I have provided some additional information below regarding the project: 1. "The PCN impact table lists wetland impact W2 as a permanent impact. The Supplemental Information indicates that wetland W2 will be impacted by minor grading and that the area will be replanted with a native/riparian seed mix. Based on the profile provide on Sheet 3, it does not appear that any fill, or increase in ground surface elevation, is needed or proposed in wetland W2 to construct the proposed stream channel. Is the intent of the project that impacts to wetland W2 result in a loss or change in ecosystem type (i.e. permanent impact), or is the intent of the project that impacts to wetland W2 will be of such short duration as to have minimal impacts to the ecology of the area, and within a reasonably short duration following construction W2 will return to its pre - construction function (i.e. temporary impact)? [15A NCAC 02H .0506(b)(1)]" This is a fair question and something that Clement, Andrew Bick and I discussed prior to submittal. The intent of impact W2 is not to change the ecosystem type, however I believe that the work done to reconstruct the stream channel will likely alter the existing wetlands hydrology (compaction from equipment, minor grading, stream bank/feature construction). The area will be replanted with a native/riparian seed mix, but due to the potential hydrology change, we considered it a permanent impact on the application. 2. "It appears that a portion of the stream restoration project extends onto a neighboring property not owned by the project applicant. Is the neighboring property owner to the north of the property aware of the project and have they given authorization for the aspects of the project to be conducted on their property? [15A NCAC 02H .0506(b)(2)]" Headwaters Engineering has provided an updated restoration plan (attached). The update plan will be conducted entirely on the property owned by the project applicant. The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until all of the following information is received: 1. Please provide your response by December 23, 2021. If all of the requested information is not received, the Division will be unable to approve the application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the Division for approval, including a complete application package and the appropriate fee.
