Box 2019 Elizabethtown, NC 28337 Re: Division of Water Quality Permit Reviews Dear Mr. Taylor: Dee Freeman Secretary At the request of the Governor's Office, I am responding to your letter of March 10, 2010 concerning the review of environmental permit applications. First, it may be helpful to provide some background on DENR's Express Permit Review Program, which is available for both stormwater permitting and for review of sedimentation and erosion control plans. The General Assembly authorized the Express Permitting Program in 2003 to address a backlog in review of development permits — especially stormwater permits — in the coastal area. At the time, the Division of Water Quality did not have sufficient staff to manage the volume of permit requests in a timely way. In response to interest in the development community, the Express Permitting Program was created to provide a coordinated permit review with an expedited timeframe for developers who had time -sensitive projects. The expedited review is only possible because the program — which is entirely fee supported — charges fees at a level sufficient to pay for additional staff dedicated to express review. The program also uses a pre -application meeting and strict completeness requirements for permit applications to ensure that the permit application is appropriate for express review. Presently, the Division of Water Quality's Wilmington Regional Office (WIRO) Stormwater Section has nine employees: three engineers assigned. to the regular state stormwater program for application review; four engineers assigned to the express state stormwater program; and two environmental specialists assigned to the stormwater compliance inspection program. In any given week, an average of 75 to 85 pending permit applications are under review. Each engineer has approximately seven to 10 applications to review and process. Taylor, PLS, GISP April 7, 2010 Page 2 of 3 pen -nits, engineers in both the regular and express stormwater programs are responsible for determining a compliance with engineered plans before issuing a permit for a project modification. Applications are processed by each engineer in the order the engineer receives the applications and the timeline for review may be affected by the need for additional information. State stormwater rules require DWQ to advise an applicant that the 90-day permit review time for the regular stormwater permitting program only begins once the application is complete. The rule also directs DWQ to return incomplete applications. The Department has directed permitting staff to try to address minor omissions by telephone or email to avoid the need to return an application. Applications often omit more complex information, however, that cannot be handled in a quick telephone call or exchange of emails. In fairness to other applicants, it is not possible to guarantee that review of an application lacking more substantive information will resume immediately upon its submission. When an applicant requests information on permit processing times, DWQ generally provides information on both the regular and the express permitting programs. My understanding is that DWQ does not encourage the use of one program over the other, but provides enough information to allow the applicant to decide which program best fits the project. For certain time -sensitive projects, the express program has met a very real need. Our experience has been that the express program also expedites review of projects that remain in the regular permitting process by reducing the number of those projects. As mentioned above, the General Assembly required the express program to be entirely self-supporting; the additional stormwater review positions in the express program would not exist in the absence of the express permit fees. The Department also recognizes the need to be as efficient as possible in our regular permitting programs. For that reason, the Department has formed an internal working group to brainstorm ideas that will allow us to better meet our dual obligations to protect the State's natural resources and provide good service at a time when both public and private resources are stretched.
