An updated page 5 is included with Section V.11. completed with the facility design criteria for the proposed modifications including manufacturer or material and the plan sheet and specification references. D. Property Ownership Documentation: 1. The applicant has provided a deed of easement between the related parties so that the property ownership documentation should now meet the requirements of 15A NCAC 02T .0704(f) for all properties associated with the wastewater treatment and high -rate infiltration facilities. An additional copy of those documents is included with this submittal. I. Engineering Plans: 1. Sheet C8 has been updated with the final equipment arrangement. The vehicular accessway has been enlarged and bollards are proposed to provide a barrier between the absorber and vehicular traffic. The sludge connection has been shifted enough that there is sufficient horizontal clearance provided between the sludge wasting quick connect and the adsorber to allow for hook up. 2. Notwithstanding the foregoing, the exact location of the Easement Area shall be selected and approved by Grantor and shown on a survey that is prepared by Grantee and delivered to Grantor. Until the Grantee begins installation of the Groundwater System, the Easement Area may also be relocated subject to the consent of both parties. 3. Relationship of Parties. Nothing in this Agreement shall be construed to make the parties hereto, or their successors or assigns, partners of one another or joint venturers of one another, or in any way to render any of said parties liable for the debts or obligations of the other. 4. No Public Dedication. Nothing contained in this Agreement shall constitute or be deemed to constitute a gift or dedication of any portion of the Easement Area to the general public or for the benefit of the general public or for any public purpose whatsoever, it being the intention of the parties hereto that the Easement conveyed herein will constitute nonexclusive, private easements for the nonexclusive benefit of Grantee, its successors and assigns. 5. Covenant to Run with the Land; Binding Effect. It is the express intention of Grantor that this Agreement shall run with the land, encumbering Grantor's Property, and it shall bind and inure to the benefit of Grantee, its successors, assignees, grantees, mortgagees, tenants, invitees and licensees as their interests may appear. 6. Modifications. No agreement shall be effective to add to, change, modify, waive or discharge this Agreement, in whole or in part, unless such agreement is in writing and signed by both Grantor and Grantee. 7. Work in this section includes providing a foul air carbon adsorber for removal of odorous compounds, primarily consisting of hydrogen sulfide and hydrogen sulfide mercaptans. B. Equipment 1. Odor control vessel shall be constructed of white fiberglass reinforced plastic with 6-inch air inlet and 1'/z" condensation drain. 2. NO CARBON STEEL DRUMS SHALL BE ALLOWED. 3. Odor control vessel shall use a Raised Plenum Airflow Distribution system for even air flow through vessel. 4. Odor control vessel shall be equipped with three (3) air sample ports to indicate when remaining media life is 75%, 50% and 25% for scheduled media change -out. 5. HICARB-721-HC is a special homogenous blend of three different medias for a broad range removal of odors found in wastewater collection systems. 2. Single medias targeting specific odor compounds that do not allow for complete odor control shall not be acceptable. 3. All H2S targeting media shall have a minimum .30 gH2S/cc media breakthrough capacity for hydrogen sulfide. 4. Granular media SHALL NOT be allowed 5. Media shall not require water addition for normal operation. 6. Media shall be completely non -biological and not be dependant on any living organisms for odor removal. 7. Media shall be able to reach full removal efficiency immediately after system startup. 8. Media Life @ 25 ppm average H2S and 1,000 cfm shall be 1-year or greater. QUALITY ASSURANCE A. Start-up and Testing 1. The system manufacturer shall furnish the services of a representative that has complete knowledge of the system and its components, to help with installation and inspect the final installation, train operating personnel in the proper operation and maintenance and to supervise testing of the system. 2. The system shall be tested under actual operating conditions. The supplier shall furnish all labor and equipment necessary for air flow and H2S testing. The test shall last for two (2) consecutive hours and samples shall be taken from the inlet and outlet of the scrubber system to verify performance. B. System Performance 1. The odor control system shall demonstrate the following performance when operating under design flow conditions indicated in the specification. INLET OUTLET 1-10 ppm H2S 0.1 ppm H2S Greater than 10 ppm H2S 99% H2S removal 2. The system shall achieve specified performance immediately upon start-up with no chemical addition and with no biological requirements. Systems requiring an acclamation period to achieve the specified performance shall not be accepted. C. Warranty 1. The equipment (MEDIA EXCLUDED) shall be warranted in both material and workmanship for a period of three (3) years after installation. The vessels consists of a high quality FRP vessel containing H2S specific and virgin carbon polishing media, a raised plenum air inlet distribution system, a corrosion resistant cast aluminum blower with stainless steel washdown duty electric motor that pulls the foul air from the source and pushes it upward through the media in the vessel. The primary H2S specific media removes incoming hydrogen sulfide (H2S) along with some organic type odors. If required, layered and mixed media combinations are available for removal of many organic or mercaptan odors that may be present. The purified air is then discharged via a 10" discharge outlet with rain cap. A 1-1/2" drain valve is provided on the vessel to remove any condensation that may accumulate. Three (3) 1-1/2" sample ports are also located on the side of the vessel for air sampling to help determine remaining media life. 2.0 - INSTALLATION 2.1— (1) Locate vessel and blower in desired location. A firm base of concrete is recommended for permanent installation. (2) Remove top and bottom manways to inspect tank internals for any damage during shipment and to make sure media support and media retention screen are in place. (3) Attach suction pipe from the foul air source to blower inlet using rubber fittings supplied. (4) Attach discharge pipe from rubber fitting supplied on blower to vessel via the supplied rubber fittings. (5) Attach 3" condensate drain valve from vessel to appropriate drain. (6) Remove top manway of vessel and fill with appropriate amount of media. Make sure that carbon media support grating and media retention screen is in place before installing media. PLEASE REFER TO SPECIAL PRECAUTIONS SECTION IN THIS MANUAL BEFORE HANDLING MEDIA. (7) Replace top manway of vessel and replace and tightening all bolts, (8) Make sure blower is properly wired for provided site voltage (Low/High) and make electrical connections to blower control panel. (9) Turn blower on and confirm proper rotation of fan as indicated on fan housing. Should air flow be higher than the recommended airflow (See chart section 2.2) an inline valve or blower VFD may be required for proper air flow adjustment. Since the proper air flow was adjusted at start-up, the valve position or VFD hertz setting should be noted by operator for future reference if needed. 3.2 - Routine checks: Inlet, vessel sample ports, and discharge air should be checked bi-weekly with calibrated H2S meters for H2S concentrations. A record of H2S concentration readings can be useful in estimating media life and media replacement scheduling. The condensate should also be check on a bi- weekly basis. This is achieved by opening the 3" drain valve located at the bottom of the vessel. If only a small amount of water is present, then this task can be performed on a less frequent basis. If excessive amounts of condensation are present, a moisture separator may be needed prior to the blower. Please contact Heyward Incorporated for information regarding the moisture separator. 3.3 - Blower Maintenance: Motor amps should be checked at start-up and recorded for future reference. The stainless steel washdown duty motors have sealed bearings and DO NO require any lubrication 3.4 - Recommended Spare Parts: There are no spare parts required for the HICARB Series Odor Control Vessels. However, it is strongly recommended that a spare charge of replacement media be on hand to eliminate any odor control downtime where odor complaints can arise from. If equipped, the blower VFD panel comes with a spare fuse which is a standard off the shelf item available locally. 4.0 - MEDIA REMOVAL / REPLACEMENT 4.1 - When the media is expended and no longer removing H2S or other odors it requires changing. Remove the top manway of the vessel and use a vac -truck to remove the media. The new media can then be placed into the vessel using step #6 in the installation procedure. Always make sure the carbon media support and media retention screen is in place before installing media. Removed media can generally be taken to a landfill for disposal. Please check with local solid waste authorities for proper disposal. PLEASE REFER TO SPECIAL CAUTIONS SECTION IN THIS MANUAL BEFORE HANDLING MEDIA. 5.0 - SPECIAL PRECAUTIONS 5.1— HICARB ODOR CONTROL SYSTEMS utilize non -hazardous media according to the definition for "Health Hazard" and "Physical Hazard" provided in the OSHA Hazard Communication Law (29 CFR 1910). However, special precautions should be taken when handling media such as the use of dust masks and rubber gloves. 5.2 — IMPREGNATED MEDIA'S - HICARB ODOR CONTROL SYSTEMS WE DO NOT USE NOR DO WE RECOMMEND THE USE OF IMPREGNATED MEDIA'S IN OUR SYSTEMS DUE TO THE RISK OF BED FIRES. WITNESSETH: 1. The DEVELOPER is the owner of the certain lands lying in Select Pender County, upon which it is erecting and will erect dwelling units and other improvements, said development to be known as Lane's Ferry Landing (hereinafter the Development). 2. The DEVELOPER desires, to construct a wastewater collection system with pumps, wastewater treatment works, and/or disposal facilities (hereinafter Disposal System) to provide sanitary sewage disposal to serve the Development on said lands. 3. The DEVELOPER has applied to the COMMISSION. for the issuance of a permit pursuant to G.S. 143-215.1 to construct, maintain, and operate the Disposal System. 4. The DEVELOPER has created or shall create unit ownership in said dwellings units, other improvements and lands through filing of a Declaration of Unit Ownership (hereinafter Declaration), pursuant to Chapter 47C of the North Carolina General Statutes. 5. The DEVELOPER has caused to be formed or will cause to be formed at the time of filing of the Declaration, the Lane's Ferry Landing Association, Inc. (hereinafter Association), a non-profit corporation organized and existing under and by the virtue of the laws of the State of North Carolina, for the purpose, among others, of handling the property, affairs and business of the Development; of operating, maintaining, re -constructing and repairing the common elements of the lands and improvements subject to unit ownership, including the Disposal System; and of collecting dues and assessments to provide funds for such operation, maintenance, re -construction and repair. 6. The COMMISSION desires to assure that the Disposal System of the Development is properly constructed, maintained and operated in accordance with law and permit provisions in order to protect the quality of the waters of the State and the public interest therein. NOW, THEREFORE, in consideration of the promises and the benefits to be derived by each of the parties hereto, the COMMISSION and DEVELOPER do hereby mutually agree as follows: 1. The DEVELOPER shall construct the Disposal System in accordance with the permit and plans and specifications hereafter issued and approved by the COMMISSION, and shall thereafter properly operate and maintain such systems and facilities in accordance with applicable permit provisions and law. 2. The DEVELOPER shall not transfer ownership and/or control of the Disposal System to the Association until construction has been completed in accordance with the permit and approved plans, and the staff of the Division of Water Resources has inspected and approved of the facilities. In order to change the name of the permit holder, the DEVELOPER must request that the permit be reissued to the Association. The request must include a copy of the Association Bylaws and Declaration. 3. The DEVELOPER shall not transfer, convey, assign or otherwise relinquish or release its responsibility for the operation and maintenance of its Disposal System until a permit has been reissued to the DEVELOPER's successor. The DEVELOPER shall provide in the Declaration and Association Bylaws that the Disposal System and appurtenances thereto are part of the common elements and shall thereafter be properly maintained and operated in conformity with law and the provisions of the permit for construction, operation, repair, and maintenance of the system and facilities. The Declaration and Bylaws shall identify the entire wastewater treatment, collection and disposal system as a common element, which will receive the highest priority for expenditures by the Association except for Federal, State, and local taxes and insurance. 5. The DEVELOPER shall provide in the Declaration and Association Bylaws that the Disposal System will be maintained out of the common expenses. In order to assure that there shall be funds readily available to repair, maintain or construct the Disposal System, beyond the routine operation and maintenance expenses, the Declaration and Association Bylaws shall provide that a fund be created out of the common expenses. Such fund shall be separate from the routine maintenance funds allocated for the facility and shall be part of the yearly budget. 6. In the event the common expense allocation and separate fund are not adequate for the construction, repair, and maintenance of the Disposal System, the Declaration and Association Bylaws shall provide for special assessments to cover such necessary costs. There shall be no limit on the amount of such assessments, and the Declaration and Bylaws shall provide that such special assessments can be made as necessary at any time. 7. If a wastewater collection system and wastewater treatment and/or disposal facility provided by any city, town, village, county, water and sewer authorities, or other unit of government shall hereinafter become available to serve the Development, the DEVELOPER shall take such action as is necessary to cause the existing and future wastewater of the Development to be accepted and discharged into said governmenta! system, and shall convey or transfer as much of the Disposal System and such necessary easements as the governmental unit may require as condition of accepting the Development's wastewater. 8. Recognizing that it would be contrary to the public interest and to the public health, safety and welfare for the Association to enter into voluntary dissolution without having made adequate provision for the continued proper maintenance, repair and operation of its Disposal System, the DEVELOPER shall provide in the Association Bylaws that the Association shall not enter into voluntary dissolution without first having transferred its said system and facilities to some person, corporation or other entity acceptable to and approved by the COMMISSION by the issuance of a permit. 9. The agreements set forth in numbered paragraphs 1, 2, 3, 4, 5, 6, 7, and 8 above shall be conditions of any permit issued by the COMMISSION to the DEVELOPER for the construction, maintenance, repair and operation of the Disposal System. 10. A copy of this agreement shall be filed at the Register of Deeds in the County(ies) where the Declaration is filed and in the offices of the Secretary of State of North Carolina with the Articles of Incorporation of the Association.
