On November 4, 2021, the Division of Water Resources (Division) received your application requesting a 401 Water
Quality Certification from the Division for the subject project. The Division has determined that your application is
incomplete and cannot be processed. The application is on -hold until all of the following information is received:
1. The PCN impact table lists wetland impact W2 as a permanent impact. The Supplemental Information indicates
that wetland W2 will be impacted by minor grading and that the area will be replanted with a native/riparian
seed mix. Based on the profile provide on Sheet 3, it does not appear that any fill, or increase in ground surface
elevation, is needed or proposed in wetland W2 to construct the proposed stream channel. Is the intent of the
project that impacts to wetland W2 result in a loss or change in ecosystem type (i.e. permanent impact), or is
the intent of the project that impacts to wetland W2 will be of such short duration as to have minimal impacts
to the ecology of the area, and within a reasonably short duration following construction W2 will return to its
pre -construction function (i.e. temporary impact)? [15A NCAC 02H .0506(b)(1)]
2. It appears that a portion of the stream restoration project extends onto a neighboring property not owned by
the project applicant. Is the neighboring property owner to the north of the property aware of the project and
have they given authorization for the aspects of the project to be conducted on their property? [15A NCAC 02H
.0506(b)(2)]
Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the
proper consideration of the application. Please provide your response by December 23, 2021. If all of the requested
information is not received, the Division will be unable to approve the application and it will be denied as incomplete.
The denial of this project will necessitate reapplication to the Division for approval, including a complete application
package and the appropriate fee.
