However, subsection (c) allows the Division of Coastal Management to circulate the request to the state agencies to determine if any changes in circumstances or in development standards warrant a new application and CAMA major permit review. DCM is not aware of any proposed changes to the previously authorized project. Upland Development Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including the driveways, condominiums, proposed boardwalk, and associated utilities, all as expressly and specifically set forth in the attached permit application and workplan drawings. Any additional land disturbing activities and/or construction may require a modification of this permit. Signature of Permittee Owinn Hedrick Permit #122-10 Page 2 of 4 ADDITIONAL CONDITIONS Sedimentation and Erosion Control 2) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 3) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). 4) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of any phase of grading on cut or filled slopes. Docking Facility 5) Slip #11 and Slip #12 and the existing mooring (a.k.a Slip #13) off shore (reference "Existing Conditions" received by the DCM on 7/1/10) shall be removed prior to initiating the permitted development. 6) In accordance with commitments made by the permittee, and in order to satisfy concerns of the Division of Marine Fisheries, hand rails or other similar devices shall be installed on the landward side of the "T" head clock to ensure that no dockage takes place within this area. 7) Unless specifically altered herein, this permit authorizes the dock expansion and the proposed covered deck and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 8) All portions of the authorized docking facility, including tie piles, shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor to the south, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. 9) Should the waterfront lot to the north be sold prior to the initiation of construction of the docking facility, the permittee shall obtain a written agreement from the new owner(s) agreeing to allow the construction of the permitted docking facility within 15' of the riparian corridor of that property, and a copy of the new agreement shall be submitted to the Division of Coastal Management prior to initiating construction of the docking facility. 10) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches and knee walls are permitted. Lattice is specifically excluded from being used under this authorization. 11) The roof of the covered platform shall not be designed for second story use. Gwinn Hedrick Permit #122-10 Page 3 of 4 ADDITIONAL CONDITIONS 12) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 13) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 14) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 15) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 1.6) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise. on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 17) This permit authorized ten (10) formalized boatslips. Easement 18) An Easement from the Department of Administration's State Property Office may be required under N.C.G.S. 146-12(e). The permittee shall contact the State Property Office at 919-807-4650 prior to the initiation of construction of any structures over state-owned submerged lands to determine if such an easement will be required. Any required easements shall be obtained, and a copy provided to the Division of Coastal Management at 400 Commerce Avenue, Morehead City, NC 28557, prior to construction of any new boat slips or other docking facilities authorized under this permit. Coastal Wetland Alteration 19) Coastal Wetlands may be cut to a height of no less than six inches, as measured from the Coastal Wetlands substrate. Alteration of the substrate is not allowed. All cuttings/clipping shall remain in place as they fall. General 20) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. Field Investigation Report: Riverwind Condominiums Page 2 9. Narrative Description: The property is located at 236 Blackwell Point Loop Road (SR 1317) in Oriental, Pamlico County. The parcel is a 0.62-acre tract adjacent to Smith Creek. This site is developed with condominium units (existing and under construction), 13-slip marina, bulkhead, and a kayak rack. The adjacent properties are residential to the north and commercial docking facilities to the south. The average elevation of the high ground of the parcel is +3' above the normal water level (nwl). Vegetation on this particular tract is mainly comprised of lawn grasses, with a fringe of Coastal Wetlands along the shoreline. This tract has approximately 225' of continuous shoreline along Smith Creek. Immediate offshore water depths adjacent to the tract range from about -F to -5' nwl. The subaqueous substrate is firm without shell. This waterbody is about 690 feet across at this location. This tributary is a part of the Neuse River basin. These waters of Smith Creek are classified as a Secondary Nursery Area and there is no submerged aquatic vegetation present. This area is closed to shellfish harvest and is classified as SC; Nutrient Sensitive Waters. There is a defined channel in the nearby vicinity of the project area. 10. Proposed Development: The applicant wishes to modify the existing docking facility, alter the Coastal Wetlands, construct a boardwalk, relocate the kayak rack, and complete the construction of the condominium units. The current docking facility has 12 wet slips and 1 mooring buoy, for a total of 13 formalized boat slips. (The DCM can find no record of authorization for Slips #11 & #12, nor the freestanding mooring. Since the applicant is proposing to remove these three slips, no formal enforcement action against the applicant is being pursued by the DCM at this time.) The applicant is proposing to construct a 20' by 20' covered platform on the inside corner of the fixed "T" platform. The existing 6' wide "T" platform will be extended on either side. The south end will be extended 17' and the north end of the "T" will be extended an additional 6'. This expansion will be done in order to enlarge the size of the ten boat slips. The existing outer tie pilings for slips 1-9 will be relocated another 5' waterward and the existing finger piers will be shifted south in order to accommodate wider vessels. These slips can support vessels up to 45' long. These ten boat slips will be in a water depth of approximately -5.5' nwl. This docking facility will extend 135' waterward of the coastal marsh. The upland development will mostly consist of the completion of the construction of five condominium units and their respective driveways. This. work will fill approximately 13,600 square feet of high ground. The existing kayak rack is to be relocated landward to a distance of 51' landward of the nwl and 36' from the landward edge of the Coastal Wetlands. It will be 4' wide and 20' long. The proposed boardwalk is to be constructed on the landward edge of the existing bulkhead. This boardwalk will be 6' wide and 200' long. It will be on high ground. At the south end of the existing bulkhead, the applicant wishes to continue to alter an area of the Brad Connell July 12, 2010 Morehead City Field Investigation Report: Riverwind Condominiums Page 3 Coastal Wetlands. This is to be accomplished by maintaining the height of the vegetation to no shorter than 6" as measured from the substrate. This area of Coastal Wetland alteration will be approximately 15' wide and 15' long. The applicant has historically performed this maintenance of the Coastal Wetland vegetation in this area. The purpose of this continuing vegetation alteration is to maintain an access path to the water. 11. Anticipated Impacts: The docking facility will usurp 22,200 square feet of public trust waters. The docking facility will have 1,590 square feet of platform area along 225' of shoreline. This dock will extend 135' waterward into a 690' wide tributary. It will be more than 80' from the edge of the navigable channel. The waters of Smith Creek are classified as SC, Nutrient Sensitive Waters and are designated as a Secondary Nursery Area. Immediate off shore water depths in the area range from -l' to -5' nwl. These waters are closed to the harvest of shellfish and there are no beds of submerged aquatic vegetation present. The condominiums will impact 10,800 square feet of high ground. There will be 28% of built - upon impervious surface area of the tract within the Estuarine Shoreline Area of Environmental Concern (AEC). The boardwalk will impact 1,200 square feet of Zone 1 of the Neuse River riparian buffer. The kayak rack will impact 80 square feet of Zone 2 of the Neuse River riparian buffer. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 13) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 14) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. Easement 18) An Easement from the Department of Administration's State Property Office may be required under N.C.G.S. 146-12(e). The permittee shall contact the State Property Office at 919-807-4650 prior to the initiation of construction of any structures over state-owned submerged lands to determine if such an easement will be required. Any required easements shall be obtained, and a copy provided to the Division of Coastal Management at 400 Commerce Avenue, Morehead City, NC 28557, prior to construction of any new boat slips or other docking facilities authorized under this permit. Coastal Wetland Alteration 19) Coastal Wetlands may be cut to a height of no less than six inches, as measured from the Coastal Wetlands substrate. Alteration of the substrate is not allowed. All cuttings/clipping shall remain in place as they fall. General 20) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the work or obstructions caused thereby, without expense to the United States or the state of North Carolina. The decks are the same height as the patios so that a handicapped person can leave the enclosed patio and go on to the outside deck over looking the water. DWQ is ok with this as long as I follow the rules they lay out. This is being taken care of by an engineer from RA. He should be finished with the plans which DWQ know he is working on. Just as soon as I receive a copy of the plans to meet DWQ requirements I will send you a copy. Sorry I did not get you the deck plans sooner as DWQ was working on this matter with the engineer and did not mean to keep you out of the loop. I have always tried to keep CAMA and DWQ involved fully in this project. As we have always worked together before starting any work on this project and will continue to do so and follow the rules laid out by CAMA and DWQ. The erosion and sediment control measures for the project must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control Planning and Design Manual. b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. No Waste, Spoil, Solids, or Fill of Any Kind No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the Pre -Construction Notification. Diffuse Flow All stormwater shall be directed as diffuse flow at non -erosive velocities through the protected stream buffers and will not re -concentrate before discharging into the stream as identified within 15A NCAC 02B . 0233 (5). 6. Protective Fencing The outside buffer, wetland or water boundary and along the construction corridor within these boundaries approved under this authorization shall be clearly marked with orange warning fencing (or similar high visibility material) for the areas that have been approved to infringe within the buffer, wetland or water prior to any land disturbing activities to ensure compliance with 15A NCAC 2B . 0233. 7. Certificate of Completion Upon completion of all work approved within this authorization, and any subsequent modifications, the applicant is required to return the attached certificate of completion to the Webscape Unit, North Carolina DWQ, 1650 Mail Service Center, Raleigh, NC, 27699-1650. 8. Deed Restrictions Gwinn Hedrick (permittee) shall execute and cause to be recorded in the Pamlico County Register of Deeds restrictive covenants acceptable to the DWQ for the purpose of maintaining the riparian buffers, as shown on the recorded plat in their natural state in perpetuity, prior to the sale of Units 1 & 2 of River Winds Condominiums in Oriental, NC. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 9) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 10) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 11) The authorized structure and associated activity must not interfere with the public's right to free navigation on all navigable waters of the United States. 12) This permit authorizes an additional 10 formalized boatslips and 4 formalized mooring pilings, for a total of 24 formalized boatslips in association with this marina. Mooring Buoys 13) The moorings shall be marked or colored in compliance with all appropriate U.S. Coast Guard and/or N.C. Wildlife Resources Commission requirements. The required markings shall be maintained for the life of the moorings. Gwinn Hedrick Permit #122-10 Page 3 of 4 ADDITIONAL CONDITIONS 14) The mooring buoy and the attached vessel, as defined by the arc of swing of the moored vessel, shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor. 15) Free standing moorings shall bear the owner's name, state vessel registration and/or US Customs Documentation numbers. Required identification shall be legible for the life of the mooring. 16) The type of material used to anchor the mooring buoy shall be non-polluting and of sufficient weight and design to safely anchor the buoy and vessel. 17) If the use of the freestanding mooring is discontinued for a period of 12 months or more, it shall be removed by the permittee. Easement 18) An Easement from the Department of Administration's State Property Office may be required under N.C.G.S. 146-12(e). The permittee shall contact the State Property Office at (919)-807-4650 prior to the initiation of construction of any structures over state-owned submerged lands to determine if such an easement will be required. LAMA Land Use Plan Conditions 19) In order to ensure compliance with the 2004 Pamlico County CAMA Land Use Plan, the permittee shall install a dry hydrant prior to the occupancy of any slips authorized by this permit. The dry hydrant shall remain in place for the life of the permitted facility. General 20) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the work or obstructions caused thereby, without expense to the United States or the state of North Carolina.
