Thanks Branch — As I reread my email, I found that I may not be as clear I as wanted to be. The
offsite BUA that you are adding to the application is only the offsite BUA that is being treated in the
proposed wetlands. You should not add in all of the BUA of the new turn lanes because only a small
fraction of them is being treated in the wetlands.

One minor comment regarding the application.
In Section IV.10, please split up the 53,369 sf drainage area into the on -site DA and the offsite DA.
The offsite DA would be comprised of those parts of the development that are outside of the 1.39
acre property boundary, such as the existing Highway 211 and new turn lane and that portion of the
driveway shared with the adjacent future development parcel.
Additionally, please report the offsite built -upon area in the appropriate box for Impervious Surface
Area. The offsite BUA would be comprised of the BUA for the shared driveway and the BUA for that
portion of Highway 211 and the new 211 turn lane, that is located outside of the 1.39 acre property
boundary.
You can scan and email that revised page 3 of the application. I've started drafting the permit and
,an issue it upon receipt of the new page 3.
FYI -
Section IV 2.b of the application (also on page 3) has been marked as using the 1995 Coastal rules
for design. This section of the application (in conjunction with 2.a. above it) is for the use of those
projects claiming a vested right to a previous set of rules. That is not the case here, so you do not
need to mark anything in Section IV 2 a or b of the application. I've marked it N/A, but if you want to
update this when you update the onsite and offsite DA and BUA, that would be nice.
Additionally, on page 3, I've removed the 3500 sf of canopy area from the "Buildings" category and
listed it separately as "Canopy" underneath the Buildings box. I simply crossed out "Streets" and
wrote in "Canopy" 3500 and I adjusted the "Building" BUA to 4050 sf.

Dear Ms. Russell:
Please find enclosed response to Linda Lewis's preliminary review of the above referenced project.
1. The short-circuiting of the wetland has been corrected. The deep pool outlet was positioned
further away from the north forebay and the center forebay has been eliminated. There are now
two forebays at the north end and the west end of the stormwater wetland.
2. Finish grade elevations have been added to the wetland cross-section detail that includes the deep
pools, forebays, shallow land, and shallow water.
3. I revised the planting plan in the shallow land to be shrubs only. After revising the wetland
layout and zone percentages, the plant percentages changed as well For example, the minimum
number of shrubs increased from 80 to 88. The plant table has been revised to include these
changes as well as Dr. Rashash's recommendations. I emailed the wetland to Dr. Diana Rashash,
an Onslow Co. Extension Agent, who has experience in wetland plantings, and her
recommendations were included as part of this revised plant table.
4. A detail has been added for the parldng island cross -sections that shows the curb cut, yard inlet,
and landscaped parking islands that will carry stormwater runoff from the parking lot to the
stormwater wetland.
5. The roof drain downspouts have been noted on the plans and drain pipes have been specified for
sections of the building and gas pump canopy. The building will be a hip roof design. The
canopy will be uniformly sloped to the roof drains.
6. Plans are sealed, signed, and dated by the Engineer.

7. On this particular site, it is not practical to capture runoff from NCDOT widening and turn lanes
and send them to the on property stormwater BN[P. Some roadway runoff is taken into the site
and into the BUT, but the road primarily drains into right-of-way grassed -lined swales. NCDOT
stated they maintain and operate under NPDES stormwater permits. Attached is a letter that was
given to the by NCDOT regarding stormwater BMPs not allowed within the right-of-way_

Recently, we have seen an increase in the number of encroachment submittals that include a
request to Ipprove the installation of storr mater devices within the Right of Way. Many of
these permanent devices have permit conditions that require them to be inspected routinely and
maintained in proper working condition. Even if the encroaching party agrees to assume
maintenance of the device, NCDOT, as ownerh anager of the Right of Way, is a party to these
devices and would be subject to any violation associated with these devices. Therefore, it is in
the best intmut of the Division not to approve the installation of any permanent stormweter
devices associated with encroachment requests within the Right of Way.

PROJECT DESCRIPTION AND PERMITS Pgp J # 5(/1 #We 2 /Z
The site is located in central Brunswick County in Supply, NC at the northwest comer property o I--.��
and Stone Chimney Road (SR 1115). The entire parcel drains into an unnamed tributary of Lockwood Folly
River (Lumber 15-25-1-1, Class Sc;). The property is Tax ID: 1680007608 owned by Campbell Brothers
Investments, LLC. Only the corner portion of the parcel is being developed at this time. The proposed building
will include a convenience store and possible future restaurant space. The site will include parking, gas pump
islands and overhead canopy, underground utilities and gas tank, stormwater wetland BMP, and NCDOT
roadway improvements along Stone Chimney and Hwy 211. Other approvals and permits that will be required
are Brunswick County Site Plan Approval that includes stormwater, utilities, building plans, and planning. Also
this project will require a State erosion control permit, a State underground storage tank permit, and a State DOT
driveway permit for road improvements.
SOILS
Based on the NRCS Web Soil Survey, soils on the developed portion are Fo, Foreston loamy fine sand HSG
Type B. S&ME performed a soils infiltration and SHWVT test for the intent of an infiltration basin, but the report
indicated poor infiltration rates not acceptable for an infiltration stormwater basin. The soils classified by S&ME
indicate sandy loamy.
STORMWATER WETLAND DESIGN
Stormwater will be collected from the C-store, gas island canopy, parking lot, sidewalks, public roadways, and
surrounding ground by yard inlets within the parking islands and curb inlets along the parking lot curbing. The
storm drainage system is a piped network that discharges into the stormwater wetland BMP into two separate
outfalls. The western outfall or "forebay" accounts for 40% of the drainage area and the northem forebay
accounts for 26% of the drainage area. Stormwater entering the western forebay has a longer treatment time
before reaching the outlet, which is necessary because more drainage is entering that side. The storm pipe
inverts are below the wetland permanent pool surface area, which reduces erosive velocities and allows for
longer TSS settling and pollutant movement. Both forebays are designed with an additional 6-inches of
sediment storage at the bottom. These forebays are accessible for rubber tire backhoe or other methods from
the parking lot for future maintenance and sediment removal. The shallow land area is designed to be 0-2"
below the wetland permanent pool. The shallow water area is designed to be 4-6" below the permanent pool.
There are two deep pools in the wetland, but one is the outlet deep pool where the low -flow orifice discharges
the first flush and 1.5-inch rainfall -runoff. The deep pools are designed to be 24-36" below the permanent pool.
The plans and details indicate finish grade elevations for these areas and pools, as well as the number of
plantings required for each area of the wetland. The temporary pool is 12-inches in depth, but the 1.5-inch
rainfall -runoff storage requirement is retained to a depth around 9-inches, which is better suited for plant life as
found by Dr. Bill Hunt's previous research on these systems. The 1.5-inch rainfall -runoff storage remains in the
wetland for 3.10 days. The 1-yr, 24-hr design storm is contained within the temporary pool volume and
discharges below pre -development rates. The 10-yr, 24-hr design storm bypasses the temporary pool volume
and discharges below pre -development rates. The 1-yr and 10-yr design storms are required to be accounted
for by the Brunswick County Stormwater Ordinance.

S&ME, Inc. is pleased to provide this report for storniwater testing services at the above -
referenced site. S&ME was requested by Mr. Branch Smith, P.E. of GS Engineering
Services on your behalf to perform these services in preparation for the planned site
improvements. S&ME has conducted these services in general accordance with S&ME
Proposal 00.8A-09 dated December 31, 2009.
[PROJECT BACKGROUND
The project site is located at the northwest corner of Stone Chimney Road and NC
Highway 211 in Supply, North Carolina. The site is currently an undeveloped Marcel that
is relatively flat and has been recently mowed. A site plan showing the proposed
development, including the proposed infiltration basin anti stormwater testing locations
(B-1 and B-2), was provided by Mr. Smith. The two stormvvater test locations were
staked in the field by others prior to our mobilization to the site.
FINDINGS
Our stormwater testing consisted of two tasks — a seasonal high water table evaluation
and hydraulic conductivity testing. The seasonal high water table evaluations were
performed on January 13, 2010 by advancing hand auger borings to depths ranging from
approximately 35 to 40 inches below the existing ground surface at the test locations
staked in the held.
Soils ;were evahiated tinder the guidance of a Licensed Soil Scicrltist for evidence of
seasonal high water table influence, This evaluation involved looking; at the actual
moisture content in the soil and observing the matrix and mottle colors. Depending on
the soil texture, the soil color will indicate processes that are driven by seasonally high
water table fluctuations, such as iron reduction and oxidation and organic matter staining.

A hand auger boring profile sheet, which provides a description ol'the observed soil
horizons and the determined seasonal high water tables, has been included with this
report.
Tlie soils at the test locations were observed to range from a sandy loam to a sandy clay
loam. The seasonal high water table was determined to be approximately 20 inches and
25 inches below the existing ground surface at locations B-1 and 13-2, respectively.
These depths were verified by Mr. Vincent Lewis, Division of Water Quality, on January
26, 2010 during a site meeting coordinated and attended by Mr. Branch Smith of GS
Engineering Services, PLLC. See Table 1 below for the seasonal high water table depth
at the test locations. The hand auger borings were continued to determine the depth of
actual groundwater, .vhich was encountered at 28 and 27 inches below the existing
ground surface at 13-1 and B-2, respectively.
S&ME performed the in -situ soil hydraulic conductivity testing by using a compact
constant head permeameter at the test locations. A ]land auger boring was advanced to a
depth of approximately 6 inches below the existing ground surface with a 3-111ch diameter
bucket. The water dissipating unit was lowered to the bottom of the hole, and water was
dispensed from the pernleameter. The Nvater was allowed to move through the unit until
steady-state flow was achieved, and then flow rates were recorded. The last three
measurements were averaged to achieve the most representative value to express the
saturated hydraulic conductivity. The depth interval of the tests corresponded to a layer
of material approximately 6 inches thick at the selected testing depths. The permeability
rates were calculated as being 1.12 and 0'29 inches per hour at 13-1 and B-2, respectively.

Please note that the seasonal high water table evaluation is based on Secondary evidence
and not on direct groundwater level measurements. Groundwater levels fluctuate for
numerous reasons, and these findings do not indicate that groundwater levels have not or
will not rise above the noted depths.

Bruns Co has to sign off before we can do anything and they have to have all State permits including State Stormwater,
so we wouldn't be able to start anything until they're all in! This also includes building inspections and fire marshall
approval. Helen didn't say much about the lighting issue w/ or Wout LEDs - all she suggested is to go back to the original
plan and meet the ordinance just to get the project constructed_ She said, then you could go back and change the lighting
and by then they may have re -written the ordinance. It sounds a little vague and I personally don't think they are going to
there ordinance changed anytime before you want to get started. We may want to all get together and call Helen about
the lighting to see which way to go ...... plus we can discuss the Express Stormwater option in person.

Got some bad news. The State stormwater review is 75 days out. They have 90 days by law. So we may not get a State
Stormwater permit until June. We thought they were all sitting around waiting for some work to come in, but that's not the
case. Only option is to pay for the Express Review and then we would have a permit by April 15. Its an additional $3500
though. June may not be bad for you if the bidg plans and other permits are holding you up??
We'll wait to hear your call.

ownership, so please note it as member -manager.
2. 1 attached a C-4 Grading pdf that shows the drainage area in red that you are looking for and storm inlet areas in blue.
3. A sidewalk detail is shown on attached C-5.1-5.2 pdf that shows the width as 5' which matches the plan. The only
sidewalk is around the building. And it calculates to 900 sgft instead of the 940 sgft I have listed. There used to be a little
portion around the loading dock within the parking lot, which is now gone and asphalt pavement is in its place, so total
impervious should still match. As we still make minor changes to the plan, we will submit any final changes as the review
is completed.

I have done a preliminary review of the proposed Minuteman Food Mart to determine if the application is
eligible for Express review. A few minor problems to address before we can accept the project:
1. There are 4 inlets into the wetlands, of which 3 enter the wetland at a point that is closer to the outlet,
with one right across the way. Short-circuiting of the treatment device is a concern. Wetlands are one of
those treatment devices that don't work well if the incoming runoff doesn't get the benefit of all that
travel time through the wetland. Please provide only one or 2 inlets, both located as far away as
possible from the outlet to facilitate the necessary contact time.
2. Please add specific elevations to the wetlands section view on sheet C 5.2. The only elevations
currently labeled are the permanent pool and temporary pool. The rest of the elevations such as the
bottom of the deep pool and the bottom of the shallow water are currently shown as a range of
acceptable depths instead of a finite elevation.
3. It appears that you have chosen to provide "shrubs only" in the shallow land area. A minimum of 80
shrubs are required, but only 60 are shown on the plant list on sheet C 5.2. The available options for
plantings in the shallow land area are herbaceous cover only, shrubs only, or a combination of
herbaceous cover and trees. There is no option for herbaceous cover and shrubs.
4. Please add a detail of the lowered curb section in the grassed islands that allows runoff to get into CB-1
and CB-2.
5. Please show the roof drain Iccadions for the building. We deed to make sure that they are situated such
that they will ultimately drain into the wetland.
6. The plans have been sealed, but they are not signed or dated. The plans must be signed, sealed and
dated before a permit can be issued.
7. The runoff from the new required turn lane needs to be addressed under this permit as well. All built -
upon area that is being constructed as a result of this project is a common plan of development must be
considered in the application.
When you've made the requested changes and addressed the turn lane issue, please contact Janet Russell to
set up a submittal meeting.

Dear Governor Purdue:
I am writing to you to express considerable concern regarding the practices of NCDENR employees
reviewing permit applications for development projects. In short, it appears that some NCDENR sections
are using the maximum allowed review period time in an attempt to force developers/citizens to pay
express fees to get their project reviewed in a timely. manner. Considering current economic conditions,
this practice presents itself as an unreasonable and unethical way to get five to ten times more fees for a
single permit.
Currently, building a small business structure in one of the coastal counties requires a plethora of permits
and fees. For example, a typical convenience store on a 2-acre site in Brunswick County requires the
following state permits:

The erosion control permit review period is 30 days. The review period for the stormwater permit is 90
days, We recently called to check on the status of the review of a stormwater permit application which
had been submitted 15 days earlier, and were told that our review was 75 days out. The reason stated
was that there were 10 projects in line ahead of ours, but that we could request an express review if we
wanted to get it sooner. Our concern is that if there are only 10 projects ahead of ours, why is it going to
'rake their entire review staff 7.5 days each to review these projects? This represents 60 man-hours per
review, which is totally unrealistic.

There are approximately 18 NCDENR engineers and environmental specialists in the Wilmington District
who are either in the Surface Water Section or the Express Review Section. Is it reasonable under any
circumstances for 18 employees to take 75 days to review 10 projects? To put this in perspective, over
1,000 hours of total staff time will be consumed while each project is reviewed.
In addition, NCDENR has told us that 95% of all applications require at least one additional information
request, and 50% require at least two additional information requests. Each time an information request
is sent by NCDENR, the 90-day clock restarts. The result is that a permit might be delayed for as long as
270 days if the owner does not request the express permit.
While we recognize that the staff in these two NCDENR sections certainly does more than review project
applications, there appears to be an effort to generate more revenue at the expense of businesses and
employers who are trying to grow m extremely tough economic times. And when we go to a business
owner or developer to recommend they pay seven times more for the same permit, we want to be certain
that this is the only option
These are different times, Governor Purdue. State and local government employees should be expected
to perform at their highest level during times like these. They should do everything in their power to
assist the citizens and businesses of North Carolina in achieving their goals in a timely and professional
manner. They should not be allowed to strmg projects out for protracted periods of time in order to
justify their workload or their jobs. Cutting any jobs now is not an answer, demanding efficiency and
productivity is.
I appreciate any consideration that you are able to give this matter.

referenced site. S&ME was requested by Mr. Branch Smith, P.E. of GS Engineering
Services on your behalf to perform these services in preparation for the planned site
improvements. S&ME has conducted these services in general accordance with S&ME
Proposal 008A-09 dated December 31, 2009.
PROJECT BACKGROUND
The project site is located at the northwest corner of stone Chimney Road and NC
Highway 211 in Supply, North Carolina. The site is currently an undeveloped parcel that
is relatively flat and has been recently mowed. A site plan showing the proposed
development, including the proposed infiltration basin and stormwater testing locations
(B-1 and B-2), was provided by Mr. Smith. The two stormwater test locations were
staked in the field by others prior to our mobilization to the site.
FINDINGS
Our stormwater testing consisted of two tasks — a seasonal high water table evaluation
and hydraulic conductivity testing. The seasonal high water table evaluations were
performed on January 13, 2010 by advancing hand auger borings to depths ranging from
approximately 35 to 40 inches below the existing ground surface at the test locations
staked in the field.
Soils were. evaluated under the guidance of a Licensed Soil Scientist for evidence of
seasonal high water table influence. This evaluation involved looking at the actual
moisture content in the soil and observing the matrix and mottle colors. Depending on
the soil texture, the soil color will indicate processes that are driven by seasonally high
water table fluctuations, such as iron reduction and oxidation and organic matter staining.

A hand auger boring profile sheet, which provides a description of the observed soil
horizons and the determined seasonal high water tables, has been included with this
report.
The soils at the test locations were observed to range from a sandy loam to a sandy clay
loam. The seasonal high water table was determined to be approximately 20 inches and
25 inches below the existing ground surface at locations B-1 and B-2, respectively.
These depths were verified by Mr. Vincent Lewis, Division of Water Quality, on January
26, 2010 during a site meeting coordinated and attended by Mr. Branch Smith of GS
Engineering Services, PLLC. See Table 1 below for the seasonal high water table depth
at the test locations. The hand auger borings were continued to determine the depth of
actual groundwater, which was encountered at 28 and 27 inches below the existing
ground surface at 13-1 and B-2, respectively.
S&ME performed the in -situ soil hydraulic conductivity testing by using a compact
constant head permeameter at the test locations. A hand auger boring was advanced to a
depth of approximately 6 inches below the existing ground surface with a 3-inch diameter
bucket. The water dissipating unit was lowered to the bottom of the hole, and water was
dispensed from the permeameter. The water was allowed to move through the unit until
steady-state flow was achieved, and then flow rates were recorded. The last three
measurements were averaged to achieve the most representative value to express the
saturated hydraulic conductivity. The depth interval of the tests corresponded to a layer
of material approximately 6 inches thick at the selected testing depths. The permeability
rates were calculated as being 1.12 and 0.29 inches per hour at 13-1 and B-2, respectively.
See the Table 1 below for the hydraulic conductivity rate at the test location.

Please note that the seasonal high water table evaluation is based on secondary evidence
and not on direct groundwater level measurements. Groundwater levels fluctuate for
numerous reasons, and these findings do not indicate that groundwater levels have not or
will not rise above the noted depths.

2. 1 attached a C-4 Grading pdf that shows the drainage area in red that you are looking for and storm inlet areas in blue.
3. A sidewalk detail is shown on attached C-5.1-5.2 pdf that shows the width as 5' which matches the plan. The only
sidewalk is around the building. And it calculates to 900 sgft instead of the 940 sgft I have listed. There used to be a little
portion around the loading dock within the parking lot, which is now gone and asphalt pavement is in its place, so total
impervious should still match. As we still make minor changes to the plan, we will submit any final changes as the review
is completed.

referenced site. S&ME was requested by Mr. Branch Smith, P.E. of GS Engineering
Services on your behalf to perform these services in preparation for the planned site
improvements. S&ME has conducted these services in general accordance with S&ME
Proposal 008A-09 dated December 31, 2009.
PROJECT BACKGROUND
The project site is located at the northwest corner of Stone Chimney Road and NC
Highway 211 in Supply, North Carolina. The site is currently an undeveloped parcel that
is relatively flat and has been recently mowed. A site plan showing the proposed
development, including the proposed infiltration basin and stormwater testing locations
(B-1 and B-2), was provided by Mr. Smith. The two stormwater test Iocations were
staked in the field by others prior to our mobilization to the site.
FINDINGS
Our stormwater testing consisted of two tasks — a seasonal high water table evaluation
and hydraulic conductivity testing. The seasonal high water table evaluations were
performed on January 13, 2009 by advancing hand auger borings to depths ranging from
approximately 35 to 40 inches below the existing ground surface at the test locations
staked in the field.
Soils were evaluated under the guidance of a Licensed Soil Scientist for evidence of
seasonal high water table influence. This evaluation involved looking at the actual
moisture content in the soil and observing the matrix and mottle colors. Depending on
the soil texture, the soil color will indicate processes that are driven by seasonally high
water table fluctuations, such as iron reduction and oxidation and organic matter staining.

A hand auger boring profile sheet, which provides a description of the observed soil
horizons and the determined seasonal high water tables, has been included with this
report.
The soils at the test locations were observed to range from a sandy loam to a sandy clay
loam. The seasonal high water table was determined to be approximately 25 inches and
24 inches below the existing ground surface at locations B-1 and B-2, respectively. See
Table I below for the seasonal high water table depth at the test locations. The hand
auger borings was continued to determine the depth of actual groundwater, which was
encountered at 28 and 27 inches below the existing ground surface at 13-1 and B-2,
respectively.
S&ME performed the in -situ soil hydraulic conductivity testing by using a compact
constant head permeameter at the test locations. A hand auger boring was advanced to a
depth of approximately 6 inches below the existing ground surface with a 3-inch diameter
bucket. The water dissipating unit was lowered to the bottom of the hole, and water was
dispensed from the permeameter. The water was allowed to move through the unit until
steady-state flow was achieved, and then flow rates were recorded. The last three
measurements were averaged to achieve the most representative value to express the
saturated hydraulic conductivity. The depth interval of the tests corresponded to a layer
of material approximately 6 inches thick at the selected testing depths. The permeability
rates were calculated as being 1.12 and 0.29 inches per hour at 13-1 and B-2, respectively.
See the Table 1 below for the hydraulic conductivity rate at the test location.

Please note that the seasonal high water table evaluation is based on secondary evidence
and not on direct groundwater level measurements. Groundwater levels fluctuate for
niunerous reasons, and these findings do not indicate that groundwater levels have not or
will not rise above the noted depths.
