would result in the shading of approximately 1,890 square feet of 404 and coastal wetlands. The proposed floating docks would incorporate approximately 1,260 square feet of Estuarine Waters and Public Trust Area. As proposed, the floating structures would not exceed % width of the water body. The proposed structures would not encroach into the adjacent 15 foot riparian corridor setback. The applicant may need to utilize logging mats across the marsh during construction and some temporary impacts may be expected. Minor increases in turbidity can be expected during construction. Catawba Avenue, Su. 203 Cornelius, North Carolina 28031 January 10, 2014 North Carolina Division of Coastal Management 127 Cardinal Drive Extension Wilmington, NC 28405 RE: NARRATIVE FOR MAJOR DEVELOPMENT PERMIT APPLICATION — SEASIDE BAY (AKA DOE CREEK) Dear NC C.A.M.A.: Seaside Bay (aka Doe Creek) currently has a permitted Boat Ramp (NCDENR # 99- 09). The project is complete as verified and inspected by C.A.M.A. We are seeking a permit for our plans for ten (10) floating docks on the Lockwood Folly River, of which two (2) are permitted and installed. We would like to add to the current, approved boat ramp, and build 8 additional docks, plus one canoe launch platform for our community's use. Seaside bay contains 147 single family residences, many of which have riparian rights on the Lockwood Folly River, Doe Creek, and Little Doe Creek. Most of the riparian rights will not allow boat slips due to shallow depth, presence of fish habitat, and lack of width of the water channel. Our plan will allow residents access to the water in an area where depth and width are adequate for boating. Attached are the fully completed application (both MP -1 & MP -4). Of the proposed floating docks, two are already permitted and built (noted as "Common" on the sketch). The total number, including the currently approved platforms is ten and all are 6'x20' and anchored by pilings driven on the back side of the floating docks. The docks are designed to be removable. We propose erecting an elevated boardwalk (6' or less in width, with a minimum 3' over the wetland substrate) to connect the floating platforms to the existing wooden docks. We also propose a 16'x20' Observation Pier with no handrails, connected to a floating 10'x10' canoe launch and swim platform. This launce platform will have no tie -ups for boats (no cleats), and pilings will be behind the platform on the shore side to prevent dockage. Additionally, the Homeowner's rules will prevent boat tie ups to this platform for any amount of time. In addition to the observation pier, we propose a wooden 8 -canoe vertical storage structure on t %CEIVED far end of the observation pier. DCM WILMINGTON, NC JAN 15 2014 ENVIRONMENTAL: These boardwalks will be over jurisdictional wetlands, and we expect to have no impact on the wetlands (no fill) from this proposal. Water depth in the Lockwood Folly River is adequate at low tide to support this project at 8 feet (typical). The width of the river is over 100 feet, which is adequate for this project. We propose no fuel, no electricity, no sewage pumpouts, and mooring for no more than 10 boats.
